From: Lexington Auto Sales [mailto: [redacted] ] Sent: Thursday, May 07, 10:AMTo: [redacted] ***Subject: [redacted] Dear Revdex.com,In response to Ms [redacted] 's complaint.This will be short and sweetWhoever was driving the car wrecked it near the home of Ms [redacted] , then proceeded to drive it around yards in the snow into the drivewayMs [redacted] , or a family member then called the insurance company and made a statement that "someone had hit the car while it was parked in the driveway"The investigating police reported that there were clear tracks indicating that someone drove it around yards into the driveway, with snow tracks to prove itIt was concluded that the [redacted] s' statement was "misrepresentation of an insurance claim"The ironic thing is that the insurance adjuster told us here at Lexington Auto Sales that "All they had to do was tell the truth and the claim would have been paid!".It was basically considered attempted insurance fraud and the insurance company denied the claimIn the meantime, in the interim time the insurance company was investigating, Ms [redacted] told us she was going to get paid to have the car fixed, so, I, [redacted] ***, owner of Lexington Auto Sales sent it out to the repair shop to have it repairedI never would or could imagine that the insurance company would deny coverageBut by the time I found this out the car had been repaired and it was around $that was owed to the repair shopLexington Auto Sales HAD to pay this bill.We at Lexington Auto Sales got stuck with the bill, because Lexington Auto Sales was being trying to be helpful, courteous, and expeditious in getting the car repaired and back to it's owner.We even told Ms [redacted] that we would give her the car back if she could bring us $even given the fact that we paid $to get it outHow good can we be? Ms. [redacted], or a family member then called the insurance company and made a statement that "someone had hit the car while it was parked in the driveway". The investigating  police reported that there were clear tracks indicating that someone drove it around 50 yards into the driveway, with snow tracks to prove it. It was concluded that the [redacted]s' statement was "false misrepresentation of an insurance claim". The ironic thing is that the insurance adjuster told us here at Lexington Auto Sales that "All they had to do was tell the truth and the claim would have been paid!".It was basically considered attempted insurance fraud and the insurance company denied the claim. Review: I Bought My Car From Lexington Auto Sales Over the Summer. There Was Some Work That Needed To Be Done; Like Locks and Wheel Barrels. I Made an Agreement With [redacted] At Lexington Auto Sales That Either I can Get It Fix and she Lower My Car Payments Or I Can Bring It When I Have Time From College To Get It Fix. So I Called [redacted] Up An Told Her I'll Just Let Them Fix It An My Wheel Barrels Really Need To be Fixing. I Also Brought Her The Paper Of the Work That Need To be Done But She Says She Lost It. I came home from school to spend time with my mother the next day we come outside an my whole wheel is off the car. We thought somebody had hit my car so we call the police officer. [redacted] stated that we call the insurance and told them what happen but the police officer had inform us that the car does not look like it was a hit and run, It might be a mechanical problem, but still call your insurance. The officer left a written statement. [redacted] picked up the car the same day. No one told her that a check was being cut she wasn't even suppose to have the car fix until we knew for sure what the insurance said. She went on her behalf and had it fix an now they want 1500.00 From us plus I'm making Car Payments so she called an told us [redacted] said make your car payment an You can pic your car up witch I did but I still haven't had my car and now he saying he change his mind an they need at least a 1000 until I get my car an I don't think it's fair cause I'm making car payment an I'm Not Driven then they want 1000 on top of that .Desired Settlement: I Just Want My Car Back I put so much money into it an I can't even get it out my name.

This

letter is in response to complaint referenced above.

[redacted] purchased the car on 6/1/12 which means she had the car over a year. She

also signed the "as is" buyers guide, which your organization is

familiar with. We have always strived to help our customers in many situations

and if she came in we tried to help her as a courtesy we may have given her

advice. We may have even checked the car for her, but by no means are we going

to work on a car ( the car was purchased eleven months ago) without some kind

of prearranged agreement, i.e, customers repair in exchange for remuneration. Whether we did look at the car or not, the issue is irrelevant, due to the fact

that she bought it "as is" and the fact that she didn't pay the car

after driving it for almost a year.

The

car was repossessed due to being around $1200.00 past due.

As

for the accusations of inspecting cars or using dealer plates illegally, we

have no comment on that, except that it is irrelevant and ridiculous.

We

realize and your organization realizes, that there's always more to the story.

You also realize, after reviewing our record with you, that we have always

responded and promptly and dealt with each situation to the best of our ability

and good name.
