Revdex.com:
I have reviewed the response made by the business in reference to my concern, and find that this resolution is not satisfactory to me however, I did not personally hand the change of address to Ms. [redacted] due to the office hours being closed therefore, I cannot prove what she did with the actual paperwork.  I also believe that I filled out the change of address within the packet that I should have turned it two weeks prior which in her eyes would be the wrong form.  It is unfortunate that Ms. [redacted] has no integrity and is unorganized.  I am sure somewhere down the line, this will effect her or her business.  I appreciate you taking the time to mediate this unfortunate for me, situation.By the way, the two documents in the mail were from the HOA of the townhouse I rented.   Thank you,[redacted]

Review: I rented an apartment managed by LGL Properties and vacated on July 16, 2016. Within my exit paperwork, I included a forwarding address to LGL Properties along with returning my house key and mail box key within an envelope in a drop box due to the business hours and company being closed. I have reached out to [redacted] regarding my itemized statement along with the return on my deposit and lack of receiving either via email on several occasions. Ms. [redacted] claims that no such change of address was submitted and the paperwork was mailed to the old address which I returned the mail key to. She stated I should wait for the post office to forward the mail however, I did not submit a forwarding address with the post office. Pursuant to CA. [redacted], LGL Properties is required to either return my deposit in full or provided an itemized statement listing any amounts LGL Properties has withheld and return a refund within 21 business days. Neither has happened.Desired Settlement: I would like the return of my deposit sent to the forwarding address immediately.

Response:

Ms. [redacted] did not provide us with a forwarding address. We sent Ms. [redacted] the appropriate notification prior to her move out advising her of her right to a "Pre-move Out inspection". The Premove out inspection notice, asks the tenant for a forwarding address. Ms. [redacted] did not accept our notice of premove inspection, she did not return the paperwork to us, and she did not give us any forwarding address. She returned the apartment keys and mailbox key and gate remote. There was no paperwork included in the envelope indicating any forwarding address. Ms. [redacted] contacted by email, on or about Monday, August 8, 2016, asking if we had mailed her deposit and itemization of deductions to the address she gave us in Stockton. Her email indicated she had a new mailing address on Rush River, Sacramento. I advised Ms. [redacted] we had mailed her paperwork on Friday, Aguust 5, 2016, which was within the 21 day time period. I also advised her, if possible, I would ask my Assistant to help with this matter. My assistant advised me the paperwork was indeed mailed on August 5, and that it was mailed to the property address because we had no forwarding address for the tenant. We have searched our records for same. There is no email, personal letter, no fax, and no returned premove out documentation received from the tenant, indicating any forwarding address for her. Since Ms. [redacted] also failed to provide the post office with a forwarding address, we have no alternative but to wait for the mail to be returned to us. Our checks are void after 90 days; if the check is uncashed within this time frame we will issue a new check for the refund. I intended to email Ms. [redacted] this morning, as she sent me another email asking about this matter; advising her the property locks have been rekeyed, including the mailbox. I will go to the property and check the mailbox with the hope our disposition letter is there. If it is, I will retrieve it and forward to her at the most recent address she has given us, on Rush River Drive. If it is not there, I will advise Ms. [redacted] by email. We have complied with the civil code procedures, regarding the disposition of the security deposit. We are sorry that Ms. [redacted] believes differently. Hopefully this matter will be resolved in a timely manner to all parties satisfaction. L. [redacted], Broker GRI LGL Properties

Response:

I have responded to Ms. [redacted] email notices without delay. She is being untruthful to state otherwise.I personally went to the property today and checked the mailbox. There were several letters of correspondence stuffed in the mailbox. 3 envelopes for her, including our letter; other envelopes were for someone named [redacted]. We don't know who [redacted] is and she is not listed on our records as being a current or former tenant at the property. If Ms. [redacted] was living at the property, it was in direct violation to our rental agreement, and was without our knowledge or approval. I have advised Ms. [redacted] that our disposition envelope was found in the mailbox today and we are forwarding same to her with our outgoing mail today. The fact that Ms. [redacted] contacted the Revdex.com has nothing to do with my following up with her to try to settle this matter. I must repeat, that at no time did Ms. [redacted] give us a forwarding address. She also did not give the Post Office a forwarding address. We mailed all our correspondence to her at her last known address in the time frame required by the Civil Code. This matter should now be closed. L. [redacted], Broker GRI LGL Properties
