upon examining my contract Mr [redacted] is not fulfilling the contract as stated. In a workmanship like manner .And with his supervision which was nil. As Mr [redacted] is building my house in Mebane,NC there is some inferior work being preformed. Not installing frieze board and siding correctly. Not providing adequate height on a deck so water doesn't roll inside. Also, Mr [redacted] knows how to play the number game. Hes in breach of contract if he gets to 10 days of no work being preformed. Hes on Day 4, with a deadline approaching. He had 180 days to fulfill the contract of getting the house built. He is fast approaching that end date with still 40% to go to complete. He hardly returns phone calls never answers back where its on paper. Nor did we ever get a timeline from him stating when work was going to be preformed. He has been called out on numerous deficiencies: such as installing a fiberglass tub without a suitable mortar base, he chose wall compound. Which might void the Tub warranty. Installing Marvin windows fully on the outside and not shimming until after something was said to him about spaces in between by Me. Not the correct sequence in building. Installing Frieze board last by installing it Over the siding causing gaps and hole for insects to nest and eventually compromise the structure,all of which he said he was going to caulk which is not the proper way. If it was done correctly 4 people that looked at it wouldn't have told me not to accept it. Even the Building inspector said it was poor workmanship. I am also having it inspected by a Home Inspector and I will present him with his Punchlist. I have tried to work things out with Mr [redacted] but he chooses to take care of his other expensive homes first it seems. He as a builder refuses to install a concrete driveway for us, claiming that he doesn't want to warrany it for a year. He is only doing what is Spec'ed out. A garage floor and a parking pad. Only because my neighbor had a driveway problem with him a few years back. Which is one of the other complaints on Revdex.com. He has not put in writing any prices before commencement of any agreed upon extras from the onset of the build, so I had no idea how Much of my $15,000.00 cash deposit I was eating up till he presented me with the change orders after said work was completed. Not fair practice to me the consumer. I want to know how much something is going to cost before he ordered it not after it was bought and installed. That is strong arming and should be illegal. There are other smaller items like popping of the siding by a nail in the front of the house that truly I have no idea what he going to do. A broken plastic drip cap in the front of my house that he will not replace but is fixing with a plastic weld. I mean come on Its Brand new, I shouldn't have to settle for Broken & Fixed trim on my new Home. There is a hole in one piece of Siding on my rear deck he chose to fill it with JB weld. Do I sit back and take it? That's why I am writing to you today. I do Not want to argue, Fight, go to court when all of this should be 100% corrected at his expense. Hes the builder and should have done thing correctly or hired better Sub contractors that know the right way. I had to hire a local builder / mediator to shed light on his work, which was fair at best. That's what I was told. I am paying him top dollar to build my home and I told him my money is broken why should my house be? Back to my fiberglass tub. It lay un-protected in the master bath while everyone climbed in it over it and on it, a called was placed to him asking him to supply some sort of protection. He said over the years he got callused and said there was a guy he knew that can repair it. I simply said I have a guy that will fix your money that I give you too that's going to be broken but it will cost you. PS not a nice guy to deal with nor does he put things in writing. The End...Desired SettlementAll I am seeking is that the work in question be reworked correctly. At his expense due to lack of experience or knowledge or supervision or all of the above. And be done in a timely manner before I close on the house. The matter about the contract not being fulfilled is also being worked out as progress toward completion of house goes forward. Issues about workmanship have been corrected.Consumer Response /[redacted]/The contractor is working with me to resolve these issues. The progress is continuing as I write this response. He still needs to keep progressing forward to achieve completion. There are a few minor details that need to be corrected that he was made aware of due to a home inspection paid for by me to point out some mis-haps by either his oversite or hid contractors failure to measure correctly. I am also awaiting the completion of my inner porch, concrete parking pad and additional concrete work not finished from the last visit of the masonry contractor.
