represent him in October of 2016. At that time, Mr. [redacted] signed an engagement agreement that outlines what services Lexington would provide for him as well as the rights he has as a client and the prices and billing procedure that would take place. Over the nine months Mr. [redacted] was a client, Lexington provided credit repair services to him and collected money according to the engagement agreement. Over the course of these nine months Mr. [redacted] called in eight times to speak about his case and go over billing. An attorney from Lexington has contacted Mr. [redacted] to discuss his concerns about Lexington’s billing and drafting payments from him. As of the time of this Response Lexington and Mr. [redacted] have not been able to discuss these concerns. this 'score', based on your financial activity.  We can only do the work which initiates your challenge to inaccurate items.  You are responsible for the accuracy of your position, and we cannot know the status of an item until it is investigated.  This is why you only pay after the work is completed, and have the right to cancel at any time you feel our work is complete.  Most importantly, we received your first indication you wished to cancel on February 4th.  Your message was received and processed with case closure on February 7th.  We also see the communications you sent between the 4th and the 7th.  The bill you paid on February 7th was the charge for services between January 8th and February 7th.  One of our agents then credited you $12.00, to refund you for this period.  All of this is as agreed at your sign up.  Additionally you were only with us from January 2nd, to February 4th, yet our work resulted in at least 6 deletions of negative items from your 3 reports.  Not only did we do the work we promised to, but you received a clear benefit from our service.  We note that you paid our set up fee and one monthly fee, and this was as agreed, and you received not only the labor and services you contracted for, but our results on your behalf are quite an improvement for your situation.  We hope you will adjust your opinion of us, due to these facts, and we ask that you acknowledge our work, our results, and your improved situation due to our efforts. Claudia I[redacted]Attorney StaffAdministrative AssistantLexington Law FirmNorth Salt Lake P: (801)297-2494Ext. 20056E:[email protected]

in a timely manner. The procedures Lexington follows for billing its client is in line with the Credit Repair Organizations Act, which states that payment for credit repair cannot be collected until after work has been performed. When Lexington collects a payment, therefore, it is for work that has already been completed on the client’s behalf. Lexington does not allow any client to “prepay” for the next month’s services. Because of this method of billing when a client cancels his or her case, in most instances work has already been completed for the client, but not paid for. The amount owed when a client cancels is not a cancellation fee, but rather payment for the work already completed. The amount of this payment depends on how much work has already been performed when the client cancels. Lexington also provides a five day period where clients can cancel their case with no charges at all, which is more generous than the 3 day period under the Credit Repair Organizations Act. After reviewing Ms. [redacted]’s case, she did not cancel her case within the five day period and Lexington sent our dispute letters to credit bureaus and letters to creditors on her behalf. When Ms. [redacted]  cancelled her case the charge was for the work completed and not for any type of cancellation fee. All of the above information is also included in the engagement agreement that Ms. [redacted] signed when she enrolled for services. All clients must sign this agreement before Lexington agrees to represent them. Lexington is sorry if this information was clear to Ms. [redacted] upon her sign up. 2016 for assistance with credit repair and to specifically address negative items on her credit reports. During the four months Mrs. [redacted] was with Lexington several disputes were sent on her behalf to the credit bureaus and letters were sent to creditors. Several negative items were deleted by the credit bureaus from her credit reports while she was with Lexington. Although not common, negative items can be re-reported by creditors if they are able to verify their accuracy. Lexington cannot control this as it has no control over what is reported by creditors and the bureaus, but rather can only respond after an item has been placed on an individual’s report. After receiving the Complaint from Mrs. [redacted], and attorney from Lexington reviewed her case and reached out to her to discuss her concerns. Although it may unclear who was ultimately responsible for the negative items being deleted, Lexington did in fact send challenges to the bureaus as directed by Mr. [redacted] and tracked those changes when it updated his credit reports. Upon receiving the Complaint from Mr. [redacted], an attorney from Lexington reviewed his case and reached out with him to discuss the details of the Complaint. We received the following information from the business regarding your complaint:  RE: #[redacted] This is Lexington Law Firm’s formal response to Ms. [redacted]’s Revdex.com complaint. Customer was only charged for work done prior to her notice of cancellation with us.  We prorated the last month to a lesser amount to comport with the number of days she continued to have us work her case that month.  Additionally customer attempts to make her service about her credit score which we specifically disclaim in our sales pitches and contracts that govern the entire relationship's expectations on both sides. During the time the customer was with us, our work was performed as agreed each payment cycle, and she understands she may request proof of that at any time, and we will even send her the entire case file as proof.  Additionally the credit bureaus themselves have informed us that they have removed at least 17 items from her reports.  Since a score change cannot be estimated for this work, we don't promise score changes.  A customer sees this disclaimer everywhere in our process.  A score is a private model that takes into account many factors, while our service focuses on removing inaccurate items.  A score change of some kind might occur but our service is not tied to it in any way, nor do we advertise such.   A file review as a result of this complaint has revealed that customer's complaint is not valid.   Customer's demand she receive all of her money back is therefore not valid. Thanks,Kristine G[redacted]|Managing Executive Assistant, Lexington Law FirmStatement of Confidentiality: The contents of this e-mail message and any attachments are confidential and are intended solely for the addressee. I am rejecting this response because:
 I [redacted] am rejecting the letter regarding my situation,,, they strictly told me over the phone that they would help in lowering my credit rating,,, and manipulating me credit score on their website,,, my credit rating showed it was a 640 credit rating and when I started the contract with Lexington Law Firm they showed a lower rating every month all the way down to the 560 rating,,, I really believe that Lexington Law Firm preys on people that don’t have higher ratings,,, continues to deduct $119 a month just for sending letters to companies that I had a credit with before,,, everyone of them denied ever lowering my rating and totally rejecting the offer from Lexington Law Firm,,, this is a bogus company that steals money for people that don’t have proven results and continues to lie to people about their business proposals,,, Sincerialy [redacted]

Lexington takes all concerns seriously and strives to resolve them in a timely manner to all parties’ satisfaction. Ms. [redacted] signed up to have Lexington address and attempt to have removed negative items listed on her credit reports. Throughout the three months Ms. [redacted] was with Lexington, over 30 disputes were sent to credit bureaus and over 10 letters were sent directly to her creditors. Lexington is confused as Ms. [redacted] would say Lexington really hasn’t done anything for her. During her time with Lexington Ms. [redacted] did see several negative items come off her credit reports. An attorney from Lexington Law Firm reached out to Ms. [redacted] several times by phone and again through email. At the time of this response Lexington has not received any returned correspondence from Ms. [redacted] in this matter. service" We challenged your items that you told us were incorrect, as agreed in our engagement agreement, which was digitally signed by you after you attested you read and understood the terms.  The credit bureaus themselves have notified us that as of February, after 4 months of providing you this service, they removed at least 8 items from your reports.  We cannot promise any results, and you agreed to this.  How could we?  We prompt an investigation that you tell us is appropriate to your situation, and any removals will depend on your accurate assessment of the item appearing on your report.  Even though we could never pretend to promise any particular result, only provoke the investigation, we achieved those 8 deletions for you.  Thus your statement 'they don't provide the service, is quite inaccurate to say the least. "and even after cancelling they continue to take money out of your account without your permission, refusing to give it back. Stealing from people who have cancelled" As you agreed, we cannot charge in advance for any month you choose to have us work, we can only bill after the month's work is completed. You were informed of this and signed a document memorializing your understanding of this important term.  We do not charge in advance.  Your complaint pretends that we bill prior to any work being completed, and so you complain about the bill for work done your final month prior to your cancellation.   Due to your complaint we reviewed the charges we made to the payment method you agreed would be honored by your bank, and all charges are appropriate and as agreed.  We note that we had continual difficulty with funds not being available on the date you selected, so we accommodated you with several date changes for your convenience, and even waived the late fees as a courtesy for you.  “Their customer services reps are rude and hang up on you” Our notes show our agents helping you with issues, granting you discounts, providing explanations, and being generally helpful.  The only odd call was where you attempted to blame us for your lowering credit score.   The agent explained we cannot control certain factors such as all of your credit cards being over the limit.  This will drastically affect your credit score and the agent was correct to help you understand we can't cause your score to decrease, and most importantly negative trade lines only account for about 1/3 of the total score you have been assigned. Our service only addresses these factors through education in the form of an easy to use website discussing these factors and what you can do.  There is no way to fix this issue but pay down your balances.  Additionally, we have no record of any agent hanging up on you, regardless of your demeanor towards them.  We expect you may remember the many courtesies that were extended to you, however, including waiving late fees for the hard declines your payment method caused, and kindly changing your billing date several times at your request. “They have false advertising stating they repair credit but after signing up they tell you that’s not what they do. Once asked to provide proof or documentation of what your paying for they hang up on you.” We do what we say we will.   There is no false advertising.  You do not supply the ad you mention, and we don't believe any exist.  Your results are proof of our work, and so is the entire case file with documentation of all the challenges on your behalf.  You have not made a copy request, but you may at any time, including after your case is closed.  We urge you to make this request if you have any legitimate doubts in addition to your statements above. Desired Settlement: RefundTo correct their advertising and to have them refund the money they stole. We certainly did not steal any money from you. Lexington reaffirms the statements it made in its initial Response to Mr. [redacted], specifically that Lexington is unable to guarantee any specific result to any client. Lexington challenges negative items on clients’ credit reports to ensure their accuracy. Lexington did this with negative items on Mr. [redacted]’ credit report in accordance with the engagement agreement Mr. [redacted] signed. The engagement agreement also indicates that Lexington is unable to promise specific outcomes. Lexington does not have control over Mr. [redacted]’ credit rating, and specifically only addresses the negative payment history from his credit reports. Based on Mr. [redacted]’ case, while challenging the negative information with the credit bureaus, Mr. [redacted]’ credit utilization ration went up and there were new credit inquiries on his reports, both of which can negatively impact a credit score. Lexington obtains a FICO score based on clients’ TransUnion reports that does not show a drop in 80 points as indicated by Mr. [redacted]. An attorney from Lexington has again tried to contact Mr. [redacted] via phone and email to discuss the details in his Complaint and Rebuttal. Lexington has even offered to allow Mr. [redacted] to listen to the call when he first engaged Lexington to represent him to show no promises were made to him. As of the time of this Rebuttal, Mr. [redacted] has still not returned any call or email from Lexington.
