RE: *** *** *** This is Lexington Law Firm’s formal response to Mr***’s Revdex.com complaintLexington now responds to Mr***’s Rebuttal to Lexington’s Response to his Revdex.com ComplaintLexington had instructed Mr*** on several different occasions that it would not challenge the hard inquiries on his credit reports on his behalfLexington focuses on the negative items listed on its clients’ reports and challenges them as to their accuracy if applicableAlthough hard inquiries may have an impact on an individual’s credit score, it is not considered a negative item that Lexington is willing to challengeLexington provides tools that allow its clients to challenge the hard inquiries if they feel it is appropriateAdditionally, Lexington is unable to guarantee that items will be removed from his reportsLexington can challenge the item with the credit bureaus and send letters to creditors on the client’s behalf, but ultimately the decision to report or not report is left to the credit bureaus and/or the creditor. An attorney contacted Mr*** based on his original Complaint and explained this to himMr*** stated at that time that his Complaint had been resolvedLexington no longer represents Mr*** based on his dissatisfaction with its servicesLexington has again taken steps it feels should resolve Mr***’s Complaint and has communicated these steps to Mr*** in an emailIf Mr*** has further questions it would urge him to contact Lexington directly to discuss his concerns. RE: *** *** * *** This is Lexington Law Firm’s formal response to Mr***’s Revdex.com complaintLexington Law Firm is disappointed any time a client is unhappy with their resultsLexington challenges questionable negative information appearing on
consumer credit reportsLexington cannot guarantee and clients do not pay for a particular credit report outcome or resultRather, Lexington charges fees only for efforts taken on behalf of our clients. A creditor may re-report an item that has been previously deleted by the credit bureaus. It can happen if a creditor or debt collector fails to verify the information being challenged during the credit bureaus’ reinvestigation of a consumer disputeIf the creditor fails to verify within this period, sometimes the negative item is removed from the credit report and later reported again after verificationIn that situation, Lexington encourages its clients to speak with a paralegal about additional challenge methods. Lexington takes all complaints seriously and diligently works to reach a mutually agreeable resolutionAccordingly, a Lexington attorney reached out to Mr*** to discuss his concernsAt the time of this response, Mr*** had not respondedDespite not being able to speak with Mr***, Lexington has taken steps it believes should resolve his concerns. RE: *** *** *** This Lexington Law Firm’s formal Response to Mr***’s Complaint with the Revdex.comLexington bills its client in accordance with federal legislation called the Credit Repair Organizations Act, which in relevant parts states that payments for credit
repair services cannot be collected until after services have been performedLexington does not charge a retainer, but rather the first payment to Lexington is the cost to set up the client’s caseThis includes pulling additional credit reports, providing identity theft protection and insurance policy, credit monitoring and a FICO score, and budgeting and other online toolsThis fee depends on the level of service the client chooses. After this fee, which is billed after five days of enrolling in services, Lexington continues to provide these services as well as sending challenges to the credit bureaus and letters to creditors on the client’s behalfLexington does not bill for these services until after they are performed, and does so every thirty days after the client’s initial payment as indicated in the engagement agreementMr*** did not terminate the representation within the first five days of service and was thus charged the amount to set up his case with Lexington. An attorney from Lexington has reviewed Mr***’s case and Complaint and has attempted to contact him to discuss his concerns in more detailsAs of the time of this Response Lexington has not heard back from Mr***, but has taken reasonable action the firm believes should resolve his concernsLexington has emailed Mr*** to inform him of these actions and would urge him to contact Lexington directly as indicated in the voicemail and email sent to him if he has any additional questions or concerns. RE: *** *** * *** This is Lexington Law Firm’s formal Response to Ms***’ Complaint with the Revdex.comLexington assists client in ensuring their credit reports are an accurate portrayal of their credit historyThe firm does this by
challenging items directly with the credit bureaus and sending letters to creditors on the client’s behalfLexington understands each client has different circumstances and a different budget and offers different levels of service to attempt to accommodate each individual who needs to improve their creditAlthough Lexington offers coaching and other tools to assist clients with their credit score, Lexington focuses on the credit history, which is only one aspect of the credit scoreOther factors such as utilization ratio, credit inquiries, and type and length of credit also impact a credit score. Upon receiving this Complaint, an attorney from Lexington reviewed Ms***’ case to look into her question about billingWhen Ms*** engaged Lexington to represent her, she also agreed to pay for her husband’s case, which is a separate case and was billed according to the engagement agreements signedAn attorney has emailed Ms*** regarding this Complaint and resolution, but as of the time of this Response has not yet heard back from herIf Ms*** has questions or would like to discuss her case then Lexington would urge her to contact Lexington as indicated in the recent email to her. agreement each client must agree to and sign before becoming a client. After becoming a client, Lexington bills in accordance with the Credit Repair Organizations Act, which mandates that money cannot be collected until after services have been performed. Because of this, when a client terminates the representation there has often times been work completed on a client’s case that has not been paid for, and will be collected after the representation is over. Upon receiving this Complaint from Ms. [redacted], an attorney reviewed her case and reached out to her via email to discuss her Complaint. Lexington has taken steps it feels should resolve Ms. [redacted]’s concerns and have communicated them to her through email. If Ms. [redacted] has any questions about her case or Lexington’s resolution, the firm would urge her to contact Lexington directly as indicated in the email to her. Claudia I[redacted]Attorney StaffAdministrative AssistantLexington Law FirmNorth Salt Lake P: (801)297-2494Ext. 20056E:[email protected]

RE: [redacted] This is Lexington Law Firm’s formal response to Ms. [redacted]’s Revdex.com complaint. Lexington has had the joy of seeing millions of negative credit items removed from our clients’ credit reports during our representation of them. Nevertheless, we regret to...

learn that even a single client is unsatisfied for any reason. In this complaint, Mrs. [redacted] expresses her frustrations with Lexington Law Firm’s billing and claims, “they do not explain to you if you file as a couple that it is still 2 separate accounts… They asked if I had my credit card link to another account I stated my husbands. Well she stated it was taken for his account. I become upset and I assumed our accounts are linked together.” [sic] Lexington Law Firm functions as every other law firm, in that each client has his/her own separate case to ensure attorney-client confidentiality. Even when two clients open a case at the same time and obtain the Friends and Family Discount, they still have two separate cases. In fact, during the case setup call with Mrs. [redacted] and her husband, the Credit Consultant told them both on speaker phone, “It’s a new case for him (husband).” The husband gave a different phone number and email address for his case, and he signed his own separate Engagement Agreement and paid $14.99 for his own credit report. In addition, the Credit Consultant specifically asked if Mrs. [redacted] agreed to use her same payment information on her husband’s case, indicating that the two cases were separate. Mrs. [redacted] agreed and authorized Lexington Law Firm to charge her credit card for both cases.                                                                 ... Mrs. [redacted] contacted Lexington Law Firm to inform it that the Friends and Family Discount had not been applied to her case, a refund was issued, AND as a courtesy, Lexington Law Firm applied a discount for the next month. Mrs. [redacted] assumed that her email to Lexington Law Firm to change her payment date would change it for both cases. Again, due to attorney-client confidentiality Lexington Law Firm cannot make changes or discuss one client’s case with another client without consent, regardless if they signed up together and one client is paying for both cases. Furthermore, Mrs. [redacted]'s email stated, "Who do I contact about getting my payment taken out on the 23rd of dec and not the 14th of dec." [sic] Nowhere in her email did Mrs. [redacted] indicate she wanted to change both her and her husband's payment dates. As soon as Lexington Law Firm learned of the discount error, it immediately went above and beyond fixing the error by giving a discount and a refund. The other billing concerns Mrs. [redacted] had were of no fault of Lexington Law Firm. Each and every time Mrs. [redacted] had an issue with billing, she threatened to go to the Revdex.com to file a complaint. Due to her unwillingness to peacefully work with Lexington Law Firm to address her issues, Lexington Law Firm decided to end its representation of Mrs. [redacted], as it reserves the right to do in the Engagement Agreement. Lexington Law Firm is unwilling to conduct business with a client who consistently threatens to file a complaint to get her way with refunds and discounts. Lexington Law Firm has already provided Mrs. [redacted] with refunds and discounts. She has received multiple months of representation for an amount significantly less than she was contractually obligated to pay. Therefore, no further refunds will be issued, and Lexington Law Firm considers this matter closed. Claudia I[redacted]Attorney StaffAdministrative AssistantLexington Law FirmNorth Salt Lake P: (801)297-2494Ext. 20056E:[email protected]

I am rejecting this response because: my complaint has to do with the misleading of me by Lexington law firm to represent me. They were hired to send letters on my behalf, It was my understanding that the law firm handling the case was doing so in their name, not...

sending letters that appear from me.

receives referrals from different companies to help individuals with various aspects of their credit. Once a person signs the engagement agreement and becomes a client, Lexington sets up their case and obtains and analyzes all credit reports, initiates an identity theft insurance policy, and provides them access to a client website with various online credit tools. Each client has a five day right of rescission, and if he or she terminates the representation within that period there will be no payment owed for the setup of the case. An attorney from Lexington has reviewed Ms. [redacted]’s case and verified she did cancel within her right of rescission. Lexington Law Firm’s formal response to Mr. B[redacted]’s Revdex.com complaint. Lexington Law Firm is disappointed to hear of Mr. B[redacted]’s dissatisfaction and any problems he had with Lexington’s credit repair services. Lexington Law Firm strives to ensure that any matter of this nature is resolved promptly and to both parties’ satisfaction.  Mr. B[redacted] first signed up with Lexington Law Firm on February 26, 2015 to have Lexington challenge negative items that appeared on his credit reports. In the span of the five and a half months Mr. B[redacted] was with Lexington, a total of 26  negative items were removed from Mr. B[redacted]’s credit reports. Lexington worked with Mr. B[redacted] to lower his monthly payments to make Lexington’s service more affordable for a period of three months. Lexington is disappointed to hear that there was a misunderstanding regarding the billing process and the timing and amounts that payments would be drafted. After hearing of Mr. B[redacted]’s issues regarding billing and payments, Lexington Law Firm has contacted Mr. B[redacted] in an attempt to resolve all issues. After speaking with Mr. B[redacted] both parties have come to a resolution that is satisfactory to both parties. Thanks,Kristine G[redacted] | Managing Executive Assistant, Lexington Law FirmStatement of Confidentiality: The contents o

up for Lexington Law Firm's services to challenge questionable negative information appearing on his credit reports.  Lexington Law Firm has challenged these negative items on Mr. P[redacted]'s credit reports with the three major credit bureaus as well as specific creditors.  In addition, Mr. P[redacted] has had access to the client website that displays actions taken on his behalf and provides personalized education regarding the credit repair process, specifically regarding the five major factors used to determine his credit score.  Consequently, Lexington Law Firm has performed the services that it agreed to perform. Thanks,Kristine G[redacted] | Managing Executive Assistant, Lexington Law Firm

RE: [redacted] This is Lexington Law Firm’s formal response to Ms. [redacted]’s Revdex.com complaint. In its Response to Ms. [redacted]’s Rebuttal, Lexington reaffirms its statements made in its Response to her Complaint. In its attempt to contact Ms. [redacted], a direct number was given to her to call that would go directly to an attorney’s secretary. Lexington apologizes if that was not clear to Ms. [redacted] and she was not able to get through. Again, Lexington is unable to predict exactly what happens with a client’s credit report or score as it is in the control of creditors to report items and credit bureaus to place them on consumers’ reports. Lexington attempts to assist clients in removing negative items from their reports, as indicated in the engagement agreement every client must sign before Lexington will perform services for them. Lexington again reached out to Ms. [redacted] by phone and email and as of the time of this Response has not heard back from her. Lexington has, however, attempted to take steps to resolve Ms. [redacted]’s concerns and have tried to notify her of these steps. If Ms. [redacted] has additional questions for Lexington she should contact us directly to discuss. Claudia I[redacted]Attorney StaffAdministrative AssistantLexington Law FirmNorth Salt Lake P: (801)297-2494Ext. 20056E:[email protected]

Re: [redacted]. [redacted] This is Lexington Law Firm’s formal response to Ms. [redacted]’s Revdex.com complaint. Our response addressed your concerns already.  There is nothing new in this rebuttal to consider.  We saw your report, you told us the items were either inaccurate,...

or you wanted them verified.  We did perform the work.  Either the credit bureaus investigated and found those items should remain, or if you believe the investigation is inadequate, you may have us re-challenge the item as you did, or you may take them to court.    Our service is much less expensive than retaining a litigation attorney, and should be a person's first step in any case, but litigation may be your next step if inaccurate items remain after all of our work.   Seeing your report does not allow us to make predictions about the investigation we cause through our work.  We agreed only to challenge those items as provided by law.  How can we possible know what the result of the investigation will reveal?  If you still believe the items are inaccurate you should contact a litigation attorney as we advise.   We fully performed the work we promised to do, and provided you with many discounts along the way, far more than any others received.  Since you chose to keep us working on your items, we cannot issue you a full refund.  We appreciate your business but we feel your request to be unreasonable as you were in complete control the entire time and chose to keep us working on your behalf.  Perhaps there is some confusion about professional services such as medicine and law.  We take the patient/client as he comes, but can make no promises, and will be paid for work done, not results obtained.  You agreed in writing that we cannot promise results, only to do the work you request.  Thanks,Kristine G[redacted]|Managing Executive Assistant, Lexington Law FirmStatement of Confidentiality: The contents of this e-mail message and any attachments are confidential and are intended solely for the addressee.
