I am in receipt of the complaint issued by tenant *** ***I appreciate the opportunity to disclose what has taken placeFirst of all, I did not directly call her and ask anythingA conversation started when I answered my phone to a non
posted numberUpon answering, I was directly confronted and she stated that I needed to supply the name and phone number of the "assessor" that had been to her property yesterdayIt took me a number of seconds to comprehend who in fact this individual was as I did not have her full name on fileShe once again abruptly made the previous statement and I responded to her stating that this was a licensed appraiser that was at the property and not an assessorShe acknowledged and appeared to understand that it was an appraiser and wanted to know what he was doing thereHaving felt that she was well aware of the sale in process, I stated that the property had been soldFrom that point on there was not a lot of conversation that made any senseAt that point, Ms*** was controlling the biggest part of the conversationI never at any time swore to Ms.*** but did tell her that she had been a problem since the day she moved in to this for sale property and that she had been acting like a *** the entire time that I have known herAt this point there was no longer a two way conversation as she immediately stated that I was swearing at her, that she was a Christian and that I was notThis screaming and chastising to me continued for another minuteI continued to listen to this anticipating that I would have an opportunity to explain my statementThis never happened stating that she was calling the Revdex.com and the Sheriff's Office to report meAt this point, she hung up the phone on meI had no way to attempt to recontact herWhat I did tell her in the beginning was that I did not intend to reveal the name and phone number as she had demanded for the appraiserI then questioned Ms*** as to whether one of the owners of the property had been thereAt this point, she stated that *** (an owner) had been there
This tenant from the very day she moved in knew that this property was for sale and as we were advised would give her a hour notice for showingMs*** does not answer her door when I attempt to make contactIn fact I am told that she will not take calls from the husband that is one of the ownersMs*** is a cousin of the owners and they felt they were doing her a favor by providing her a place to reside understanding that the property would be soldThe owners reside some miles north of this property and therefore have been inconvenienced on a number of occasions to allow showings, etcWe were reassured some weeks back by the owner that they have conversed with the tenant and that all would be OKYet, it has not beenWe have been told that access was to be granted and yet when we should show up, Ms*** would state that no one had contacted her and therefore we could not come inThere is no specific written lease on this property and I am told by the owners that they simply have a day/day verbal agreementIn this conversation they also advised that at the very time of this call, they were preparing the day notice to terminate any relationship that they have with their cousin, Ms***The owners, in fact, told me that whether this sale went through or not, they were ending the relationship and no longer wanted to be affiliated with Ms***
We regret this unfortunate situation and trust that the above will explain and conclude with an understanding of this particular situationI have been a top producer in this area since the late 1970's and have remained so throughout the yearsMy office was established in and has also continued to be the top producing office for the Paxton, Buckley, Loda, Roberts areaIn 1996, we became affiliated with the Coldwell Banker franchise and over the years have received numerous awardsSometime back we determined that it would be necessary for the owners to be in attendance upon all entries and have accommodated that for the last number of months
Admittedly this is a difficult situation that we continue to deal with as best as can be handled
