We replied to Ms*** on different occasions with an detailed explanation of her itemization of security deposit She requested additional time to keep the keys past the 1st day of the month because she was "pressed for time to move out and clean" She was told if she was unable to
clean our office would arrange cleaning and deduct it from the security deposit In the same email we told her she would be responsible for the rent if the keys were not returned by the end of the month, her reply was "I will have the keys in the office box by 11:pm on Friday!" Ms*** did not request a final walk through, she did not follow the terms of the lease regarding move out requirements (professional carpet cleaning, utilities) When the property was checked to ensure vacancy there was food in the freezer that had to be removed The move out cleaning was based on the last contact we had with the tenant prior to her move outMs*** has the email communications with our office and had every opportunity to verify move out requirements Furthermore, her move in checklist did not note any items that were not cleaned to her satisfaction

The carpets were cleaned by a professional cleaning machine, I was just the one who used it, which there is no specification in the lease against that.

It appears that assumptions went both ways.  I assumed that based on Ms. [redacted] request to keep the keys and her statement that she would not have time to move out and clean, that she would actually be unable to do both.  I assumed that because she did not request a move out inspection that she was walking away from the property, again based on her last contact.  I continued to assume that we would need to clean when food was found in the property and there was no professional carpet cleaning receipt provided.  A walk away (not emergency) cleaning was scheduled and completed.

I am rejecting this response because:I asked via email what I needed to do to prepare for move out, and I was told that I only needed to have the house cleaned and keys/garage clicker turned in, I was not told to schedule a move out inspection. Wouldn't that have been an important item of business to bring up when we were discussing the timeline via email for move out when I was concerned about making sure everything was done on time? If there was a question of whether I needed an emergency move out, then you should have asked. And charging $400 for a few items of food in the freezer, which I do not even recall being left there as my friend and I both cleaned the fridge, is not justification for an emergency move out. I stayed up for 72 hours straight moving and prepping the house for move-out to make sure it was completely clean, so even if you assumed there was an emergency move out/cleaning fee, there would have been nothing to clean anyway, because I already cleaned it! So how can you charge that fee if there was no need for it when you saw the property was already cleaned after I turned in everything by the deadline?
