Lennar met with this customer this morning and has been in contact with throughout the warranty period.  We are in the process of scheduling the homeowner's one-year final punch list.  All of these concerns have been and are being addressed.

However, the customer complains that at that same time in 2007, Lennar “refused to replace the second tank (same model) after repeated requests.” Importantly, there was never anything wrong with the second tank (hereinafter “Tank 2") - - it did not leak or otherwise fail in any respect. Rather, the customer only wanted it replaced because Tank 1 was replaced.
The Complaint then states that “several large cracks were discovered in my septic tank after a sewage backup into my basement. Lennar refused to replace my second failed septic tank. Reason: Out of warranty.” What the customer failed to state, however, is the fact that the foregoing event occurred in April 2015, eight years after the customer settled on the home and seven after the expiration of Lennar's Warranty coverage.
It bears repeating that Lennar takes pains to abide by the agreements it made in the Warranty. In this case, neither the April 2015 event, nor the 2007 claim concerning Tank 2 is covered by the Warranty. Indeed, any “deficiency” in a septic system is covered under the Warranty for two years from the date of settlement on the property. As such, by the terms of the Warranty by which the parties agreed to be bound, the two year coverage for this claim expired in 2009. Since the April 2015 event is indisputably six years beyond the expiration of the two year period, it is not covered by the Warranty. Similarly, because Tank 2 was operating properly in 2007 (and beyond), there was no “deficiency” at all and therefore no Warranty coverage.
Since none of Lennar's foregoing response is disputable in any respect, Lennar respectfully requests that you close your file on this matter and expunge this Complaint from Lennar's record. Given that these claims are demonstrably false, that is the only way Lennar can be sure that its excellent reputation is protected.

REGARDING: [redacted]'s rejection of response from Lennar
Lennar -Virginia has continued to respond and complete all of [redacted]'s customer care complaints that are covered within his home purchase.
As of today, the Customer Care Department all pre-settlement items are complete with customer care issued tickets signed by [redacted], verifying the work is done. I have provided the signed-off tickets for your review. 
Some landscaping and remaining
concrete work is scheduled and being coordinated with our Land Development department, as we are doing for all of our Courtland Rural Village home owners.  The work is in progress and we continue to monitor the progress. 
[redacted] continues to open new items and customer care requests that we are responding to but cannot provide a set date for completion until the trade and/or vendor has confirmed the schedule.  
It is always our intention to continue to earn our home owners trust before, during and after the home buyer process. Whenever there is an issue that is part of the home warranty, our intention is to address it promptly and completely.

Review: The complete lack of customer service and warranty support I have received from Lennar to date has been unacceptable. I have been in contact with Lennar since our original walkthrough of our home to address these issues and have had only 6 items completed in over a year.

Lennar has an obligation under its warranty agreement to respond to my claim within 30 days and complete repairs by 60 days. This has not been the case, even with items that have been fixed.

Siding has been missing from the side of my house for a year.

I have, quite possibly the saddest “tree” in the world in front of my house.

When it rains hard, water comes into the unfinished room in my basement. Hopefully, that’s the only spot.

This house cost over $590,000. I get better customer service when I purchase a $0.99 hamburger at [redacted]. Lennar Virginia should be ashamed of the “service” they have provided, and furthermore you should reconsider continuing to build on this block until my issues and those of my neighbors are addressed. Frankly, it’s quite arrogant to keep building more houses when you can’t even serve the simple warranty claims of the ones they have built.

These are the things I frankly have given up on:

Floor Glue exposed / floor has spots on it

Fumes / weird smell in closetsDesired Settlement: What should be done, it that I get to choose the contractor of my liking to address these issues and send them the bill. Frankly they are only the middle-man here and their lack of responsiveness has caused these delays.

Lennar met with this customer this morning and has been in contact with throughout the warranty period. We are in the process of scheduling the homeowner's one-year final punch list. All of these concerns have been and are being addressed.

Review: Have had problems with house since prior to closing, was told they would be fixed within days of closing. Provided a detailed list at settlement to Lennar - several items still outstanding. Provided a 90 day post-settlement list to Lennar. Many items still outstanding. Contract states that Lennar will fix the items covered under warranty within a reasonable and timely matter(90 day was March 31st 2014).

They have stated that the items on my list ARE under warranty as spelled out in the contract, but they have yet to actually show up and fix them.Desired Settlement: Repair of all items on my post-settlement and 90-day list or money from Lennar so I can hire contractors to do it myself.

Review: On September 27, 2012, we noticed water pouring in through our Lennar window. After nearly 10 months, several window replacements, window reconfiguration, additional water damage caused by other storms while the window was still faulty, Lennar had to separate the top arched window from the bottom three windows creating a new configuration of the window design. As a result of the water damanged caused by the defective window and lack of response and viable solutions during these 10 months, the custom wood plantation shutter that was damanged and no longer fits the new window configuration. On October 24, 2012, Lennar agreed to pay for the damaged plantation shutter ($2,100) from Budget Blinds (see attached documentation). It has been nearly 16 months since the water damage began and almost 12 months since Lennar agreed to send us a check for the defective window that caused damage to our plantation shutter and as of today, 9/18/2013, I still do not have Lennar's payment for the damaged plantation shutter. I have attached the pertinent documentation and correspondence with Lennar that shows their agreement to pay for the damage. Importantly, under Lennar's Limited Warranty Coverage policy for workmanship/systems standards, they have not followed through on their responsibility to take corrective action. Review: I contacted Lennar at [email protected] via the company's website on 7/1/2013 to advise that my ceiling leaks during heavy rains. As part of the email submission process through the website, I had to enter my name, address, and contact info. I received an automatic reply on 7/1/2013 acknowledging receipt of my submission and stating that I would be contacted as soon as possible. On 7/12/2013 I reached back out via [email protected] to see if there had been any progress, as I'd heard nothing. On 7/15/2013 I received an email from [redacted] nothing that she'd need my street address [though I had already supplied it in my initial submission] to see if she'd "received my Service Request." I responded with my address the same day. On 8/8/2013 I again reached out to [email protected] nothing that it had been over a month and I'd still heard nothing in the way of getting my ceiling fixed or even setting up an appointment. [redacted] got back to me on 8/12/2013 noting that she needs to know "what [my] issue is" and that based on the chain of emails she doesn't know the nature of my complaint (even though, again, ALL of this information was supplied in my initial submission). I responded that I didn't know what the purpose was in leaving a message on the Lennar website if none of it will be forwarded, but I know that's not her fault, and I then provided the issue (cracking on the interior of my vaulted ceiling such that my roof leaks during heavy rains and drains down the wall near an electrical outlet...i.e., a fire hazard). To date, I've heard nothing from Lennar in the way of getting this issue corrected.Desired Settlement: Fixing of the leaking ceiling issue both internally (within my condo-townhouse unit) and externally, as applicable. Addtionally, mold testing (paid for by Lennar) to ensure there has been no mold damage to the home in light of the issue.

Review: I purchased a brand new home from Lennar in 2007. In my contract there is a warranty for 10 years on structural issues. We have serious crack on the outside of the house and other concerns that are indicating structural issues. I have contacted Lennar Customer Service on 2/11/2013 and put a request in their system. A week went by and I have not heard from anybody so I followed up with an email. After many follow ups I finally got a service appointment scheduled for 3/15/13 at 8.30am. Both my husband and I took some time off work that morning to be at the property but nobody showed up or contacted us as to what happened. I have called Lennar and left couple of messages and sent emails throughout the day but have not heard from anybody. It is unacceptable for customer service to provide such service. My concerns with the property have not been addressed or resolved.Desired Settlement: I need LENNAR to fix the issues with my house ASAP.
