Initial Business Response /* (1000, 8, 2016/02/08) */
The letter we have received has said to not personally identify the person who had made the complaintSo we will just call him Customer
In November or we were contacted by the customer who stated his truck needed an injectorHe then
had the International Truck towed to our place of businessUpon arrival we contacted customer to tell him not only was this truck missing an injector but the radiator and dash had been removed as wellTo which he stated the truck had been previously worked on by someone else who must still have the missing partsCustomer said he would bring them to usThis customer had been a client of ours for many years, so when the truck sat untouched unable to go forward with repair without parts we were still willing to work with himIn early we loaned our $ABS Scanner to this customer who said he needed to check on another truck Around this time we made arrangements with customer to have a second truck towed down to our shop in March This International was missing the same partThe borrowed ABS Scanner is vital to our business and is used to run diagnostics for particular jobsAfter a substantial amount of time running business without it being returnedAnd now in possession of two vehicles taking up space where we conduct business, we made several attempts to contact the customerBig jobs require constant communication between business and customer, without it progress cannot be madeWe have done the occasional work for this customer as far back as to the best of my knowledgeOn good faith we loaned out our scanner while allowing his vehicles to occupy space longer than any other clientCustomer was completely unreachableWe drove out to where he did business and was told he no longer worked from thereThey also offered us no means of new contact information for customerDuring this time, we were under pressure from our land lord to remove the vehicles as we are not allowed to "store" on the propertyWithout contact and no agreement to store unmovable large vehicles we had to assume that they had been abandonWe had to take time to research our options and contacted Turners Lien Service (Turners information is included in the attached documents)Turners had no success of locating the owners of the two International TrucksAs of September 3, ownership of the vehicles had been transferred to uswe were in our legal rights to now have the trucks removed from the propertyContact still had not been established between us and the customerThe incomplete non running trucks were then sold to someone who would come remove them from this business property
Customer finally contacted us in November however, by this time the trucks were goneIt was a very unfortunate situation, one we tried to avoidBut the pressure of our landlord and, the lack of contact in a timely manner by customer resulted in our need to take legal action to ensure the right to remove the large vehicles from the premisesThe sale of the and International trucks in their condition could not even remotely cover not only the loss of the scanner which had to be replacedBut the time of lost space these trucks occupied at our business where space is already limitedOccupied space means limiting the amount to customers we can take inEveryone lost time and money in this situationWe would have much rather been able to fix the trucks while continuing our relationship with a long standing client, then to have had to part ways due to the lack of communication
Initial Consumer Rebuttal /* (3000, 10, 2016/02/09) */
(The consumer indicated he/she DID NOT accept the response from the business.)
No contact was ever attempted by *** *** or his landlord at all*** had been to my home as I had given him a ft RV among other vehiclesDuring this time I was suffering gliomas and was in and out of the hospital*** knew where I worked and where I livedHe had my cell phone and never called or returned my callsI had a witness who went to Leroys shop and told him I was ill; but still wanted my trucks repairedThe trucks were still there at that timeShortly after I had a buyer go to the yard; only to be told *** sold them*** then got on the phone and told me he sold them to someone taking trucks to MexicoHe is correct on the monies owed for the space occupied; and the scannerIt was an expensive one he lent meAll I ask to resolve this matter is the proper documentation showing they were lien and sold so I can show the DMVI am still getting charges from these trucks registrationI am recovering and I just want to put this behind me
