Review: On April 21, 2014 I approved a contract and placed a down payment of $2,067.00 to Levato & Sons for masonry work on my home. I picked up a permit application on April 25th and asked [redacted] Levato to sign the permit application. After repeated requests, he finally came to sign the application on May 12th. At this time [redacted] Levato told me he will *egin the work after nine sunny days.

I applied for the permit the following day, May 13. On May 15, the Morris Plains Construction Official rejected the permit application for lack of plans and called Mr. Levato at 8:50 am to request the plans. On June 30th I went to the permit office and was told the su*mitted plans were rejected *y the construction official on June 12, and Levato had not yet responded or fixed the plans. [redacted]., an employee of Levato, told my hus*and *ill repeatedly that he would talk to the construction official and revise the plans. This never happened. On July 25, [redacted]. assured us he would contact the construction official on July 29th, and agreed with my hus*and that if this did not occur on that date, we will cancel the contract and Levato will refund our down payment. My hus*and called [redacted] on July 30th and was told he had not yet visited the construction official. [redacted] and my hus*and agreed to end the contract. My hus*and called [redacted] Levato on August 1st and was told *y [redacted] that he would mail the down payment *ack to me that day. We did not receive the check, and on Aug 5th we wrote a letter (return receipt) requesting our deposit *e returned. We have not yet received the check.Desired Settlement: I am requeting my deposit of $2,067.00 *e returned.
