Complainant [redacted] is not our customerHer son, [redacted] is a borrower on a loan with a private beneficiary which was severely delinquent at the time of this complaintRed Shield Servicing was instructed by the beneficiaries to begin foreclosure proceeds on 08/24/The Notice of Default on the property encumbered by the recorded Deed of Trust and the borrowers promise to repay was recorded on 8/25/The borrower’s mother, [redacted] , was attempting to pay off this loan (at a discount) on behalf of her sonAfter conversations with the beneficiaries (mother AND daughter) the offer of a discounted payoff was deniedSubsequently, the borrower (and his mother) came into our office on 11/27/and reinstated the monthly payments that were delinquent and owingThe Notice of Default was rescinded on 11/28/The payment that came due on 12/05/has not been received as of today’s dateWe feel this complaint was filed in bad faith as an attempt to mar the legal process due a lender to collect a debt

Dr [redacted] is correct I am continuing to work with his attorney I recently sent him a draft agreement, and he emailed today to tell me it looks fine I expect we will work through final details within a few days

I am rejecting this response because:they obviously don't know who I am because they address me as Mr I am a physician and people address me as DrHarpole.It is an outright lie that they responded to my questions If they did certainly they would be willing to send copies of their responses to my questions.One question was : what would my return in cash be if the property at *** *** sold for $110, They had a contract to sell for this price and advised me to pay over $8,to clear up the delinquency on the first Before sending more money (i have contributed more than $64,to *** ***) I wanted to know if it was wise to "throw good money after bad."They did not respond.I asked them why they turned title of the property to me I don't want the responsibility of owning a worthless property Spartan said that the property would go to foreclosure sale on May 6, That date has passed and I don't know what has happened to this property

I apologize for the delay in responding.I just read the response from Spartan loans.  There are a few details in their response which I consider untrue and make it clear to me how unethical this business is.1.  [redacted] was not severely delinquent.  They did not give him credit for a payment of $17,740.00.  [redacted], the holder of the note, signed the receipt that the money was received.  [redacted] at Spartan and [redacted]'s daughter [redacted], decided it was not valid.  [redacted] herself told me she never got to speak to [redacted] about the money in question.  I told her if she spoke to [redacted].  [redacted] would tell her the truth.  The signed receipt was valid.  That is why [redacted]s at Spartan decided the loan was so delinquent.  I truly believe [redacted] and [redacted] were trying to get the house from my son.  I want others to beware.2.  [redacted], the daughter, did except a negotiated amount of $140,000.00 which I was getting a loan for.  I had a pre-approval letter from the bank.  However, once the house went into foreclosure the bank stated - the loan would be considered a bailout and therefore could not proceed with the loan.  It was the bank that denied the loan.3. This complaint was not filed in bad faith.  We just couldn't get any action from them until we reached out to you.4.  Yes, [redacted] and I did go to the office to pay and stop the foreclosure.  We felt we would have to take other measures regarding the $17,740.00 payment.  When we went into the office we could see a women's head peeking around the corner to look at us.  That to me was very unprofessional. How long does it take to record the "Rescinded Notice of Default"  and will we be notified of that as well?I appreciate your time.  I wish I didn't have to do this.  I do feel the public needs to know about our experience with this company.I still have not been able to reach [redacted].  She sent me a Merry Christmas wish through [redacted] because [redacted] is forbidden to speak to me.  [redacted] and I have been friends for years and cash money has gone back and forth between us.   I would never have given anyone besides [redacted] $17,740.00 cash.   I love and trust her.  Her daughter [redacted] and [redacted] are the two I don't trust.Sincerely,[redacted]
