LGI Homes - Arizona

Dear Sir/Ms.,
I am lodging a complaint against LGI Homes on Marana Road, Marana. Arizona. This is based on their
refusal to return my earnest money of $1000.00 nine days after it was submitted. The Sales Agent, Ms.
*** ext. *** had indicated the earnest money would be returned to us in
full should we decide to withdraw our application almost up to the day of closing. The earnest money
was originally submitted by check on February 10, 2017. The house we were purchasing was not
expected to be fully built and available for move-in until July 2017.
An attempt was made on three separate occasions to resolve the dispute. On March 6, 2017, I emailed
a response to *** earlier e-mail, dated February 19, 2017, where she acknowledged our
withdrawal and advised the earnest money would not be returned to us. In the March 6
th
email, I
reminded Ms. of her earlier agreement to return the earnest money in its entirety should we
back out for any reason. I additionally expressed my hope that this could be amicably settled informally.
There was not any response from Ms. to this email.
The second attempt to settle the dispute was made at some point in May 2017. I met with Ms.
at the LGI Sales office just off of Marana Road. Once again, I made the request that the earnest money
be returned to us in keeping with what she promised on February 10th in the presence of both ***
*** (i.e. significant other) and myself. She claimed that the earnest money would have been given back
only in the event we decided to purchase a Tucson home we had made an offer on prior to the LGI
home. However she indicated that our discovery of another home in Marana subsequent to the LGI
home was not considered appropriate for a reimbursement of the earnest money.
The third attempt was done more recently with Mr. *** (XXX-XXX-XXXX), Vice President of
Sales for LGI Homes. He expressed some concerns for what Ms. had told us. He requested that
he have a little time to talk more in depth with Ms. to sort out just what had transpired. He
called back once more indicating a need for another extension, and since then has not made any further
contact. It has been over a week now.
