September 20, Revdex.com *** *** *** ** *** * *** ** *** Chris C*** Euro Body FX *** *** *** ** *** ** *** Dear MrC***: In reply to your response to my complaint filed with Revdex.com #***, my husband and I would like the return of $because work was not performed on our Honda Odyssey VanThe van was brought into your repair shop Monday, June 19, I specifically asked if you were able to do transmission workYour reply was yesOn our initial contract dated June 19, 2017, it states: Replace Complete Assembly With Transfer of Parts (B); Labor Total $That is the contract I signedBecause you failed to provide service to our transmission, the van was picked up Tuesday, July 18, The only issues concerning this matter are the following: I telephoned you and spoke to you approximately weeks after the van was in your shopYou informed me that you were searching for a used transmission and, in fact, located a used transmission from "back east"I called again a week later and was told you had received a transmission but it arrived "cracked" and you did not want to put a "cracked" transmission in the van and was returning the "cracked" transmission to a business in "Denver"I noted the discrepancy but I waited for a call when the van would be ready for pick upI did not hear from youI called again and you told me you received another transmission and that it would be placed into the vanI also expressed my urgency to have the van returned fixed and you told me "If you want to come get the van that was up to me because the van wasn't ready"I replied no, we have waited this long and I just want the van repaired properly so that I could pick it upOn Wednesday, July 5, 2017, I called again to inform you that our only other vehicle, my husband's pick up truck was stolen from his work at the VA Hospital and now we had no vehicleYou told me again, "that maybe it would be better if I came and got the van because you had not fixed it"At that suggestion from you, I became very worriedI thought you had partially worked on the van and we would pick up the van inoperableWe waited until July 18, 2017, in hopes that the van would be fixed or at least drivable enough to retrieve the vanIt was not fixedThe day that we picked up the van, my husband and I saw you working on a truck and a transmission sitting on the ground inside one of your repair shop baysI did not see our vanWe searched in another bay and located our vanIt was on the far right side of the shop buried in the last bay with vehicles on the left side and in front of two other vehiclesOur van was very dustyIt looked as though the van had not been touched since we brought it to your shopThere was also a dent in the left front side of the van that had not been there when brought into your shopYou then told us that we would have to pay $for core charge or restocking fee which my husband reluctantly paid because we wanted our van and we were unable to drive it out without the removal of the two vehicles behind itMrC*** we are only asking for the return of the $because of your lack of serviceAll the excuses you offered in your response are the cost of doing businessThe warranty company agreed to pay $2,I agreed to $for labor cost because that was the price we had received from another quote to fix the vanIt is your business to find a transmission and replace the old transmissionThe fact that you gave the Revdex.com another invoice for a higher price is not the price agreedMrC*** we are not asking for money regarding how inconvenienced we were for the month without the use of our vanI am a senior citizenAt years old, I had to take the bus on several occasions to doctor's appointments and appointments with *** ***Your lack of performance, lack of keeping us updated on the progress or lack thereof, we had no choice but pick up the van and seek another repair shopWe should not be responsible for a charge of $for absolutely non performance on your partMrC*** if we do not receive restitution of $277.50, I am prepared to file a complaint with the states Attorney General Office, Consumer Protection Division and if we have to, file in small claims courtIf we file in small claims court I will be asking for not only the return of $with interest but also that you pay all court costsMrC***, please return our money within days of this letter or we will proceed as indicated above*** *** *** ***

where the only Charge was the Restocking Shipping charges not a core charge to send the Transmission Back to the place it was purchased from. I Christopher as being one in the same had never Spoken to [redacted] in any matter at any time including the day in question said to be July 18 2017. The only correspondence in any matter on this day and before was with [redacted], Telephone contact [redacted] up to the day in question . Was always upset on the problem with her van and the aftermarket warranty that was supposed To cover the cost of the repairs, on the van in question. [redacted] stated to me that she had been shopping around to a number of shops around Albuquerque that did not want to do the repairs. This was due to the fact that the warranty only pays a certain amount of money that did not cover The entire repair. The warranty did not cover the 2 two hours of diagnoses that I Christopher did Perform $98.00 per hour which would come to $196.00 dollars plus tax. The warranty only covered a Used transmission with an entire part cost of $1850.00 which is the exact cost that the shop paid with no mark up. I Christopher did match the offer set forth by the warranty for the part. [redacted] at that time did ask if I Christopher could help on the cost of labor and did agree to $700.00 dollars plus tax. I will attach a price quote that will show the true cost of this repair. This will show how accommodating I Christopher was to [redacted]. The Part took a considerable amount of time to arrive, as the warranty does not pay for expedited shipping. Within this time [redacted] become upset at the time frame, I Christopher has no control of that. [redacted] called the Shop Euro Body at or before 8:30 am July 18 2017; I Christopher did speak with her and let her know it would take one more day not 3 months as stated by [redacted] at that time demanded a rental vehicle, at that time I stated Euro Body does not provide a loaner nor a rental at the shops cost. Also the warranty company does not cover rentals as well. [redacted] become upset that her vehicle was here and stated she wanted to take it somewhere else to finish the work. At that time I Christopher told [redacted] that was up to her, but the fact of the matter is the transmission was already purchased and cannot be returned without a RESTOCKING FEE OF 15%. I Christopher explained that she was already very upset and that I reserve the right to refuse services at this time. I explained the two options that she had which are as follows One (1) to purchase the transmission at the cost of $1850.00 Plus tax and take the vehicle somewhere else, Two (2) to Pay the 15% RESTOCKING SHIPPING RETURN FEE OF $277.50. I Christopher Explained to her that I could no longer proceed with the agreement to replace the transmission. To further accommodate [redacted] I Christopher did agree to suspend all Labor and Shop Supplies cost at that time. [redacted] did agree to the RETURN of the transmission at the 15% RESTOCKING SHIPPING fee of $277.50. She did sign this agreement which plainly states no other fees charged but the RESTOCKING SHIPPING FEES AND NO OTHER LIABILITY BE BROUGHT FORTH TO EURO BODY FX. The return of the RESTOCKING SHIPPING FEE is not warranted because EURO BODY FX did not at any time make a profit from the RETURN of the transmission. It is unfortunate that the satisfaction of [redacted] could not be done to her standards, but this was the best and most civil compromise agreement by both parties.
