Lexus of Akron-Canton's Response
Case # [redacted]
The Customer purchased his 2013 Lexus RX350 (the "Vehicle") from Lexus of Akron-Canton on September 22, 2015. When the Customer agreed to purchase the Vehicle he asked for a trade appraisal...

on his 2007 Ford Focus. Lexus of Akron-Canton appraised the Ford Focus and offered him $1,500.00 trade-in value for the Ford. The Customer accepted our offer of $1,500.00 and said he was going to use the $1,500.00 trade-in amount as a down payment towards the Lexus purchase. After the Customer agreed to purchase the Lexus and the Buyers Order was prepared reflecting the $1,500.00 trade-in value, the Customer asked Lexus of Akron-Canton's pre-owned manager, Jeff Schultz, to omit the trade from the deal. Mr. Schultz clarified with the Customer that he intended to pay the $1,500.00 outright in lieu of the trade credit and the Customer confirmed that was his intent. Lexus of Akron-Canton prepared a new Buyers Order which reflected that a down payment of $1,500.00 was due at the time of purchase. To date, the Customer has not paid the agreed upon down payment and he is now claiming that it is not owed. The Customer has stated that he has a copy of a Buyers Order reflecting that he does not owe the $1,500.00 down payment. Lexus of Akron-Canton has asked the Customer repeatedly to provide a copy of this document and as of today he has failed to do so.
With regard to the Armorall SmartShield, our records indicate that the product was applied to the Vehicle at the Customer's request on October 7, 2015. We have a Repair Order reflecting that the work was completed and we also received verbal verification from our Service Manager that the product was applied to the Customer's Vehicle. The cost of the Armorall SmartShield, as reflected on the Buyers Order, was $1000.00 not $2000.00 as stated in the Customer's complaint.
While we regret that the Customer is dissatisfied with his experience at our dealership, it is our position that he owes the down payment of $1,500.00, and we are simply asking him to pay what he agreed to and what the Buyers Order substantiates. Taking the Vehicle back is not an option at this point, because the Customer has been driving it for over two months and the value of the vehicle has significantly depreciated.
Initial Consumer Rebuttal /* (3000, 7, 2015/11/26) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Nobody at Lexus ever told me that I owed them $1,500 I got a call about 3 weeks later after signing papers and not receiving my title after my plates has expired even when I talked to Metro Lexus of Cleveland they said that this Lexus of akron is nothing but crooks the salesman. If I owed them $1,500 why didn't they collect it when I signed the final paperwork. Also the Armour wall shield was not applied you can just tell by looking at the vehicle also my dad sells of chemicals for a living and I've had 3 people look at it and of all said there's no protection put on it. I've also contacted the Attorney General of Ohio and he's has stated that there's been nothing but problems with this company to

Lexus of Akron-Canton ("LAC") has reviewed Mr. Z[redacted]'s concerns and our records with respect to his purchase of a 2008 Lexus GX 470 (the "Vehicle"). When Mr. Z[redacted] purchased the Vehicle, LAC obtained a CARFAX Vehicle History Report...

which reflected that routine maintenance had been performed and there were no major accidents or issues with respect to the Vehicle. Prior to purchasing the Vehicle, Mr. Z[redacted] inspected it on a lift at LAC on two separate occasions, and also took the Vehicle to a third party for inspection. In addition, LAC performed its used car pre-delivery inspection, a routine oil change and tire rotation. LAC also repaired - at Mr. Z[redacted]'s request - an inoperable running board light bulb, socket, and connector. Mr. Z[redacted] purchased the Vehicle - a used car with over 129,000 miles - "as is", with no warranty, and he also signed an Agreement to Binding Arbitration. Although we are disappointed Mr. Z[redacted]'s experience has not been satisfactory, LAC believes it is not responsible for the problems Mr. Z[redacted] has incurred. Notably, the Lexus dealership where Mr. Z[redacted]'s vehicle was ultimately repaired informed LAC that Mr. Z[redacted]'s subsequent issues with the vehicle could only be detected when the check engine light came on, and it had not been on at any time when the vehicle was at LAC.
Nevertheless, LAC offered Mr. Z[redacted] $1,000 to resolve the matter in an effort to satisfy his concerns. He declined our settlement offer and pursued this claim with the Revdex.com.

Initial Business Response /* (1000, 5, 2015/06/26) */
We contacted the customer to ask them to show us the screen shot of the 2 years maintenance. During that month Lexus had the first 2 services included (the 5,000 & 10,000 mile maintenance) but not the first 2 years. If the customer proves...

otherwise, we will be happy to honor it.

I forwarded over the screen shot of the promotion to my salesman on 6.26.15. It does say it is for two years. Please let me know the outcome of this case. Thank you.
Final Business Response /* (4000, 13, 2015/07/17) */
Yes we will honor her request regarding the maintenance as we stated weeks ago when we first received the Revdex.com complaint. Why was this not relayed to the customer from the Revdex.com??? Please let her know that we will. I will also have our staff reach out for good measure.
Thanks.
