It is unfortunate to hear how the owner feels regarding the transactionNever the less, everything was done per the contract and all other signed addendums (please note, even the owner's comments within their complaint agrees with this fact)Sadly there is nothing that can be done as they are asking for things beyond what was agreed to and ultimately approved by the owner (in writing) prior to closing the escrowWe are bound, happy and willing to fulfill everything within the contract with all our home buyersWe are sorry the misunderstanding exists between us, never the less we have upheld 100% of our contractual obligation and there is nothing we can do in this matter

I am rejecting this response because:
Lennar acts as if they are innocentWe had no choice but to accept the house as it satWe made several decisions prior to our disappointment in the colorThe attitude was take it or leave itI'm not surprised by their disbelief in how things wentas
far as the solarThey allow their sales people to make statements that they have no business doingI was told don't worry about that just signWe were manipulated from day and lied to every step of the wayLike I said Not at all surprised by the holier than thou attitude they take

Good morning,
We have reviewed the complaint and do not understand why it was filed
In a nutshell everything was done per contract, accepted and approved by the home ownerTo be more specific, (prior to closing he escrow)the owner had a final walk through on the home and signed an acknowledgment approving and accepting the home, it's features, colors, all repairs and stating there are no outstanding issuesIn addition, the owner executed a contract with the Solar Company accepting the PPA (again PRIOR to closing the escrow on the home)
If there were any issues with the home especially the exterior color then it would have been noted at the walk through and resolved PRIOR TO CLOSING THE ESCROWIn addition, we would not have closed the escrow if there were any issues with either the interior or exterior colorsThat is why the buyer's acknowledgement / sign off of the final walk through is so important
With regards to the Solar Company; with every home buyer they have the ability to exercise their free market right whether or not to purchase from usHowever if someone does purchase from us it comes with specs, features etcthat come with the home and are not negotiable and of course is reflected in the respective sales pricesWe are not and do not portray ourselves to be a custom home builderIf we were then the owner would have the ability to choose many if not all the components that go into the homeHowever, the price of said home would be significantly higher

Admittedly we do not understand why *** *** has filed a complaint with the Revdex.comIn good faith we built a home for her and in the end she is unable to obtain a loan or unwilling to pay cash to fulfill her contract with usWe are not a lender and cannot control what a bank will require of a
potential borrowerThe home is now over two months late in closing and we must move on
Having said the above, we exercised our contractual right to terminate the escrow and refund all deposits to *** ***The paperwork she has to complete is a formality to cancel the escrow and return said deposits
Again we do not understand the purpose of the Revdex.com complaint as all deposits are to be returned

This matter was addressed with the customer and their Realtor prior to their close of escrow on 8/15/All misunderstandings pertaining to their purchase price have been resolved and the buyer proceeded with the purchase of the home and closed escrow on 8/15/

We have already agreed to replace the whole tile flooring in the downstairs portion of this home and a couple of tiles at the master suite bath floorAs far as their granite concernWe had our trades go out and fix the repair and homeowner
was satisfied with repair at same time this complaint came inHomeowner has been explained to during purchase of home and new home orientation that our trades work Mon-Friday 7-3:We cannot work around his schedule after 4:or weekendsIf they cannot be present during the repairs they can find someone over to be present, does not have to be them or they can sign a key release and one of our customer care reps can be present baby sitting home
As soon as tile comes in CCR will be calling homeowner to schedule time frame for flooring repair

First of all, my family and myself were never notified while in the home orientation, that the home workers could only work from 7-3:We also were not notified about the terms regarding who had to be present in our home when repairs occurThe reason we are not accepting the response is because they only want to replace all the tile downstairs and some in the master bedroomHowever, the laundry room and the other upstairs restroom have tiles that are crooked and are in need of replacementWhat I do not come to comprehend is how they want to replace all the tile downstairs and some in the master bathroom but yet completely ignore the fact that the laundry room and other upstairs restroom need replacements as wellRegarding the granite, we were never satisfied with the conditions of the granite in the kitchen and the laundry roomWe notified *** and other Lennar personnel, that we did not want repairs in the kitchen and laundry granite, we wanted replacements just like they replaced the granite in the downstairs restroomThe reason why I entered this complaint was because the last call I had with *** regarding the tile, we did not come to an agreementHe communicated that they would only be replacing a few tiles downstairs onlyI told him that I would be taking my complaint to the Revdex.com if that was the case and these were ***'s exact words, "that's fine" I want the tiles replaced and straightened because I'm afraid to break my toes if I hit the borders of the uneven, raised tiles

I apologize if you say you were unaware of our trade partners schedule however this our policy for trades for your FYI for future inquiries
Your downstairs will be completely re-done due to the fact the count was more than tiles and Cal Custom would be taking out more than half your floor to do this repairUpstairs the count was around in hall bath, in master and around 3-in laundry all as noted with tape and fixableWhich will be addressed at same time
Granite repairs by trade said you were satisfied with repair on seam and noted so with trade partner did the repairConcern was fixable and no replacement was necessary
CCR will be contacting you to schedule your tile repairs shortly at which time while you will be unable to function your kitchen and downstairs we will offer you meal reimbursements as well as hotel as neededWhen work gets ready to start they will go over this process and documentation with you
