No Home - Lost Earnest Money
Back in July 2022 my family wanted to purchase a new construction home in Phoenix Arizona and happen to see model homes which were Lennar. We saw some of the models and were interested in their multi-Gen homes, in which the sale rep (name will not be mentioned) helped us and decided to purchase, we wrote up a contract. We planned on moving to Arizona in June of 2023 so having it built from the ground up was no problem. My daughter who already lived in Arizona was renting at the time and because her lease would have been up in March 2023 she would move in the new home. She decided that it would be in her best interest to break the lease early so we decided to see if we could switch homes for an earlier date and put the earnest money toward the switch home. Lennar approved our request. The new home would be ready in late December 2022. We also worked with Lennar Mortgage so that there would be no problems, and everything was under one roof. Now comes the nightmare. We were told our loan was approved, and received a congratulatory letter that our loan was approved. There were additional items they needed for the underwriter to which we provide (over & over again) as they kept saying they never received it. Then when we thought everything was finally done since they had scheduled us for the 2-home inspection & gave us a closing date, that’s when the other shoe fell. We received an email on November 19, 2022, from Lennar secretary on behalf of the Sr. Vice President Sales & Marketing "Please consider this letter as notification that the contract entered into with Lennar Arizona, LLC. dba LENNAR HOMES, for the purchase of -------- Glendale AZ homesite 2 at Marbella Ranch, a Lennar Community, will be cancelled and all earnest monies retained on November 29, 2022, unless the following happens - 1. Loan approval." I immediately contacted our loan officer, and she knew nothing about it, she contacted the sale consultant, the person we signed the contract with and was told that our contract was contingent upon us selling our current home. I advised both that the contract that we signed clearly states (pg. 3 section 7.6 Sale of Other Residence "Buyer represents and warrants that this Agreement and the mortgage loan refenced herein, unless otherwise provided are not and will not be subject to or contingent upon buyer's selling and/or closing on the sale of Buyer's present residence or other property". But the sale consultant insisted that it was. Needless to say, we lost the home along with our $10,000.00 earnest money. I recently called April 2023 to see if they would consider using our earnest money on another Lennar home that is Move In Ready and was told by a corporate manager that Lennar no longer does that. I don't understand how a billion-dollar corporation can easily take funds away from normal people that aren’t rich. Is that how they made their billions by taking advantage of little fish? Our hopes & dreams were taken away from us by Lennar, instead they gave us stress and anxiety. If anyone knows of a good lawyer, please send them my way.
