Mr& Mrs*** purchased their home from *** Homes back in A copy of the Grant Deed which was recorded July
2, is enclosedAs part of that purchase, the Edmonstons received a written express warranty for their homeA copy of the 2-warranty is enclosed as wellAs you can see, the roof on the house was covered by a year warranty from the original close of escrowThe Edmonstons' first report of roof leaks did not come until the Spring of nearly years after close of escrow and nearly years after the warranty on the roof clearly expired
Notwithstanding the foregoing, upon receipt of the Edmonstons' complaint earlier this year, *** dispatched the original roofer, Petersen-Dean, and a second roofer, Allstate, to investigate the homeowners' claimsThat investigation determined that while a leak in the roof may have been present, it likely related to a broken roof tile and the lack of maintenance on some sealant near a kick-out at the garageAt no cost to the homeowners, the broken tile was replaced as a courtesy and additional sealant was applied
It is ***'s expectation that the roof leak reported by the homeowners have been addressed by these courtesy repairsHowever, should the leaks reoccur, any further repairs to address the roof at the home in question are the responsibility of the Edmonstons per their home warranty
*** Homes strives to build homes which exceed the expectations of their customersOn rare occasions, those expectations are unreasonable and cannot be met*** simply cannot be responsible for maintaining the roofs on houses which are years out of warranty
