I am rejecting this response because:This response is so absurd it does not justify a response.Revdex.com, What is no laughing matter is what I learned today from BMW-- that Midas called them this morning asking for information on my confidential account information with BMW Midas, ever hear of Consumer privacy laws? You just violated a multitude of them as you did not have my permission to ask for my account information there Further, BMW was appalled and offended at your incredible lack of judgment in putting them in such a situation Reputable, competent businesses do not act this wayRevdex.com, Thank you again for all of your help If I did not make clear before: I am not seeking money through this forum though I know the Revdex.com rules encourage claimants to put a dollar amount on what would resolve their claimAs you can see from Midas' responses, Midas has not offered me one ounce of recognition or apology of the number of things they did wrong here that lead to me having such a poor experience with them What I want most of all is to make sure that no other consumer receives the abhorrent treatment I did from Midas at the downtown Sacramento location If, through telling my story, I can save even one person from going through what I did with Midas, then as [redacted] would say, my efforts shall not have been in vain :)

I am rejecting this response because:I don't see any offer here to consider and I would have been agreeable to one but I spoke with Midas Sacramento District Management today and now Midas is denying that I ever requested that they fix my broken right turn signal when it was their OWN FAILURE to provide me with an invoice of the work I requested under Califirnia law Incredible I have a witness who I wa talking with on the phone who heard me ask if the right turn signal was fixed and heard Midas' reply that there was nothing wrong with it Another car dealership I took my car to a few days later inspected the car and found that the wires to both turn signals were corroded and they are fixing it tomorrow so I am out more money now for something Midas said they would fix and did not (another witness I have: this new company also verbally informed me of the problems they saw with the way Midas handled this entire situation and Midas' additional failure to diagnose two oil leaks my car had). This is not about the money for me, though - it is about the disrespectful and dishonest way I was treated by the Midas staff and District Manager I was open and still am open to a reasonable settlement of this matter ( $for the subsequent inspection I had done after my car continued to leak fluid after I left Midas plus the money I will be out to have my turn signals fixed ( Approx $ 300; I will have receipt tomorrow) but Midas has offered me no reasonable credit I will accordingly be filing a complaint with the California Bureau of Automotive Repair for violation of the California Automotive Repair Act ( for Midas' failure to give me an invoice of the right turn signal work I requested) and I will be filing a complaint in Sacramento Superior Court for violation of the Act as well as fraudulent inducement. I appreciate the Revdex.com's time and effort to try to help resolve this matter but again it is not about the money for me-- it is about making sure that this unjust and dishonest treatment by the Midas staff at this Sacramemto location does not happen to another consumer Thank you

Revdex.com:
I was able to speak with the owner/*** this morning 06/18/and he has agreed to mail a check for half of the cost of the used muffler ($149.00)While it is less than I would like under the circumstances I accepted it, so this issue can be closedI would like suggest that Midas take extra steps to make sure they explain in detail and honestly the circumstances surrounding their recommended repairsEspecially to those that have little to no auto experienceTheir customers (including myself) are very trusting and expect to be told all the information so that we can decide and make informed decisionsPoor communication or miscommunication are never good enough reasons when the information being told to the client is "exact", repeated, and restated and confirmedThank you and I hope to give this business another chance to service my vehicleThey were a very nice group of guys

She has provided no proof from Nelo BWM that our work was faulty, because it was not

Muffler was hanging from car when came to Midas and had scapes from dragging on ground or speed bumpsThe broken mount/hanger had been welded before and broke off againthe other repair shop had welded the bracket on the muffler and it could not be removed without damaging the mufffler morethe
customer was given an option to buy a used muffler with an existing hanger on itThe customer agreed to the repairs, the work was doneI have explained the repair again to the customer and I have another call into her to discuss a resolution with herI am sorry for any communication issues and hope to keep her as a Midas customer.I will let Revdex.com know once we have settled this complaint. Thanks, *** ***

I am rejecting this response because: There are multiple misnstatememts of fact in this reply and despite its verbosity it does not address the issue:MY CAR STILL IS NOT FIXED. My car is in the shop as I write this and I now have awritten opinion that Midas' work was faulty If there is no offerto reduce my bill I will proceed to pursue this matter in court ***

I am rejecting this response because:This response is so absurd it does not justify a response.Revdex.com, What is no laughing matter is what I learned today from BMW-- that Midas called them this morning asking for information on my confidential account information with BMW.  Midas, ever hear of Consumer privacy laws?  You just violated a multitude of them as you did not have my permission to ask for my account information there.  Further, BMW was appalled and offended at your incredible lack of judgment in putting them in such a situation.  Reputable, competent businesses do not act this way. Revdex.com, Thank you again for all of your help.  If I did not make clear before: I am not seeking money through this forum though I know the Revdex.com rules encourage claimants to put a dollar amount on what would resolve their claim. As you can see from Midas' responses, Midas has not offered me one ounce of recognition or apology of the number of things they did wrong here that lead to me having such a poor experience with them.  What I want most of all is to make sure that no other consumer receives the abhorrent treatment I did from Midas at the downtown Sacramento location.  If, through telling my story, I can save even one person from going through what I did with Midas, then as [redacted] would say, my efforts shall not have been in vain :)

Under Penal Code 518 PC, the California crime of extortion (also known as "blackmail") occurs when you do any of the following:use force or threats to compel another person to give you money or other property, use force or threats to compel a public officer to perform an official act, orif you are a public official, act under color of your official right to compel another person to give you money or other property.1

I received a call from Ms. [redacted] on 3/10/17 regarding her 1998 BMW. She said the car was overheating and there was steam coming from under the hood. I advised her to have the car towed to prevent any additional damage. Ms. [redacted] instead chose to drive the car to my shop.   Once she...

arrived, we immediately began our diagnostic process which includes taking photos. A large crack was discovered in the car’s coolant tank; this leak caused coolant to pour on the hot engine resulting in the steam and a non-sealed coolant system. We informed Ms. [redacted] of the issue and she approved the work in person and signed the repair order. A new coolant tank was installed and using a coolant vacuum her coolant was replaced ,and we performed a pressure check of the system.   To make sure there were no overheating issues, we let the car run for 30 minutes with the air conditioning on. Ms. [redacted] had very low gas in the car and at no charge we added a gallon of gas to complete the check and ensure she would have enough gas to drive home and to a gas station. The temperature gauge herd steady; the system was sealed with no leaks or overheating issues. Ms. [redacted] was happy with the work and drove the car home that day.   The next day we received a call from Ms. [redacted], saying that she heard a pop in her car and it was once again overheating. I again advised her to not drive the car and have it towed in. She once again chose to drive the car in. She arrived and the car was excessively leaking coolant in my parking lot. The plastic neck on her radiator cracked and subsequently blew the upper coolant hose off the radiator. We explained that with the coolant tank being repaired and now 100% sealed, this unfortunately was a case of the next weakest part failing in her 19 year old vehicle.   With multiple guests in our lobby Ms. [redacted] proceeded to yell and scream at my service manager, [redacted]. She was extremely disturbing to our other customers and refused to step outside for a private conversation. Ms. [redacted] yelled that she is a lawyer and would sue if we did not replace the radiator. I tried to explain that the plastic radiator neck is on the opposite side of the car as the coolant tank, and we are not responsible for the old plastic failing.   I offered to have the car towed to another shop of her choosing for a second opinion, at my expense. I also explained that if the other shop could show we were at fault, I would pay for the repair. She refused my offer and approved the work to be done by us. We replaced the radiator and as an extra precaution I replaced the thermostat at no charge to Ms. [redacted] (which cost me $337). This all happened late on a Saturday afternoon, and three of my technicians stayed an hour and a half past closing to make sure Ms. [redacted]’ car was done. We again ran the car for 30 minutes with the AC on to ensure no overheating.   Once we pulled out the car she accused us of stealing one of her hub cups. On the attached time stamped photo you can see the hub cap missing when she first brought in the car. I find it extremely insulting that she would accuse me or my technicians of stealing a hub cap. Especially after my team and I stayed at the shop an hour and a half after closing on a Saturday to ensure her car was complete, when we easily could have closed as scheduled and left her car to finish on Monday.   Even with this insult, I told Ms. [redacted] to call my personal cell phone over the weekend if she had any issues. I never heard back from her until this complaint. Attached are timestamped photographs documenting the repairs. I have retained all of the old parts which further validate these repairs
