construction contract, Lexar Homes completed a Final Walk-Thru Reportduring which the home owner is presentAll check list items are addressed, documented inwriting and initialed and signed by the customer as shown on the attached reportAt thebottom of the report, it is stated that, "Owner may not occupy the home until Lexar is able tocomplete the list of work agreed uponIf you choose to immediately occupy the premises,then the house is accepted "as is" and the repairs will not be completed." I have alsoattached a copy of the construction contract also initialed by *** *** detailing sections& addressed in the previously discussed section of the report.*** had an immediate need to occupy the home in the midst of the check list items beingcompleted, thereby, voiding any further responsibilities that Lexar Homes should've had forcompleting the check listLexar Homes, however, has completed everything addressed onthe original check list in hopes that *** would be more than satisfied with the services weoffer.One year later, we are still receiving calls on items *** feels is our responsibility, thoughnot originally addressed at the final walk throughLexar Homes has handled and repairedeverything she has requested, but feel she is constantly 'finding' further itemsLast month,a repair to a chip in her tub was still handled by Lexar HomesTwo months prior to thatanother issue she had regarding the 'look' of her fireplace stone she suddenly wasn't happywith was also handled and paid for by Lexar Homes.We feel all issues we were under obligation to address have been handled and that Trisha*** has treated us unfairly as a home builderRegular homeowner maintenance andchanging the look of the home after it is complete is not a responsibility of any builder afterthe home is complete according to the original construction contract.Sincerely,Bryan K***Idaho Rural Development, LLCMember/Owner

Complaint: ***I am rejecting this response because: As noted on the final walk through paper, there remain items that have not been completed from the initial list of problems such as a trim piece in front of the french doorsBare concrete is visible from the insideTrim piece on kitchen cabinet was replaced but has yet to be stainedNever were longer strike plates placed on doors as shown complete by Lexar
I did desire occupancy as I was told by Bryan that the build would take 110-days from beginning to endThe actual time frame was monthsI was told by Matt C*** who was the foreman on my build that I could occupy the house as soon as I obtained a certificate of occupancy which I didAs most items on my original punch list had been handled, I moved in on 6/1/After having lived in the house for a short time, I found other issuesAs stated by Bryan, the chips in the tub had been there since the beginning most likely the result of tile workThe fireplace stone was falling off the walls and the entire fireplace was not centered.I don't feel that that constitues not being happy with stoneThe stone was completed removed to center the fireplace on the wallI did ask if I could change out the darker colored stone for lighterI was allowed to have that done and the fireplace issue has been resolved
At this time, I have structural issues with the house which have been brought to light from a whole house inspection I had completed in 11/Lexar was notified with a list of issues at that time. I have water coming into the garage which comes in at least ft and runs the entire length of the garageLexar's fix was to run caulk along the door jambs which has not resolved the problem and is quite unsightlyThe floors creak in many areas with the problem becoming worse has time passesThere is exposed rebar along the front of the house
I feel that these issues should be taken care of by Lexar as they are structuralI believe that a homeowner has one year to bring issues to the builders' attention which I have doneSincerely,*** ***
