Leith Pre-owned 2000 Auto Park Blvd. Cary NC.- BREACH OF CONTRACT
Purchased a Nissan Sentra. We had an agreement to take funds for deposit on a Friday. They decide to take my money 3 days before causing overdraft fees etc. Let's say it was an honest mistake. Due to their chain of command no one was able to address or handle my over drafted account. I call corporate office. When I finally speak to sales manager on day 2 he knows nothing about what happened the day before. What I had going on was not relevant because the bank honored their transaction so they got their money. At 3:10 pm on Day 2 I receive a call from the COO. He let me know quickly that I have no Value to LEITH at all. Let me help LEITH OWNER & MR. COO #1 The Consumer is always right. #2 You deescalate and allow the consumer to express their frustration- When YOU screw up. #3 You never tell a Consumer to HUSH. #4- I am almost certain LEITH pays the COO good money and he was like a bulldog on the phone battling with me for their ERROR. Hear me clearly my $5000+ transaction may be peanuts to you but you will not yell at me, leave my account in over draft for 3 days not pay the fees and make it seem as though its just my problem. I will NEVER purchase or go near LEITH again. I will let everyone know the $$$$$ is more important than the Consumer. Thank you for letting me know what your Brand is all about. You want me to HUSH. You will Hear me at some point.

Leith Honda failed to represent their customer in a warranty dispute and led the charge.2006 Honda Civic "Engine Block Crack" Technical Service Bulletin 10-048: The problem: The engine block may leak coolant, resulting in engine overheating. Corrective action: Dealers will replace the engine block free of charge.Warranty info: Repairs will be done under an extended warranty (10 years from the original date of purchase, no mileage limits). My 2006 Honda Civic was purchased August 14, 2006. On the date of August 12, 2016 (Friday) at or around 5:40 pm EST. the vehicle broke down in motion and was unable to drive due to something involving the engine. The vehicle was towed by [redacted] to our local repair facility. On Monday morning August 15, 2016 the vehicle was diagnosed as having a cracked engine block. With the information I had on hand I contacted American Honda as Consumer Reports advised. Aug 15, 2006: I spoke with a couple friendly reps. I received a case number and was told the vehicle was under warranty and contact the local dealership and inform them of the break down date and tow records. The rep did tell me the warranty had expired on Sunday the day before my call. I immediately called the dealership (Leith Honda-Raleigh) Service Dept. I spoke with a Service Advisor who asked for the Vin#. He initially stated that the Honda's Vin did not show any recalls/warranty for Cracked Engine Blocks. I informed him that I just got off the phone with American Honda and they stated "yes". However, expired yesterday and to inform him of the mechanical breakdown date. Long story short not covered. I called American Honda back and was informed to have the Honda towed to Leith Honda for diagnoses. The next morning Tuesday Aug 16, 2016 the Honda was towed to Leith Honda. One week and a day later (Aug 24, 2016) the Service Advisor called and left a message that it was a Cracked Engine Block. They spoke with some District person and offered us 90% of the cost of repair. I am to pay 10% of the repair. My estimated cost $375.00 I spoke with the Service Advisor and tried to explain to him the warranty was for 100% and the breakdown date. He stated that the warranty would have been in effect if it was originally towed to Leith Honda. Leith Honda did not want to see the [redacted] tow records. I called back to American Honda (Aug 24, 2016) and informed them of same. American Honda assigned a Case Manager. The case Manager called the next day and asked me to fax him copies of the tow records. The tow records were faxed within an hour.Desired SettlementI want Leith Honda to refund all cost to the repair.Coils and gasket heads were to be replaced if damaged.We are not asking for any monies toward towing or alternate transportation.I was working with American Honda and things were going great until Leith Honda did more than they were supposed to do.Leith Honda was to only diagnose the vehicle. Make a report American Honda.Instead they contacted someone district service person.Leith Honda never asked for records of the break down date, nor did they care.My initial phone call to Leith Honda the service advisor pretended he knew no such warrant.I briefed on same as he sounded to be clueless.As you can see he be came brief on the situation later.This same service advisor stated to me that we only took the vehicle in for service twice since originally bought.He made me to believe that if we have given Leith Honda business after the purchase would be covered.Above and beyond the Engine block damage. Leith is charging me for coils and gasket head damage.These damages are covered on the extended warranty I have the American Honda Letter to consumers and recordings of Leith Honda and American Honda if needed.Business Response Thank you for the opportunity to respond to Mr. [redacted]'s concern.Mr. [redacted] called American Honda Motor Co. and he was advised to take the car to a Honda Dealer to verify the concern to be considered for Goodwill assistance. No case manager was assigned at that time. When Mr. [redacted] called Leith Honda, We performed a Vehicle Identification Number search in Honda's database to determine if there was any warranty coverage. There was no warranty coverage available for this car as it was deleted by American Honda as soon as it expired. Mr. [redacted] is stating that we did not follow his instructions to call our customer relations number. Decisions for assistance go through the District Parts and Service Manager regardless of Who is called.Mr.[redacted] had not spoken to a Case manager at Customer relations at this point, so we followed proper protocol and called the District Manager.Mr.[redacted] was offered 90% of the Engine block repair. After disassembly, it was determined that the engine was so severely overheated the head was damaged beyond repair. Several other engine components were melted and not reusable (dipstick,coils etc ). The damage to the cylinder head and related components is due to customer negligence. It is the customers responsibility to properly service the car. It is also the customers responsibility to monitor the gauges to ensure proper vehicle operation. The customer stated the check engine light was flashing. The owners manual clearly states if the light is flashing, engine damage is occurring. Stop operation of the vehicle.Service bulletin 10-048 guides the technicians to find the source of the coolant leaks because they are very minor and only seep over time. Proper maintenance would have detected this long before damage was done to the engine.American Honda stepped up and covered 100% of the engine block repair and 50% of the cylinder head and damaged components. Leith Honda is not responsible any manufacturer goodwill assistance. Consumer Response Leith Honda and/or Leith Inc. response to my complaint is not acceptable. I fully disagree with their alleged comments.1. Vehicle was warranted until Aug 14, 2016. The well-known defect occurred on Aug 12, 2016. The cracked engine block left my vehicle non-operational while driving with no power. Safety was our main concern. The vehicle had to be pushed off the roadway. This occurred in the evening.2. Leith Honda and American Honda was closed on Aug 14, 2016. I did call American Honda first thing in the morning PST (Aug 15). American Honda stated the vehicle was under warranty and to call the dealership and inform them of the breakdown date and tow records. If I had problems call back and they will assign a Case Manager.3. I called Leith Honda service. Service Advisor stated the vehicle was not in warranty and was not familiar with the known Technical Service Bulletin 10-048 (TSB). I explained that I had just got off the phone with American Honda and they stated it was. I just needed to tell them the breakdown down date and tow records. Service Advisor continued to deny warranty repairs nor wanted to see tow records. I told him I had a case number from American Honda and he did not care.4. Aug 15, 2016, after the call to Leith Honda, I called American Honda again. They advised to have the vehicle towed to Leith Honda for a diagnosis. The vehicle was towed to Leith Honda on Aug 16, 2016 in the morning. Prior to the tow I left a voice message with Leith Honda service that the vehicle was being towed to them for the Engine (cylinder) block crack. The vehicle needed to be diagnosed for American Honda.5. Calls were made to Leith Honda during the week for an outcome. The vehicle was never taken into service for an evaluation.6. One week and a day later (Aug 24, 2016) the Service Advisor called and left a message that it was a Cracked Engine Block. They spoke with some District person and offered us 90% of the cost of repair. I am to pay 10% of the repair. Leith Honda was only to diagnose the vehicle and report to American Honda, not a rep. My estimated cost was $375.00. Read Leith response. They state it was 100%. Truly a lie or a typo. I paid 10% of this repair.7. As a result, I called back to American Honda (Aug 24, 2016) and informed them of same. American Honda assigned a Case Manager. The case Manager called the next day and asked me to fax him copies of the tow records. The tow records were faxed within an hour.8. Aug 25, 2016 Leith Honda called again asking about having the repairs done. I stated that it should be 100%. He stated that I could call American Honda but they have already done that and it is 90/10 split. I informed him that I had already done so and they assigned a Case Manager. He was also informed they had no records of Leith Honda contacting them about the vehicle. I got a little pause, then an ok. I asked once again do you want the case number. This time he took it.9. Within 45 minutes Leith Honda's service advisor calls me back being loud and angry, stating they can rescind the offer anytime. Take it or they will rescind it. He stated that Leith Honda is not going to change their mind. He was upset that we have only taken the vehicle twice for service to them, one for a paint warrant and battery. Either a lie or typo in their system.10. Leith Honda states the vehicle was not regularly maintained. This is an assumption on their part. US laws states I do have to have my vehicle serviced at the dealership to uphold its warranty. Please see Magnuson- Moss Warranty Act. 11. "An independent mechanic, a retail chain shop, or even you yourself can do routine maintenance and repairs on your vehicle. In fact, the Magnuson-Moss Warranty Act, which is enforced by the FTC, makes it illegal for manufacturers or dealers to claim that your warranty is void or to deny coverage under your warranty simply because someone other than the dealer did the work. The manufacturer or dealer can, however, require consumers to use select repair facilities if the repair services are provided to consumers free of charge under the warranty."12. Leith Honda is lying again or misheard something. The Check engine light nor overheating light was not flashing. You will find many cases reported on the internet and NHTSA reporting same.13. TSB directly tells service techs what to look for and repair. This means replacing coils and head gasket if damaged.14. Technical Service Bulletin 10-048: The problem: The engine block may leak coolant, resulting in engine overheating.15. TSB even states over heating. This will cause other damage that is not the fault of the owner but the faulty engine block.16. Conclusion: Vehicle was in warranty at the time of breakdown. Vehicle was maintained. We were never offered 100% for the engine block. Leith Honda failed to mention we paid 10% of the coils being replaced. Goodwill offers are for vehicles out of warranty. Leith Honda over stepped their bounds with myself and American Honda. American Honda changed their attitude after being contacted by Leith Honda.17. I do have recordings of Leith Honda Service Advisor and American Honda. We are in a one party state so it is legal.18. Leith Honda has lied on me and now American Honda. Complete false statement. "American Honda stepped up and covered 100% of the engine block repair and 50% of the cylinder head and damaged components. Leith Honda is not responsible any manufacturer goodwill assistance."19. Leith Honda continues to lie, misrepresent facts, to confuse consumers about who and whom they may take their vehicle to for regular service to maintain a warranty.20. Take their word for what it is worth.Final Business Response Thank you for the opportunity to respond. If Mr. [redacted] will look at the repair order he will see that American Honda paid for the engine block at 100% ( line A ). The additional repairs that are not covered by any warranty were Goodwill warranted at 50%. The service bulletin only covers the engine block.Leith Honda performs warranty work for American Honda. Leith Honda operates under the guidelines set up for the dealer network and does not set policy. It does state no charge for the engine block. I also noted close to $100.00 of charges that I was not aware of. The last conversation I had with the service advisor was a 90/10 split on the engine block. “Take it or leave it. This is this dealerships opinion and you can take it or not. We can rescind it at any time.”The receipt was not reviewed simply because you know what you were told, so pay the bill or get a mechanics lien. After getting the vehicle back it was driven to our service professional to complete other work that Leith recommended. We lost trust in Leith. Sadly we have two other vehicles that if needed to be serviced by the dealer, it would be a Leith dealership. Re-thinking this and looking into out of market dealers.Lack of this service advisor communicating with the consumer has caused this customer to write negative reviews on Leith Inc. and American Honda.He could have made a courtesy call or met my daughter at pickup and informed her of the change of opinion to pay 100% of the engine block.Another reason I disagree with Leith is because they represent their consumer to American Honda.There was nothing wrong with my cylinder head gasket prior to the engine block crack. The problem is the known engine defect that caused the head gasket warp.More Info Received From The BusinessAs previously stated, Leith Honda does not control warranty work. We preform work as directed by American Honda. I cannot help that Mr. [redacted] did not want us to follow the procedure that American Honda requires in our business operations manual. We contacted the appropriate Decision maker at Honda and he was in contact with The representative Mr. [redacted] spoke with. The decision was made by the correct personnel using the correct procedure.

I have experienced the biggest run around on warranty issues with this company. They have been stringing me along for more than one year. They are just waiting for the warranty on the car to run out so that they do not have to honor anything that is wrong with the vehicle.
The car is losing oil somehow. It is documented as when I go to get my oil changed, they tell me that the car is almost bone dry. This can destroy the engine. I am still within the 100,000 mile warranty on the engine. They have done 2 oil consumption tests that find the car up to 1 quart of oil down every 1000 miles, but they will do nothing about it. Every time I go there, I get a different answer as to what I should do or not do. The last time, they just said, here is the phone number for Honda Call them.
I cannot afford another vehicle, and I am not a mechanic, I don't understand why they would treat their customers like that. I have spoken to the manager who simply doesn't care. I will never buy another vehicle from this company again since they obviously don't want to take care of their customers.

After 6 years and four brand new cars, Mercedes Benz of Cary NC has asked me not to come shop there anymore, or to service my cars. They claim it's because of my bad language, accept there are no instances or examples given to me. They won't return emails and my SA has been ordered to ignore me. They lied when I called to ask for my SA by saying she's not available. The manager, whom I have never even met, told me he can make these sorts of decisions without having to ask his boss.......so now I will go find somewhere else to spend more money and get my cars serviced. I was very offended by this choice and not given a chance to even rectify my 'bad language'.

On the date of August 12, 2016 (Friday) at or around 5:40 pm EST. the vehicle broke down in motion and was unable to drive due to something involving the engine. Leith Honda failed to represent their customer in a warranty dispute and led the charge.2006 Honda Civic "Engine Block Crack" Technical Service Bulletin 10-048: The problem: The engine block may leak coolant, resulting in engine overheating. Corrective action: Dealers will replace the engine block free of charge.Warranty info: Repairs will be done under an extended warranty (10 years from the original date of purchase, no mileage limits). My 2006 Honda Civic was purchased August 14, 2006. On the date of August 12, 2016 (Friday) at or around 5:40 pm EST. the vehicle broke down in motion and was unable to drive due to something involving the engine. The vehicle was towed by [redacted] to our local repair facility. On Monday morning August 15, 2016 the vehicle was diagnosed as having a cracked engine block. With the information I had on hand I contacted American Honda as Consumer Reports advised. Aug 15, 2006: I spoke with a couple friendly reps. I received a case number and was told the vehicle was under warranty and contact the local dealership and inform them of the break down date and tow records. The rep did tell me the warranty had expired on Sunday the day before my call. I immediately called the dealership (Leith Honda-Raleigh) Service Dept. I spoke with a Service Advisor who asked for the Vin#. He initially stated that the Honda's Vin did not show any recalls/warranty for Cracked Engine Blocks. I informed him that I just got off the phone with American Honda and they stated "yes". However, expired yesterday and to inform him of the mechanical breakdown date. Long story short not covered. I called American Honda back and was informed to have the Honda towed to Leith Honda for diagnoses. The next morning Tuesday Aug 16, 2016 the Honda was towed to Leith Honda. One week and a day later (Aug 24, 2016) the Service Advisor called and left a message that it was a Cracked Engine Block. They spoke with some District person and offered us 90% of the cost of repair. I am to pay 10% of the repair. My estimated cost $375.00 I spoke with the Service Advisor and tried to explain to him the warranty was for 100% and the breakdown date. Prior to the tow I left a voice message with Leith Honda service that the vehicle was being towed to them for the Engine (cylinder) block crack. The vehicle needed to be diagnosed for American Honda.5. Calls were made to Leith Honda during the week for an outcome. The vehicle was never taken into service for an evaluation.6. One week and a day later (Aug 24, 2016) the Service Advisor called and left a message that it was a Cracked Engine Block. They spoke with some District person and offered us 90% of the cost of repair. I am to pay 10% of the repair. Leith Honda was only to diagnose the vehicle and report to American Honda, not a rep. My estimated cost was $375.00. Read Leith response. They state it was 100%. Truly a lie or a typo. I paid 10% of this repair.7. As a result, I called back to American Honda (Aug 24, 2016) and informed them of same. American Honda assigned a Case Manager. The case Manager called the next day and asked me to fax him copies of the tow records. The tow records were faxed within an hour.8. Aug 25, 2016 Leith Honda called again asking about having the repairs done. I stated that it should be 100%. Within 45 minutes Leith Honda's service advisor calls me back being loud and angry, stating they can rescind the offer anytime. Take it or they will rescind it. He stated that Leith Honda is not going to change their mind. He was upset that we have only taken the vehicle twice for service to them, one for a paint warrant and battery. Either a lie or typo in their system.10. Leith Honda states the vehicle was not regularly maintained. This is an assumption on their part. US laws states I do have to have my vehicle serviced at the dealership to uphold its warranty. Please see Magnuson- Moss Warranty Act. 11. "An independent mechanic, a retail chain shop, or even you yourself can do routine maintenance and repairs on your vehicle. In fact, the Magnuson-Moss Warranty Act, which is enforced by the FTC, makes it illegal for manufacturers or dealers to claim that your warranty is void or to deny coverage under your warranty simply because someone other than the dealer did the work. The manufacturer or dealer can, however, require consumers to use select repair facilities if the repair services are provided to consumers free of charge under the warranty."12. Leith Honda is lying again or misheard something. The Check engine light nor overheating light was not flashing. You will find many cases reported on the internet and NHTSA reporting same.13. TSB directly tells service techs what to look for and repair. This means replacing coils and head gasket if damaged.14. I have been trying to get a refund for my GAP insurance. However, the dealer keeps avoiding my request. I purchased a car from Leith Lincoln on November 6, 2015 and was convinced to purchase GAP insurance. The contract for the GAP insurance states that a refund can be given upon cancellation up to a total loss of a vehicle. It even has a clause that a full refund can be given if cancelled within 60 days. The instructions are to send a letter to the dealer requesting cancellation. I sent 4 letters to Leith Lincoln (the address on the contract and then to the address in Google). My first letter was sent on November 25 then one letter every 3 weeks after that since I received no response. After 3 months of not receiving a response, I reached out directly to the dealer via phone and spoke with [redacted] in Finace. I explained my problem with having my GAP insurance cancelled and refunded. He stated he would call me back and or email me an update on my status. However, I had to call back 3 more times and on March 12, 2015 he stated that the cancellation was processed and that my bank should receive a refund. After 2 months I reached out to Leith Lincoln again and each time [redacted] in Finance stated he would get an update on my cancellation. However, after 3 calls in the past 2 weeks I have not received a response. It has been over 6 months since my first request for GAP cancellation.Desired SettlementI would like a refund for the GAP insurance purchased. Failed to correct maintenace issues based on repair diagnostic codes. Recommended a corrective action that wasn't required and did not fix the issue.On 19 November 2014 I had my wifes 2010 Jeep Patriot towed into [redacted] Chrysler Jeep. The vehicle was sluggish and skipping at approximately 11:00 AM. I met the tow truck at the dealship and informed [redacted] about my issues and that the ETC light was on. At 1:30 I called [redacted] he informed me the car had not been looked at yet, but soon. Around 3:00 pm, I called back and Mr [redacted] he informed me the tech recommends a tune up and fuel induction service would be a start to resolve the issue. I mentioned the car had a tune up probably 20k miles ago, he said well this is what the tech recommends, so I agreed because they are the authority. I went by later that evening paid for the service $336.46. My wife drove the car home. within a few days she said if feels like it is skipping again. on Nov 30th the car had the same symptoms.This time I brought the vehicle to chris leith Dodge. I met with [redacted] A service advisor and explained my situation and the symptoms of the vehicle. They ran the diagnostic and said they needed to change the Throttle body which just so happens to the part that relates to the warning light on the dash board. He also mentioned the car required a fuel induction cleaning which jeep supposidly already did. I mentioned that to him and he said let me check I will call you back. [redacted] called me back and said he could not speek for the other service people at Jeep but it definately needed this service. Total cost of this $651.78. I would recommend Chris leith Dodge in a heart beat. In regard to Jeep I felt they misdiagnosed did not service the codes and that the work they did was ill advised and not needed. I drove my car to the dealership to fix a transmission problems and the car was driving fine. Now they tell me it doesn't run.I took my car in for a transmission problem and it was driving fine minus a couple leaks and the car shifting. I try to come pick it up and they said my car was driving earlier but there's an alternator problem with a battery problem. I had the altenator and battery checked before taking it in and it was completely fine. Now the problem I paid 600$ to fix isn't working and I have to pay over 3000 in repair it to just start it up. I have a 2010 BMW 128i I bought it certified pre-owned. I rarely drove the car because all the dash lights were on most of the time. I had the car towed to the dealership multiple times to get fixed. I had to pay a 50 dollar copay most of the time and I would leave the dealership and the lights would come right back on. The car was under warranty and it was never fixed and they just took my copay. Before the warranty ran out I had it towed one more time because the lights had been on as usual and the guy told me it was just the battery. I got the battery replaced and my car registered many faulty codes, so I was lied to about the battery being the issue. He also told me the battery wasn't covered under warranty and I would have to pay for it. I find it funny that the one thing that is not covered under warranty was what he says the issue was. Now 500 dollars latter I am expected to spend more money to fix a car they never fixed. I also took the car to southern states BMW and they said I would have to pay 190 dollars a hour to figure out what's wrong. When they told me it was the battery. Leith BMW of Raleigh NC nor Southern States BMW of Chapel Hill NC never fixed the problem. This is a 33,000 vehicle with only 28,000 miles on it. I find this very unsettling! Upon review of the service file we found initially, in March 2015, that a faulty IBS (that is a intelligent battery sensor in laymen's terms)had failed on the client's vehicle. This defective part caused a myriad of other faults. We replaced this part under the client's CPO warranty and upon its replacement the vehicle still had a fault for the left rear wheel speed sensor. We then also replaced the left rear sensor under the CPO warranty that same visit. The client returned 2 months later on June 29, 2015 with complaints of warning lights. We inspected the car and found that the faults that we had addressed in March had not returned but a fault was then present for a right front wheel speed sensor. We replaced that part as well for the client and the repair was covered by her CPO warranty. We have not seen the vehicle back for any diagnosis or repairs in the last 8 months?? The client being charged the standard $50 deductible for BMW CPO warranty repairs is a standard fee that all BMW CPO warranty repairs incur and therefore we would not consider refunding the deductible for these needed past repairs. The vehicle's CPO coverage has expired by time in December 2015 and if there were any issues with the vehicle, all the client had to do was bring it back to us and allow us to address the concerns for her before this expiration date. I would also like to clarify to the client that a failed/depleted battery is a covered repair in most cases during the terms of the NEW CAR limited warranty for the first 4yrs/50k miles (whichever comes first) but the battery is NOT COVERED under the terms of the BMW CPO warranty, so she was correctly advised by whomever provided her with that information.Although the vehicle is now out of CPO warranty coverage, Leith BMW would be willing to invite the client back to check the vehicle and see what kind of issues and faults that the vehicle has now. We would be willing to waive the initial diagnostic fees for routine inspection and fault code discovery but if the diagnosis became excessively long or complicated the client would need to contribute to the cost of the process. Once we discover what concerns the vehicle has now Leith BMW would be willing to reach out to BMW NA on the client's behalf and attempt to solicit assistance with needed repairs from BMW NA. This is just an offer to check out the vehicle for the client and seek BMW NA assistance and in no way guarantees that financial assistance for whatever needed repairs will be provided nor eliminates the possibility of cost of repair of the vehicle to the client.In summary, whenever the car has been brought into our shop, we have diagnosed and correctly repaired the current issue that was presented to our staff by the vehicle. See complaint description belowIssue:I purchased a Honda Accord Sport model from Leith Honda in Wake Forrest, NC during the month of February, 2016.The vehicle had the following issues at the time of sale:1. Paint Scratches2. Noise coming from the driver's side dashboard3. Protective Coating purchased at time of sale needed to be applied.On February 23 2016, I informed[redacted], my sales consultant, that their contracted paint company couldn't repair the vehicle for close to a month after my date of purchase.He replied with the following:"I just ran it by a manager, and he offered our apologies, but, the best thing to do is to get the scratch fixed, then do the Simonize. We understand how frustrating it is"I then contacted the dealership's general manager and [redacted] Honda responded by giving me a rental car and taking my car in to have all issues fixed. They took my vehicle in on March 4, 2016.On March 11, 2016, Leith's Service department contacted me informing me all issues were resolved but that they found another scratch on a car and that the sales department wouldn't pay to have the scratch repaired. In an email dated March 11, 2016, I requested that [redacted] Honda tell me in writing why they wouldn't repair the scratch. Leith Honda then called me back and said that they would pay to have the scratch repaired.Leith Honda's service department contacted me on March 28, 2016 to inform me all issues had been resolved with my vehicle. I picked the vehicle up on this same day.The vehicle still had a very noticeable sound coming from the driver's side dashboard. At this point, I also spoke on the phone with the dealership's general manager (March 29, 2016).Leith Honda's GM claimed that I delayed picking the car up on time even though I picked up the car the same day their service department informed me that it was ready to be picked up. At this time, I also explained to him that the noise happens when materials in the dashboard expand during warm weather and that it didn't make sense for me to ride with a technician. They needed to let the car sit in warm weather and then drive it. The noise had occurred previously in warm weather and their technician had heard the noise previously and thought that he had repaired it. A technician contacted me on March 30, 2016. The first question he asked was if I could ride with him. This is when it became apparent that there was a lack of communication between the dealership's service department and GM. The technician was the 3rd person at Leith Honda to whom I had explained why it didn't make sense for me to ride with a technician, especially when the car hadn't been sitting in warm weather. The technician then picked up my car and the dealership GM contacted me 4 hours later telling me that there was no issue with my vehicle. The dealership's GM also claimed that I had told him I would ride with a technician which was completely inaccurate. I had told him I would ride with a technician if the technician could re-create the noise and drive the vehicle to my location. This is the second time he made inaccurate statements while dealing with me.I have owned the vehicle for less than 60 days. Complaint[redacted] Nissan incorrectly diagnosed the electrical problem on my vehicle and brushed it off as a maintenance item (bushing replacement).I was in an accident on 2/17/15 where my convertible top wiring was damaged. They worked actively with the [redacted] Center and [redacted] to "fix" it when it was stuck open around october 2015. They basically Saudered wires, which I believe is not a good fix for these wires. Regardless I am still having new problems show up on the convertible system. It was taken back to the shop and they are trying to cover up the wiring by saying the problems are due to bushings. They are being very dishonest with me and are not fixing the electrical issue. They should have suggested replacing the whole soft top, this should have been the correct thing to do. And now they are covering it up and brushing it under the rug. They diagnosed the problem incorrectly(to cover up their blunder and possibly [redacted] and [redacted] when its obviously an electrical problem. Now I'm stuck with a malfunctioning convertible top and [redacted] won't pay for the repairs until this is diagnosed for it is... A huge electrical problem!Desired SettlementMake sure the diagnosis is correct. Admit that there is still an electrical issue with the convertible top.Business Response On April 16,2015 a 2010 Nissan 370Z was brought to Leith Nissan by [redacted] The miles at this time was 32,965. When they brought the vehicle in they stated that when the customer was opening the convertible top it froze, then the back dropped down then they had to help the front close manually. At that time my technician looked at the vehicle and found code (XXXXX) isolated to roof state incorrect codes preventing top from operating. The technician cleared the roof state incorrect codes and performed calibration . The tech then operated top several times to verify top is in correct state. [redacted] picked up the vehicle on April 17,2015. The next time we had the vehicle was October 14,2015 [redacted] brought the vehicle back to us the mileage was 38,461. They stated that the convertible top was not working at all. Tech found broken wires in a worn harness and soldered three wires. There is a bulletin by Nissan that it is perfectly fine to repair Nissan wire harness for the top and that you do not have to replace the harness. The vehicle was picked up by [redacted] Collision on Oct 23,2015 with the top working perfect. On February 18,2016 at 41,526 miles the vehicle was brought back to us by [redacted] saying that the top seems to be opening and closing hard. The technician looked at the vehicle and found that both sets of hinges are worn, The storage compartment cover is torn and clips missing. We sent the vehicle back to [redacted] at this time with no repair. On March 8,2016 at 42,103 miles the vehicle came back with [redacted] The customer Mr. [redacted] and [redacted] from [redacted] They asked us to look the vehicle over and let them know what it needs to repair the vehicle from opening and closing hard. We put Mr. [redacted] in a XXXX XXXZ belonging to [redacted] Nissan at no charge to the customer for him to drive. The next day we had an estimate together for the Hinges and storage compartment cover, we called [redacted] at Geico and he came out looked at the estimate and authorized Leith Nissan to order the parts for the vehicle. The vehicle was purchased used by Mr. [redacted]. The three times that Leith Nissan has looked at the vehicle over the past year and 9,138 miles the vehicle has been looked at for three different complaints on the top. The parts are still on order for the last complaint and the vehicle is in our possession while we wait for the parts which are 5-7 days out.

Leith Honda failed to represent their customer in a warranty dispute and led the charge.2006 Honda Civic "Engine Block Crack" Technical Service Bulletin 10-048: The problem: The engine block may leak coolant, resulting in engine overheating. Corrective action: Dealers will replace the engine block free of charge.Warranty info: Repairs will be done under an extended warranty (10 years from the original date of purchase, no mileage limits). My 2006 Honda Civic was purchased August 14, 2006. On the date of August 12, 2016 (Friday) at or around 5:40 pm EST. the vehicle broke down in motion and was unable to drive due to something involving the engine. The vehicle was towed by [redacted] to our local repair facility. On Monday morning August 15, 2016 the vehicle was diagnosed as having a cracked engine block. With the information I had on hand I contacted American Honda as Consumer Reports advised. Aug 15, 2006: I spoke with a couple friendly reps. I received a case number and was told the vehicle was under warranty and contact the local dealership and inform them of the break down date and tow records. The rep did tell me the warranty had expired on Sunday the day before my call. I immediately called the dealership (Leith Honda-Raleigh) Service Dept. I spoke with a Service Advisor who asked for the Vin#. He initially stated that the Honda's Vin did not show any recalls/warranty for Cracked Engine Blocks. I informed him that I just got off the phone with American Honda and they stated "yes". However, expired yesterday and to inform him of the mechanical breakdown date. Long story short not covered. I called American Honda back and was informed to have the Honda towed to Leith Honda for diagnoses. The next morning Tuesday Aug 16, 2016 the Honda was towed to Leith Honda. One week and a day later (Aug 24, 2016) the Service Advisor called and left a message that it was a Cracked Engine Block. They spoke with some District person and offered us 90% of the cost of repair. I am to pay 10% of the repair. My estimated cost $375.00 I spoke with the Service Advisor and tried to explain to him the warranty was for 100% and the breakdown date. He stated that the warranty would have been in effect if it was originally towed to Leith Honda. Leith Honda did not want to see the [redacted] tow records. I called back to American Honda (Aug 24, 2016) and informed them of same. American Honda assigned a Case Manager. The case Manager called the next day and asked me to fax him copies of the tow records. The tow records were faxed within an hour.Desired SettlementI want Leith Honda to refund all cost to the repair.Coils and gasket heads were to be replaced if damaged.We are not asking for any monies toward towing or alternate transportation.I was working with American Honda and things were going great until Leith Honda did more than they were supposed to do.Leith Honda was to only diagnose the vehicle. Make a report American Honda.Instead they contacted someone district service person.Leith Honda never asked for records of the break down date, nor did they care.My initial phone call to Leith Honda the service advisor pretended he knew no such warrant.I briefed on same as he sounded to be clueless.As you can see he be came brief on the situation later.This same service advisor stated to me that we only took the vehicle in for service twice since originally bought.He made me to believe that if we have given Leith Honda business after the purchase would be covered.Above and beyond the Engine block damage. Leith is charging me for coils and gasket head damage.These damages are covered on the extended warranty I have the American Honda Letter to consumers and recordings of Leith Honda and American Honda if needed.Business Response Thank you for the opportunity to respond to Mr. [redacted]'s concern.Mr. [redacted] called American Honda Motor Co. and he was advised to take the car to a Honda Dealer to verify the concern to be considered for Goodwill assistance. No case manager was assigned at that time. When Mr. [redacted] called Leith Honda, We performed a Vehicle Identification Number search in Honda's database to determine if there was any warranty coverage. There was no warranty coverage available for this car as it was deleted by American Honda as soon as it expired. Mr. [redacted] is stating that we did not follow his instructions to call our customer relations number. Decisions for assistance go through the District Parts and Service Manager regardless of Who is called.Mr.[redacted] had not spoken to a Case manager at Customer relations at this point, so we followed proper protocol and called the District Manager.Mr.[redacted] was offered 90% of the Engine block repair. After disassembly, it was determined that the engine was so severely overheated the head was damaged beyond repair. Several other engine components were melted and not reusable (dipstick,coils etc ). The damage to the cylinder head and related components is due to customer negligence. It is the customers responsibility to properly service the car. It is also the customers responsibility to monitor the gauges to ensure proper vehicle operation. The customer stated the check engine light was flashing. The owners manual clearly states if the light is flashing, engine damage is occurring. Stop operation of the vehicle.Service bulletin 10-048 guides the technicians to find the source of the coolant leaks because they are very minor and only seep over time. Proper maintenance would have detected this long before damage was done to the engine.American Honda stepped up and covered 100% of the engine block repair and 50% of the cylinder head and damaged components. Leith Honda is not responsible any manufacturer goodwill assistance. Consumer Response Leith Honda and/or Leith Inc. response to my complaint is not acceptable. I fully disagree with their alleged comments.1. Vehicle was warranted until Aug 14, 2016. The well-known defect occurred on Aug 12, 2016. The cracked engine block left my vehicle non-operational while driving with no power. Safety was our main concern. The vehicle had to be pushed off the roadway. This occurred in the evening.2. Leith Honda and American Honda was closed on Aug 14, 2016. I did call American Honda first thing in the morning PST (Aug 15). American Honda stated the vehicle was under warranty and to call the dealership and inform them of the breakdown date and tow records. If I had problems call back and they will assign a Case Manager.3. I called Leith Honda service. Service Advisor stated the vehicle was not in warranty and was not familiar with the known Technical Service Bulletin 10-048 (TSB). I explained that I had just got off the phone with American Honda and they stated it was. I just needed to tell them the breakdown down date and tow records. Service Advisor continued to deny warranty repairs nor wanted to see tow records. I told him I had a case number from American Honda and he did not care.4. Aug 15, 2016, after the call to Leith Honda, I called American Honda again. They advised to have the vehicle towed to Leith Honda for a diagnosis. The vehicle was towed to Leith Honda on Aug 16, 2016 in the morning. Prior to the tow I left a voice message with Leith Honda service that the vehicle was being towed to them for the Engine (cylinder) block crack. The vehicle needed to be diagnosed for American Honda.5. Calls were made to Leith Honda during the week for an outcome. The vehicle was never taken into service for an evaluation.6. One week and a day later (Aug 24, 2016) the Service Advisor called and left a message that it was a Cracked Engine Block. They spoke with some District person and offered us 90% of the cost of repair. I am to pay 10% of the repair. Leith Honda was only to diagnose the vehicle and report to American Honda, not a rep. My estimated cost was $375.00. Read Leith response. They state it was 100%. Truly a lie or a typo. I paid 10% of this repair.7. As a result, I called back to American Honda (Aug 24, 2016) and informed them of same. American Honda assigned a Case Manager. The case Manager called the next day and asked me to fax him copies of the tow records. The tow records were faxed within an hour.8. Aug 25, 2016 Leith Honda called again asking about having the repairs done. I stated that it should be 100%. He stated that I could call American Honda but they have already done that and it is 90/10 split. I informed him that I had already done so and they assigned a Case Manager. He was also informed they had no records of Leith Honda contacting them about the vehicle. I got a little pause, then an ok. I asked once again do you want the case number. This time he took it.9. Within 45 minutes Leith Honda's service advisor calls me back being loud and angry, stating they can rescind the offer anytime. Take it or they will rescind it. He stated that Leith Honda is not going to change their mind. He was upset that we have only taken the vehicle twice for service to them, one for a paint warrant and battery. Either a lie or typo in their system.10. Leith Honda states the vehicle was not regularly maintained. This is an assumption on their part. US laws states I do have to have my vehicle serviced at the dealership to uphold its warranty. Please see Magnuson- Moss Warranty Act. 11. "An independent mechanic, a retail chain shop, or even you yourself can do routine maintenance and repairs on your vehicle. In fact, the Magnuson-Moss Warranty Act, which is enforced by the FTC, makes it illegal for manufacturers or dealers to claim that your warranty is void or to deny coverage under your warranty simply because someone other than the dealer did the work. The manufacturer or dealer can, however, require consumers to use select repair facilities if the repair services are provided to consumers free of charge under the warranty."12. Leith Honda is lying again or misheard something. The Check engine light nor overheating light was not flashing. You will find many cases reported on the internet and NHTSA reporting same.13. TSB directly tells service techs what to look for and repair. This means replacing coils and head gasket if damaged.14. Technical Service Bulletin 10-048: The problem: The engine block may leak coolant, resulting in engine overheating.15. TSB even states over heating. This will cause other damage that is not the fault of the owner but the faulty engine block.16. Conclusion: Vehicle was in warranty at the time of breakdown. Vehicle was maintained. We were never offered 100% for the engine block. Leith Honda failed to mention we paid 10% of the coils being replaced. Goodwill offers are for vehicles out of warranty. Leith Honda over stepped their bounds with myself and American Honda. American Honda changed their attitude after being contacted by Leith Honda.17. I do have recordings of Leith Honda Service Advisor and American Honda. We are in a one party state so it is legal.18. Leith Honda has lied on me and now American Honda. Complete false statement. "American Honda stepped up and covered 100% of the engine block repair and 50% of the cylinder head and damaged components. Leith Honda is not responsible any manufacturer goodwill assistance."19. Leith Honda continues to lie, misrepresent facts, to confuse consumers about who and whom they may take their vehicle to for regular service to maintain a warranty.20. Take their word for what it is worth.Final Business Response Thank you for the opportunity to respond. If Mr. [redacted] will look at the repair order he will see that American Honda paid for the engine block at 100% ( line A ). The additional repairs that are not covered by any warranty were Goodwill warranted at 50%. The service bulletin only covers the engine block.Leith Honda performs warranty work for American Honda. Leith Honda operates under the guidelines set up for the dealer network and does not set policy. The decision was made by the appropriate personnel At American Honda not Leith HondaMore Info Received From The ConsumerI chose not to accept Leith??™s response, mainly due to the fact that this did not have to go here, if the service advisor had done his job by being customer friendly and informative.I??™ve read the receipt. It does state no charge for the engine block. I also noted close to $100.00 of charges that I was not aware of. The last conversation I had with the service advisor was a 90/10 split on the engine block. “Take it or leave it. This is this dealerships opinion and you can take it or not. We can rescind it at any time.”The receipt was not reviewed simply because you know what you were told, so pay the bill or get a mechanics lien. After getting the vehicle back it was driven to our service professional to complete other work that Leith recommended. We lost trust in Leith. Sadly we have two other vehicles that if needed to be serviced by the dealer, it would be a Leith dealership. Re-thinking this and looking into out of market dealers.Lack of this service advisor communicating with the consumer has caused this customer to write negative reviews on Leith Inc. and American Honda.He could have made a courtesy call or met my daughter at pickup and informed her of the change of opinion to pay 100% of the engine block.Another reason I disagree with Leith is because they represent their consumer to American Honda.There was nothing wrong with my cylinder head gasket prior to the engine block crack. The problem is the known engine defect that caused the head gasket warp.More Info Received From The BusinessAs previously stated, Leith Honda does not control warranty work. We preform work as directed by American Honda. I cannot help that Mr. [redacted] did not want us to follow the procedure that American Honda requires in our business operations manual. We contacted the appropriate Decision maker at Honda and he was in contact with The representative Mr. [redacted] spoke with. The decision was made by the correct personnel using the correct procedure.

I was told that they needed a form that I needed to fill out to process my contract. I was never called about a form and did not know they needed something from me until I made a call to them. I sent in the form in 12/3 to [redacted] the sales guy. It is still not paid off. This can affect my credit and I may have 2 bills to pay from the old company and the new one because of what has happened.Desired SettlementI would like my trade in loan to be paid off as soon as possible and if it effects my credit, I would like Leith Honda to correct it. My finance company is American Honda Finance.
