I purchased a vehicle from Leominster Used Cars on [redacted] This vehicle did not pass inspection and had many issues that they refused to fix at first. It had a broken rear chassis, the front body mount was rotten and many other safety issues. After being in the shop for repairs for over a week and when I did not write a letter to the finance company stating the car was repaired the owner [redacted] took the vehicle away from me on [redacted] He said he would give me my down payment that evening and to this day I am still waiting. They do not answer my calls, and are never at the dealership when I go, even though the sign says OPEN. They will not give me my down payment back and I do not have a vehicle. I need that money to buy another car as I have 2 children and one of them does not have bus transportation to and from school. I also need a car to go to work. Leominster Used Cars is not a trustworthy dealership and sale unsafe vehicles. Please be aware and check the vehicle thoroughly before purchasing.Desired SettlementI am asking for a refund of my down payment in the amount of [redacted] and other monies that I have lost due to this situation. I can send a description of these and proof if needed.Business Response Contact Name and Title: [redacted]Contact Phone: XXX-XXX-XXXXContact Email: [redacted]Hello![redacted] came in to buy a car with us around [redacted] of 2014 and we helped her out with the car she liked the most in which is the 2003 [redacted] she is talking about. when she first came in she spoke with [redacted] We had the down payment on the car set at around [redacted] because her credit is bad and there was not much we could do to help,so [redacted] and husband told us they didn't have that money and they only had the [redacted] she is talking about,so after 2 or 3 days of working things out with them and trying to help,because we help people here, we decided that we could go ahead and help this Lady that came in and needed help and not to say that she went for a test drive there was no issue on the car other then the back up sensor broken and side bar wasn't holding the way it should.So we went ahead with the deal, got her all papers needed for her to registered the car and insure the car, after she got it all done she came to the dealer and pick up the car. so next day or a day after next she came by the shop saying that it didn't pass inspection, telling us that the car is this and the car is that, so we looked into the sticker paper and saw that she was already making a big case of something that wasn't that big to start with, so we brought my mechanic here and fixed the issues to pass inspection in which was the plate lights, e break and some other minor issue. So we fixed the car and the car passed inspection.3 days after she left with the the inspection sticker was all set and done with. on the same day that she passed inspection she came back saying that the starter wasn't good and needed to be changed, we as a good dealer we went ahead and changed that for her also(keep in mind that we didn't have to change it, but we did, to make her happy) after that she disappeared for a little bit. a week or two after she comes back here saying that the car has a bad front end and that she went to change the oil and the guy at [redacted] tire told her the front end is condemned and it was unsafe. so we again as good faith took the car and brought to our guys to see what was the unsafe issue in which we take very seriously here, so my guy told me that it need to be fixed and we went ahead and fixed didn't even ask them what would cost us to fix it. about 2 or 3 days passed by [redacted] came by again saying that something else was wrong with the car also, so we went to the shop where the car was fixing and looked at the issue she was talking about, which my guy had already welded it and made it safe, but [redacted] wasn't happy still, she wanted a new muffler, a new part, we told her it was already fixed and she should wait and see how all was going to be when it got done,so she says I need a car, [redacted] gave her his truck to drive for a few days while her car was being fixed. so [redacted] comes in again at shop where the car was being fixed and complaint to the guy who was fixing the car saying that we weren't fixing it right we weren't doing this we weren't doing that, so [redacted] comes by and find out that she is still complaining about us not being good to her and she also found another issue that she wanted him to take care of,she also told us every time that if we don't fix it she wasn't going to stay with the car anymore like every time she came in,if you don't fix this I am going to return this deal, if you don't do that I am going to return the deal, we took it as much as we could, trust me, I tried all I could to help her but she was never happy, basically what she wanted was a brand new car with no issues at all, but we sell used cars not brand new cars,we are called" Leominster used cars" not Leominster brand new car. So after that one last "if you don't do this I will return the deal", [redacted] calmly told her to remove her items of the car and give the keys back that he was taking the car away from her, we got over worked on this car for her, to make her happy and we were never able to make her happy, husband many times came in and said car was fine, but wifey isn't happy. I am willing to refund her money,I Am not saying I wouldn't return it,but I wont return the full amount of $1600, I will[redacted]duct the 3 months extended warranty I paid for her to fell safer in those 3 months in which it wasn't on the deal for the [redacted] deduct to my guy that I paid commission to, I don't think its his fault that [redacted] has that (" if you don't do this I will return the deal")saying, [redacted] to have it detailed again. so [redacted] minus all that will bring the number to [redacted] it made me very disappointed to read [redacted] saying that we aren't trusty worthy and that we sell unsafe cars. She isn't just a liar when she says that, shes is also making false accusations against Leominster used cars.Just to complement and finish with this, I sold the truck a week ago and haven't received one phone call from the client to complain that the car is unsafe or didn't pass inspection, I AM also talking to my lawyers to find out if I can bring a letter from this customer who bought the car last week to show the judge that the problem wasn't us. [redacted] is still in possession of 1 of the keys for that same car and all paper work that was done here, if she wants to get the [redacted] she has to return all paper work including the [redacted] receipt and keys on that automobile. otherwise I will see her in court.sincerely,[redacted]Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)I will not accept only [redacted] from Leominster Used Cars or their statement because it is lies again, and I have proof. They do not even have the dates correct,I signed paperwork for the car on [redacted] I will have to pursue legally, since I am entitled to my entire diwn and insurance according to [redacted] laws. I do not have any paperwork, and how could they of sold the car if I did? I do have a key that was at my home when Mr. [redacted] took the vehicle away from me and told him I would return it that evening when he said he would give me my down payment back, that was almost 2 months ago. I know my rights and this vehicle was unsafe when I purchased it, the repairs were done except the muffler but they gave me a hard time to do them. They didn't want to do any repairs until I got the finance company involved. The vehicle was getting repairs for a total of 10 days, and they didn't loan me a car until after the 6th day. They said they were not making a big profit on it with all the repairs and that is why they took it away from me to sell it for more to someone else. I really hope the person who bought it doesn't have any problems. Thank you for your help.
