I explained everything and will no longer be replying to these messages.  Just as we already explained, we don't have the money, the previous owners have the money, and as explained by the UFC Gym corporation, if the customer is able to produce the completed cancellation form or confirmation email, they will be able to further assist them.

I am rejecting this response because:Response:I explained everything and will no longer be replying to these messages.  Just as we already explained, we don't have the money, the previous owners have the money, and as explained by the UFC Gym corporation, if the customer is able to produce the completed cancellation form or confirmation email, they will be able to further assist them.My response:Once again the response is untrue.  As it is clearly listed on the attached document from my [redacted] charges, UFC has been getting "paid" for a non-existent since Sept. 10, 2013, in the amount of 73.83 every three months. How can the writer/owner state that they don't have the money?  UFC is listed right on my statement.  UFC is the business that was bought, thus, UFC has been receiving the cash, not the previous owners.  Also, the original contract is null and void since there is no authorized signature from my wife, since it was forwarded to billing fraudulently. She never signed it because she never agreed to it. As the current business owner, I would like a response to that. I've attached the contract again without the signature. I was told that you bought the contracts when you became the owner, however, this contract is not bindind, it is not SIGNED by my wife.

Complaint: [redacted]
I am rejecting this response because:I will address each sentence of UFC Gym’s response individually:Sentence #1:   “This person is simply not telling the truth.”I wouldn’t waste anyone’s time including my own if this wasn’t blatantly wrong.Sentence #2:    “They had a contract that automatically renewed which is very common, and they claim they contacted the previous owners regarding the cancellation of the contract yet we have no record of this.”Untrue; we have a print out from their own data base which clearly shows that this membership was cancelled on 3/14/2013.  They supplied us with it on the very day that I uncovered these charges; 6/19/2015. (See attachment.) It’s even crossed out in their system, with eight subsequent charges totaling $665.01.Sentence #3:   “They have continued to pay for the membership for several years without any issue, and decided to suddenly contact us.”Once I became aware of the charges I immediately contacted UFC Gym. Shame on me for not catching it sooner, but since it was a quarterly bill on one of my wife’s cards, it went under the radar.Sentence #4:   “The regional manager of the UFC asked them to please provide proof that they had requested the cancellation, and they are not able to provide this information.”Untrue.  I sent their regional manager a very lengthy, detailed e-mail with the same four attachments that I included with this response.  I asked him to let me know that he received the e-mail with all the attachments; he never did.  (See included e-mails.)Dear Mr. Xxxxx,                                     ...                                         ... 23, 2015    First off, thank you so much for your time, this has been a very frustrating situation. Xxxx Xxxxx, the manager of "UFC GYM", Shrewsbury, has been nothing but helpful in trying to sort this mess out. It is clear that the membership was cancelled as of 3/14/13.  (See attachment #1.)  Mr. Xxxxx again cancelled this "membership" to immediately stop the bleeding.  (See attachment #2.)     Unbeknownst to me, we have been charged $73.83, every three months since Sept. of 2013 on my wife's "[redacted]" card, totalling $665.01.  Shame on me for not catching it sooner, but that fact that it was a quarterly charge, on one of my wife's cards didn't help the situation; it slipped through the cracks. Also, there was absolutely no correspondence when "UFC" took over [redacted]" informing us of the change of ownership; even though we were no longer members, we were still getting billed. That would have "red flagged" the situation sooner. I discovered this on June 19th, 2015.     The fact that my younger son, 17 at the time, joined while the business was [redacted]", and my wife cancelled the membership while it was still [redacted]", makes it all the more perplexing. He stopped going after two visits which prompted the membership cancellation.  We ate the $350.00; lesson learned. All but one of the nine quarterly bills that I paid were billed to "UFC" Shrewsbury, starting in Sept. of 2013; the first was listed as "LA Boxing", in June of 2013.  (See attachment # 3.)    My wife, who insisted on no automatic renewal or billing charges was misled by the original "manager/sales person" of [redacted]".  According to her the person she dealt with agreed with her request while she was there, but told her he still needed a credit card to seal the deal.  After which, he submitted it to "[redacted] anyway with no authorized signature.  This is a moot point since the membership was in fact cancelled 3/14/13. (See attachment #4.)     On a side note, I was informed by Mr. Xxxxx that I am not the only customer who fell victim to the very underhanded business practices of [redacted]", they have been picking up the pieces dealing with disgruntled customers since "UFC" bought out [redacted]".     Thank you again for your attention to this matter.  If it's not too much trouble, can you let me know that you received this e-mail and all the attachments? (I still don't trust e-mails.) Sincerely,[redacted](No response.)Dear Mr. Xxxxx,                                                               ... 24, 2015I was wondering if you read my e-mail and if you did, I would like to know your opinion and advice as to further action needed to resolve this matter.  Thank you.Sincerely,[redacted](No response.)On the 25th of June, 2015, I had several text messages from the regional manager, which by the end of them I was accused of “telling him what his job was”, he stopped all contact with me.  Those are saved on my mobile phone.   That prompted this last e-mail.Dear Mr. Xxxxx,                                     ... June 30, 2015    After our last text messages, I would like to know if there is any update. I would like to know the process of how I will get my money back.  I would like to know if my original e-mail was read and forwarded, and to who. Can I speak to them or anyone else?Is there a customer service department or human resources that I can deal with rather than take up your time?     I am not trying to tell you how to do your job, I am looking for names and possible time frames as to a follow up phone call, etc.No one is accusing you personally of any wrong doing but this is not going away until I am reimbursed of the money that was wrongfully withdrawn from a cancelled membership.Sincerely,[redacted]Sentence #5:   “We have kindly explained to them that we cancelled the contract as soon as they contacted us, even though there should be a 30 day notice of cancellation and that is really all we're able to do at this time until they can provide proof that they requested cancellation of the contract prior to 6/2015.”The mgr. did cancel the membership on 6/19/2015 when I initially called, but the print out which was provided to us shows it being cancelled way back on 3/14/2013.  So the cancelled membership was cancelled again.  (See attachment.)Sentence #6:   “There was clear communication to all gym members in 2013 when the [redacted] franchise was purchased by UFC Gym, and this purchase did not change any contract obligations.”We never received any notification when the business changed hands: if we did I certainly would have contacted UFC immediately.  On a final note, I am prepared to get satisfaction in way of a full refund, even it requires getting the media involved.  ("Shame on You", "Press on your Side.” etc.) That is not a threat, but a true statement.I am recently retired on a fixed income so I have plenty of time, money, not so much!
