Initial Business Response /* (1000, 15, 2015/12/08) */

Retyped by staff
Firstly, I would like to say, as I did while MrsW*** was cussing me, I am sorry the trunk was a surprise to themWe had asked several times to both her and MrW*** if they wanted to pay the
additional monies to have the huge stump ground and removedTheir answer each time was that their elderly lady friend who chopped wood for a living would be very pleased with the woodWe knew better however could not convince either one of themBoth were pleased with the job performed and in speaking to the neighbor and his wife, they too were amazed at the size once the trunk was had been downedAgain we offered and no one wanted to pay the additional amountThe estimate is attached and that work was performedWe went back (when requested by cussing and badgering) to take ADDITIONAL brush awayHowever, neither understood this would need to take place "between" other scheduled jobsTo date we have NOT been compensated for this workThe W***s still owe $We would like this to go on record
I apologize Lexington Wood Source did not reply sooner as I had a mild heart attackShould you have further questions, please reach me at ***, ***
Sincerely,
Ken L***
Initial Consumer Rebuttal /* (3000, 17, 2015/12/17) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I, John W***, am responding because the response from MrKen L*** is not stating the facts as my wife and I remember themSeveral of statements are just not true
While my wife was angry when she talked on the phone she says she did not curseShe told me she said something like '' you are 'damned' right we would not recommend your company to others
We had two previous proposals to trim our trees and we also requested one from Lexington Tree Service and MrL*** showed up ahead of the scheduled time on July 22, when I was not at home and convinced my wife that the tree was old and had exceeded its lifetime and that it should be cut down not just trimmedThe proposal was already written when I arrived at home for the maple tree to be removed and the others trimmedThe stump and the stump grinding were brought up by MrL*** and my wife and I decided against having the stump removedWe are making a 'rock-garden around it
At no time was there anything discussed about the trunkIt was feet in length with many partial huge branches still attached brought down into our neighbors yardBefore the tree was actually felled into the neighbors yard, MrL*** left with the 'climber' around noon what I thought was a lunch break was actually to have a look at a neighbors tree and soon I heard saws and I could see the climber cutting a tree down there before returning to finish cutting down our treeThat climber should have remained here on our job and should have trimmed our front elm tree that day
Later that week Thursday Augthe two men crew attempted to reduce the top of the elm tree but could not reach high enough with the ladder truck to trim the tree top properlyThe top of that elm tree never did get reduced and that is another reason why we do not think we should pay for work that was not done on that tree besides other work my wife and I ended up doing ourselvesRead on
While our neighbor graciously had agreed to allow Lexington Tree Service back the chipper and their truck on their driveway and their yard to near the Maple tree and to drop branches on their yard, they were upset when that huge trunk ended up laying mostly in their yardThey requested that I contact the company to clear their yard immediatelyBecause of a medical issue with one of their workers the next morning and an other issue with another worker, nothing was done for two days after the tree was felled
The large limbs were cut off the trunk on Thursday, August and the trunk was cut in sections by the two workers but they could not 'roll' those into our yard because they were to heavy to handleDuring the remainder of the week the heavy pieces remained where they where, pinning the smaller branches that should have been cleared and chipped before dropping the big ones on top
I hired a contractor with a big backhoe and a dump truck to clear the heavy items from our neighbors yard and from our yard in order to free the formerly pinned down smaller limbs so they could be accessed and removedIn fact, Lexington Tree Service could not have removed and chipped the smaller limbs because they were pinned down before Saturday
This contractor moved the heavy chunks off the smaller branches into clear areas so Lexington Tree Service men and my wife and I could get these to the chipper that Saturday morningWhile doing this he had to position the backhoe each time and then again later when he loaded them unto his dump truck, our yard was ruined in those areas
Since no request for payment was sent to us for about two weeks or longer, we thought that because of the problems and the delay with the cleanup etcthe company were not going to request any further paymentsThat is why so much time went by before we wrote to them and to you the same dayMy wife wrote the complaint to you, quoting from my letter to Lexington Tree Service, on 10-20-
MrL*** never returned here after August to check on thingsI never received a copy of his respond to Revdex.com or to my letter to him we mailed on October or registeredbut not picked up and signed for until December 7, A check for half the balance we were willing to pay was sent along with that letter but has not been cleared by our bank
I might have said ''take care of this instead of '' handle this '' to MrsL*** on the phone but the mail we sent on or about October should have made that clear
My wife and I worked from afternoon/late evening August 3rd until evening August 8th trying to free what we could of the pinned down limbs, cleaned our neighbors long drive, part of their front and back yard, our front yard from the branches left there from trimming our elm tree and finally our whole back yardWe later worked on repairing our lawn which we are going to finish next spring
We regret we let MrL*** talk us into cutting the tree cut and not just trim it and we regret that we hired Lexington Tree Service because of what we experiencedWe were told it would be two long days, not seven daysHad MrL*** actually discussed the trunk instead of just the stump and quoted a separate price for that in addition to the $proposal total I think we would not have that tree removedMrL*** might have discussed tree trunks with other customers but he did do that with usUnfortunately! Enough said!
John W***
