We have reviewed the response made by the business in reference to complaint ID# ***, and have determined that my complaint has NOT been resolved because:
Following is our reply and corrections to assertions made by George M*** in the message of Exotic Classics we received on June *, 2016.We have photos provided by Exotic Classics (taken after our inspection and after the purchase but prior to delivery) in which the top rail of the convertible frame is clearly bent; one of the photos has an individual we believe to be George M*** sitting in the car next to the unmistakably bent rail. The photos were taken at Exotic Classics’ facility and are dated after our purchase but prior to the piby the transporter. The transportation company also provided photos taken at Exotic Classics prior to the handling or loading of the car in which the top frame is obviously bent We have confirmed with the transportation company that the car was damaged before they loaded it As described below, we have documented proof that -0- miles were put on the car between the time the car was picked up by the transporter at Exotic Classics and we received the car. We also have written confirmation from Ferrari Long Island that the top was not bent, the door was functioning and the shells were in place at the time of our inspectionThe top never functioned when we received the car and an independent Ferrari mechanic has confirmed the substantial damage, the feeble attempts of Exotic Classics to hide/repair the damage and all facts contained in our correspondence to the Revdex.com and to Exotic Classics. For example, Craig B*** assured us that Exotic Classics had replaced and adjusted some micro sensors in the power top; the local Ferrari mechanic confirmed that the micro sensors were not new and that several were not capable of functioning because the severe damage to the bracket/hinge mechanism prevented their operation. Craig B*** agreed that the car would be sold with a working top and Exotic Classics warranted its operation to us. We specifically conditioned the acceptance by Exotic Classics of the purchase funds in our escrow closing letter in which Exotic Classics warranted the proper operation of the top and a warranty that the car was in the condition as existing at the time of the inspection. As shown by the repair estimates, repair of the convertible top on this type of car is extremely expensive and we took great care to assure that we received a car with a properly functioning top; unfortunately our reliance on Exotic Classics was misguided. We also understand that the car is covered by the New York Used Car Lemon Law.Although not relevant to the Revdex.com complaint but to be very clear, we never made or discussed a claim against the transport company because it was obvious that the car was damaged before the transporter received the car; accordingly, since no claim was made no claim was ever denied. We are not sure of the reasons for these contentions by George M*** or his assertion that we provided this information because it is false. Please feel free to contact the transport agent by calling *** (cell ***, business ***) to confirm. It is our understanding that the transport agent conducted an investigation and arrived at the same conclusion as did we.The response by George M*** you received certainly reflects issues which were not included in our complaint with the Revdex.com; we did not include all of the many problems we have encountered with Exotic Classics but focused on the issues we felt were most important. The car arrived with the exact mileage shown on the transportation company Bill of Lading, which was signed by Craig B*** of Exotic Classics, and reflected the mileage at the time the car left the possession of Exotic Classics. There was a discrepancy between the mileage shown on the Retail Certificate of Sale completed by Exotic Classics at the time of the sale and the Bill of Lading, which evidences use of the car while in the sole possession of Exotic Classics after it was purchased but prior to being picked up by the transport. The transport driver told us the car was dirty when he loaded it onto his enclosed transport. We were informed that the car was the last car on and the first car off of the transporter and that it had not been touched subsequent to being loaded at Exotic Classics’ facility We have compiled quite a list of defects and misrepresentations with respect to the car but need not complicate our Revdex.com complaint with these items; as stated above, we are now subject to extraordinary expenses because of the convertible issues which we tried to avoid.All amounts claimed were amounts actually expended or for which repair commitments are outstanding. We received several bids on all required work and have only accepted or asserted the lowest bids. For example, rather than utilizing the $3,brackets for the top, we purchased salvage parts for $1,800; we found a top supplier charging $5,installed rather than pursuing the Ferrari dealer top which is $13,plus labor. Following is our reply to the message of Exotic Classics we received on June **, 2016.Again, the photos provided by Exotic Classics and the transport company unequivocally show that the car was damaged while in the sole possession of Exotic Classics and the Ferrari mechanic confirmed that Exotic Classics did not adjust/maintain the top as they represented, that it had been damaged and was not operational as warranted. The reply of Exotic Classics is correct only in asserting that we made many attempts to amicably settle this matter with Exotic Classics and carefully considered the Revdex.com complaint prior to filing. As stated in our complaint, we will agree to drop the complaint if we are compensated for a portion of the costs resulting from the actions of Exotic Classics; our reason for filing the complaint being that Exotic Classics damaged the car, did not honor its warranty and misrepresented the condition of the car. We are being very generous by seeking only $2,for our loss of over $11,500.We are puzzled by the “OUR ELSE” (sic) language in the note from Exotic Classics. Obviously Exotic Classics is accusing us of making some sort of threat; we do not discern any hostility in our attempt to be compensated for the wrongful actions of Exotic Classics. Again, we are seeking partial compensation to cover our loss.

I am responding to *** *** complaint. The title shows being delivered by *** on 12/**/at 6:pm. We overnighted this on Friday December ***. The lien release shows being delivered on 12/**/at 6:pm. We also overnighted this on Monday December ***. *** Auto Finance had electronically filed a lien release with NYS Deptof Motor Vehicles. This was rejected byMissouri's Motor Vehicle Dept. We immediately got in touch with *** to get a paper copy of the lien release.They told us that it would take days . We did e-mail *** *** a copy of NYS DMV title update showing thatthere were no liens. We were hoping that their motor vehicle department would accept that while we werewaiting for the paper lien release.I feel that we took the proper steps immediately to handle this concern

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me. The original paperwork was grossly mishandled by Exotic Classics and their responsiveness was the worst I've seen yet I'm happy to at last have all the correct and completed paperwork. It's unfortunate they have not offered to compensate us for having to send incorrect paperwork back or for fees associated (while nominal) with having to title the car after the expiration of the temporary tag due to the title not having any signatures to make it a legitimate legal sale document. They did the minimum required to get this transaction resolved and only when we were frustrated stepped up to keep us better informed about what they were doing with the resolution and timing.

We sold the [redacted] A 2002 360 Ferrari, we provided the customer with photos and video of the convertible top working, when the vehicle was purchased it was sold as is with no warranty. the customer had his own pre-purchase inspection done by Ferrari of Long Island and the convertible top was...

working as designed. the customer hired his own transportation company to pick up and deliver the car to him when the car left my Facility the top was working when he received the car the top was bent and not functioning the transportation company that he hired damaged the car I spoke with the customer over a month ago he was putting in a claim with the car carrier for damages. he called me 2 weeks ago saying that the claim was denied and looking for my company to pay for the damages our he will take legal action against us. I told him again that we did not hire the company to transport the car he did and it left our facility working. the customer even noted in his Revdex.com complaint that the there was no damage when we had the car. all the under body shells were in place when the vehicle left our location the customer also fails to note in his report that when he received the car it was covered in mud and had more miles on it witch in my opinion is that the transportation company drove and damage his vehicle the transportation company that he hired will not reimburse him for damages so he is trying to threatening exotic classics with legal action unless we pay him so money back. we owed him extra keys for the car witch we had no problem paying him for. if exotic classics hired the transportation company and they refused to pay for damages we would absolute reimburse our customer to make him happy but we did not hire the transportation company [redacted] did. thank you for your time if you have any questions please feel free to call me at [redacted] **

If Exotic Classics hired the transport company to ship a car and they damaged it and if they refused to pay for the repairs as a good will gesture we would pay for the repairs. But in this case we did not hire the transport company the customer hired his owen, in the purchase agreement it does state the vehicle is being sold as is. The top was working when it left my location, and there was not any bent convertible top pieces. This customer has been posting all over the internet bad reviews.

First thing Friday morning (Dec [redacted]) the business emailed me claiming they would be overnighting the title document. Monday mid-day and still have no copy of the title. Also - the business claimed they submitted the lien release from [redacted] Dec [redacted] to me via email. If it takes 7 days to mail it they should already have it as it's been 10 business days (going on 11) since the request was made.

Good morning.  The original customer had lost his title and we applied for a duplicate.He then found the original and brought it in to us signed.  We should have sent that title to [redacted]. [redacted] was paid off in August for the loan on this vehicle.  They electronically filed...

the lien release whichshows up with NYS Motor Vehicle Dept.  Upon hearing that Missouri title department would not acceptthe electronic lien release, we immediately called [redacted] Auto Finance.  They stated that they wouldmail out a hard copy but it would take 7 days.We issued [redacted] originally an in-transit permit that is valid for 30 days.   Sincerely, Barbara G[redacted]Office ManagerExotic Classics LLC
