Review: Liberty Auto Sales ([redacted]) led me to believe financing had been approved for a 2002 [redacted]. On Tuesday, August 20, I returned the vehicle to have a myriad of repairs done only to be told that I, in fact, DID NOT qualify for financing. I paid a $500 partial installment for the down payment. Liberty alleges I falsified my employment with the City of Fredericksburg School system. I was still an employee of the school system, however, was out on leave due to injuries sustained on the job on February 28 & May 4. A Worker's Comp claim has been filed. The overall tone of the business has changed since [redacted] & her husband no longer work there. As soon as you walk in the door, [redacted] ambushes you saying he's the owner. I knew that wasn't true because [redacted], who is still there, was the [redacted] when I purchased my 2004 [redacted] 3 yrs ago. [redacted] lured my in-laws away from a dealership next door alleging he could get the same car for thousands less and even has a separate business card advertising himself as a "Car Finder". [redacted] & [redacted] violated the privacy act and disclosed ALL OF MY FINANCIAL BUSINESS to another customer that texted me verbatim what they said. I listed [redacted] as a reference for "contact purposes" only not to be told that the finance company called the school and was advised I didn't work there anymore. [redacted] dialed my number early one Saturday and with no greeting asked "did you get your down payment together?" I responded "[redacted] you may have dialed my number because of a note on his application that I referred him, however, you have dialed the wrong number. I could hear him screaming at Melissa "you gave me the wrong [redacted] paperwork". When I shared this incident with a friend that is also a Liberty customer, she laughed and said she was actually sitting in the office when that happened. She added that [redacted] even threw the papers at [redacted]. They are deceitful--I initially asked where did [redacted] & her husband move to, I'm sure to keep a sale, they all lied and said they didn't know. When in fact, [redacted] has had regular communication with[redacted]. Their operation lacks professionalism and integrity. I honestly feel they are toying with financing because of the repairs needed. I took the vehicle to a reputable repair shop, Strickly Business, [redacted], to be checked over. [redacted] even discouraged me from doing so by insisting they do a thorough check before the vehicle is delivered. It's even a concern about the legitimacy of the inspection sticker since items that were checked OK ARE NOT--the passenger side mirror DOES NOT work, stuck in the down position; passenger side 2nd row door seatbelt DOES NOT fasten; CD changer DOES NOT WORK, continually reads CD error & 6-disc changer box could not be located in the vehicle; brakes & rotors were needed all around; headlights weren't positioned correctly; message center continually reads DOOR AJAR even after all doors including the hatch are slammed; upon delivery message center read OIL CHANGE REQUIRED, and weekly LOW OIL LEVEL so I was weekly adding a quart of oil; ALL FLUIDS WERE AT EXTREMELY LOW LEVELS, I had to buy antifreeze and windshield washer fluid.Desired Settlement: I would #1 like a refund of the $500 partial desposit paid. LIBERTY terminated the contract, NOT [redacted], citing financing could not be obtained. I have bought condos and houses and all contractual agreements refund the Earnest Money Deposit (EMD) if financing isn't obtained. I should not be held financially liable for their negligence in allowing me to have possession of the vehicle for 3 weeks; and #2 I would like to have the credit inquiries to my credit report concerning this failed transaction to be removed.

[redacted],

In reference to this customer when she filled out her credit application for the bank she was not truthful in her statements in regards to her employment situation. Stating that she worked for a business that she was no longer employed with and was actually on unemployment. This is not a situation that banks will fund upon. When the bank called to verify her employment status and was made aware of the inconsistency on her application they at that point sent her information back to our dealership. They had every right to press charges as this is illegal to lie on a credit application. At this point we could not get the customer funded. This is not personal, but it is illegal to lie on a credit application. We wish the customer the best, but we could no longer assist her in getting a vehicle.

Review: I purchased two vehicles from this location. One had a myriad of mechanical issues, but the seller did resolve most of them. The major issue that I have is that it has been almost two months and I have yet to receive either the title for the vehicle and the registered plates that I paid for. I have left numerous email and phone messages with them, and have yet to receive ANY response. I was told after the first thirty days that there was "a problem with the [redacted] that didn't allow us to get your plates within that time". They issued me another set of 30 day plates and said it would only be a couple more days. That was the last I heard from them almost 20 days ago. Legally, they are only allowed to extend a temporary 30 day tag once after the initial, ( I am a Police Officer, so I deal with this regularly) so in 10 days, I will be unable to use my vehicles any more and cannot register them with the title transfer. I do not understand why they have not been in touch. When I was purchasing the vehicle they were all over me, now they have disappeared.Desired Settlement: I want both of my cars registered and the title issued immediately. If I need to contact an attorney, and/or take this to further litigation, I will. It seems it would be so much easier for everyone to just provide me with either an explanation of any kind, and the status of my plates. I have NEVER had this much trouble with any company in my life. Its as if they think I'm just going to go away. This is my last opportunity to allow for a resolve before I start a claim with the county clerk.

I spoke with the company and they stated that for the one vehicle everything has been received and for the other vehicle everything should be ready either at the end of this week or middle of next week.

Review: Please find the following facts outlined below: -On April, 12, 2013, a [redacted] was purchased at Liberty Auto Sales, LLC, located in Fredericksburg, Virginia. - On May, 10, 2013, a phone call was made to Liberty Auto Sales employee, [redacted]. After receiving an estimate on the vehicle in question, it was found that repairs were necessary. [redacted] assured me that the warranty on the vehicle would be honored. The written warranty on this vehicle covers 50% of labor and parts on moving parts. [redacted] was asked how much I could expect to pay, but she reassured me that repairs would be made for free as a courtesy. The vehicle subsequently failed to pass Delaware Motor Vehicle Inspection because of engine and exhaust system issues. [redacted] requested that I get an additional estimate so that she could determine what course of action was best. - On May 31, 2013, two auto repair estimates were faxed to Liberty Auto Sales. [redacted] informed me that the repair costs were too high, and that it would be best to transport the vehicle back to Liberty Auto Sales. - On June 4, 2013, the vehicle in question was brought to Liberty Auto Sales. While repairs were being made a loaner vehicle was supplied. Originally, I was told that it would take one week for all necessary repairs to be made. I was then informed that it would take an additional week for the vehicle to be repaired. - On June 12, 2013, I was informed that the vehicle had been serviced and was ready to be picked up. Approximately 48 hours after the vehicle was driven back to Delaware, the check engine light came on. After taking the vehicle to [redacted] Auto Repair, in Dover, Delaware, I was informed that there were issues with the cooling fans in the engine as well as the exhaust system. Another phone call was made to [redacted] of Liberty Auto Sales, informing her that the same issues with the vehicle existed. It was at this point that [redacted] of Liberty Auto Sales began to intervene. He assured me that the vehicle would repaired free of charge. He agreed to have the vehicle towed back to Liberty Auto Sales so that it could be serviced again. Repeated phone calls were made to Liberty Auto Sales to see when vehicle repairs could be scheduled. This is when [redacted] began backpedaling. He asked for estimates again, then he proposed that he could find less expensive parts. When asked about the status of the tow, he stated that it would be too costly. As of July 12, 2013, the temporary tags on the vehicle in question were set to expire. [redacted] asked that I take the car through inspection again so that he could see what issues remained. The vehicle failed to pass Delaware Motor Vehicle Inspection for a second time. Over the next few weeks, [redacted] became increasingly difficult to get a hold of. [redacted] began acting as the intermediary once more. I was told on numerous occasions that [redacted] was working on locating reasonably priced parts. - On August, 1, 2013, [redacted] agreed to have the vehicle in question repaired at [redacted] Auto Repair, Dover, Delaware, at his expense. - On August 2, 2013, the vehicle was dropped off at [redacted] Auto Repair. The [redacted] of the establishment spoke to [redacted] at length and agreed to the arrangement.. While [redacted] Auto Repair prepared another car repair estimate, I remained in contact with [redacted]. I informed him that the vehicle's tags were set to expire on August 8, 2013. After that date, the vehicle would no longer be legally operable. [redacted] was adamant that there would be no further delays. - On August 7, 2013, [redacted] again changed the terms of our agreement. In his opinion, the estimate prepared by [redacted] Auto Repair was too high. He stated that he just needed more time to order used cooling fans to put in the engine. When asked for an approximate time frame, he stated that it would take three to five business days. [redacted] again became difficult to speak to over the phone. Most days, [redacted] assured me that the parts were on their way. For whatever reason, they were sent Liberty Auto Sales in Fredericksburg, Virginia, rather than directly to [redacted] Auto Repair. During this period of time, representatives for [redacted] Auto Repair became increasingly agitated because of the continued delays. - On August 26, 2013, the cooling fans finally arrived at [redacted] Auto Repair. The fans were installed. A remaining balance of $240 remains. Both [redacted] and [redacted] assured me that they would be paying the balance over the phone. Dozens of calls were made to Liberty Auto Sales, all resulting in more excuses and delays. - On August 29, 2013, [redacted] promised that payment would be remitted by Liberty Auto Sales the next morning. - On August 30, 2013, a phone call was made to [redacted] of Liberty Auto Sales to see if the bill had been paid. She informed me that [redacted] was not yet in the office, but that he would be coming in shortly. At 3:30PM, another call was made to check payment status. Again, I was notified that things were 'hectic.' Subsequent phone calls yielded similar results. It was on this date that [redacted] Auto Repair washed their hands of this proverbial circus act. They informed me that my vehicle needed to be removed or storage fees would start to be added on. I also made [redacted] aware of this fact. To date, the $240 bill remains despite numerous verbal promises made by Liberty Auto Sales and its representatives. - Since being informed on May, 10, 2013, of the issues my vehicle has experienced, Liberty Auto Sales has taken insufficient action. Four almost four months, repairs have been put off. - Liberty Auto Sales, LLC, has illegally disregarded the [redacted] Regulation Rule Concerning the Sale of Used Vehicles, [redacted] - Liberty Auto Sales, LLC, has failed to comply with the Uniform Commercial Code, by supplying a vehicle that is and remains unfit for safe transport. - Liberty Auto Sales, LLC, has disregarded the [redacted] by purposefully delaying repairs and making oral promises that directly conflicted with the warranty that was supplied in writing. - Actions made by Liberty Auto Sales have resulted in unnecessary costs and hardship. Their reprehensible business practices have damaged my relationship with my preferred mechanic at [redacted] Auto Repair. - Liberty Auto Sales has gone back on nearly every promise made. I was completely willing and able to pay 50% of the repairs covered under the written warranty, but they offered to 'take care of everything' themselves. Please note that these services were made at their suggestion, not mine. - [redacted] asked on numerous occasions if it was possible to register the car before repairs were made. Because the vehicle is being financed by an outside lender, the car must be registered with the lien holder before [redacted] at Liberty Auto Sales will be paid. I believe that [redacted] is purposefully delaying repairs in order to get out of having to honor the warranty a well as the verbal promises he and his representatives made. - I authorized [redacted] to communicate on my behalf with Liberty Auto Sales. She has helped me attain auto repair estimates as well with transporting the vehicle back and forth to Virginia. This information should be on file at Liberty Auto Sales. Should proof of my claims be necessary, accurate documentation can be supplied.Desired Settlement: Remit payment to[redacted] Auto Repair, located in Dover, Delaware, in the amount of $240.

Revdex.com Case # [redacted]

In case [redacted] we are not required to guarantee emissions tests. When we made the first appointment for the vehicle we fixed the car free of charge and gave her a loaner car in the interim as a courtesy as this problem was not covered under our 50% -50% warranty. When the purchased vehicle was driven back to the state of Delaware we were made aware of a problem with the exhaust fan (which is not covered in warranty) we did agree to buy the part, have it shipped to us (as this is the only way it could be shipped) because they would only send it to the address on the credit card provided. We then spoke to the customer and gave her the tracking number on said part [redacted] when it arrived in our store it was sent directly to her mechanic, in both cases we paid for shipping and provided shipping information to the customer.

After said vehicle was fixed by the customer's mechanic, we then received a phone call that we were to pay the bill at Tony's Auto Repair. We hold a 50%-50% warranty in house [redacted] and it does not cover an exhaust fan, we still tried to go the extra mile by ordering the part and shipping it paid for by our company. We have made every attempt to make this customer happy and to assist in this issue that is out of the state of Virginia, where the car was purchased.

If you should have further questions please contact the office and we will be happy to assist.

Best regards,

Response:

I have reviewed the response in reference to complaint ID [redacted], and have determined that there is no proposed action, but instead an inadequate explanation of the company's actions. Thus, their lack of transparency will not resolve my complaint. For your reference, details of the offer I reviewed appear below.

Please find the following facts outlined below:

1. Liberty Auto Sales continues to lie and misrepresent the facts. Their response failed to address many of the facts that I outlined. Please note that their reply contained no concrete dates, noted few conversations, listed no names and also fails to address the verbal promises made by both [redacted] and [redacted]. In fact, [redacted] of Liberty Auto Sales, LLC, submitted this blatant lie in writing. Liberty Auto Sales claims that none of the issues that I have with my car are covered under warranty, and that their representatives did not make multiple verbally binding agreements with me. Their claim is that they only ordered parts, had me drive the car to Virginia, supplied me with a loaner vehicle, had me obtain and fax repair estimates and DE [redacted] Inspection failure printouts so that they could perform 'courtesy' repairs. This explanation defies logic.

2. There are four people that can attest to the verbal contract that [redacted] and [redacted] of Liberty Auto Sales, LLC, made and I will provide notarized affidavits if necessary.

3. The vehicle in question first failed Delaware Motor Vehicle Inspection on 5/10 because of faulty cooling fans in the engine and issues with the exhaust system [redacted] This completely contradicts what [redacted] of Liberty Auto Sales, LLC, says in her Revdex.com complaint reply. She claims that the vehicle was only slated for 'courtesy' exhaust system issue repairs and that she was not aware of any cooling fan issues when it was repaired in early June. This is a lie.

4. On 5/31 and 6/5, two faxes were sent to [redacted] of Liberty Auto Sales (please see supporting documentation). These faxes contained both the failed Delaware Motor Vehicle Inspections report as well as two estimates repair estimates(please see attached estimates). Please look at the dates that these estimates were made on. Also note the dates on the fax transmission forms. How could [redacted] not have been aware of issues with the engine cooling fans? All of this documentation supports the fact that representatives for Liberty Auto Sales, LLC, are supplying false information in an attempt to have this complaint closed in their favor.

5. The repairs in question pertained to the cooling fans, which are located in the engine as well as the exhaust system. The cooling fans are covered under the 50/50 warranty [redacted]. Please note that they keep referring to the repairs as 'exhaust fans,' and 'emissions issues.' I believe that they are doing this to try and confuse the Revdex.com about what is and is not covered under warranty. There is no arguing the fact that the engine cooling fans are a part of the engine. They are, in fact, moving parts that are covered the warranty.

7. Please note the date on the invoice that Liberty Auto Sales conveniently included. It has an order date of 8/14. There is also no delivery date on their invoice. The vehicle in question had already been at [redacted] Auto Repair for 2 weeks by the time they even bothered to order the parts. [redacted] spoke to the owner of [redacted] Auto Repair and agreed to pay for servicing. These conversations took place on 8/1 and 8/2. I have phone records and other proof to substantiate my claims.

8. Liberty Auto Sales, LLC, did not provide timely repairs. Since 5/10, I have attempted to get them to honor their warranty and verbal promises. Liberty Auto Sales, LLC, did not properly service the car in June, when it was driven from Delaware to Virginia. It took them from June until August to even send parts. Auto dealers are not permitted to deliberately delay repairs, but that is what Liberty Auto Sales, LLC, is doing.

9. The vehicle in question was driven to Fredericksburg, VA, at my expense because Liberty Auto Sales, LLC, promised to fix these issues. All they did was reset the codes on the vehicle. No actual repairs were made. I have two failed Delaware Motor Vehicle Inspection reports to back up this statement. Liberty Auto Sales, LLC, has provided no factual rebuttal.

10. Liberty Auto Sales, LLC, has already been caught in numerous lies. First, they did know that the car's cooling fans, located in the engine, needed to be replaced when it was originally serviced in June. I believe that they failed to replace the cooling fans, as is required under their warranty, because they did not want to incur the expense. Now, they are lying and claiming that they did not promise to pay $240 to [redacted] Auto Repair.

11. In their rebuttal, Liberty Auto Sales, LLC, fails to address the [redacted] Trade Regulation Rule Concerning the Sale of Used Vehicles, [redacted]. This is because they are plainly in violation of this federal regulation.

12. Liberty Auto Sales, LLC, also failed to address the fact that they are not in compliance with the Uniform Commercial Code. Vehicles with serious emissions issues and faulty engine parts are not safe for transport. Their reply did not even touch on this fact.

13. Their response does not address the fact that they have violated the [redacted] because they did purposefully delay repairs covered under warranty.

14. While the main issue I have with Liberty Auto Sales, LLC, refers to their unwillingness to honor their own in-house warranty, it should also be noted that oral contracts are binding in the state of Virginia. For Liberty Auto Sale, LLC's representatives to blatantly lie about this dispute shows their lack of integrity and character.

15. Their past actions were negligent, but their false statements now firmly imply breech of warranty and failure to honor a verbal agreement. I await their next response, which will hopefully address the facts outlined above rather than attempt to downplay my fully substantiated claims.

16. Only a payment in the amount of $240 for the full price of repairs will favorably satisfy my complaint.

Regards,

Business

[redacted],

As we discussed this morning, [redacted] wrote a check to [redacted] in the amount of [redacted] to satisfy any outstanding fees associated with this account. I believe that this check should have cleared any monies owed to this case in full. If there are any additional questions please contact myself via email or telephone.

Response:

I have reviewed the reply made by the business in reference to complaint ID [redacted], and have determined that, once again, there is no proposed action. Therefore, my complaint remains unresolved. For your reference, details of the offer I reviewed appear below.

Liberty Auto Sales, LLC, did indeed remit a check in the amount of $[redacted], but it was in regard to a different matter. As ordered by the [redacted] returned $251.83 in sales tax, title and registration fees. Please contact [redacted] at the [redacted] at [redacted] or [redacted] for confirmation of these facts.

As such, my complaint still stands. No further action has been taken by Liberty Auto Sales, LLC, in regards to my complaint, and I am still out of $240 in repair costs that [redacted] promised to pay [redacted] Auto Repair.

Regards,

Review: I bought a [redacted] from Liberty Auto Sales in October 2012. I was guaranteed that the car was in good condition. Not to long after driving the car back and forth to work, the car started to have problems. The car would rev up, make a loud noise, the check engine light came on, and occasionally turn completely off while driving. I called the dealership and explained to them the problem and they told me to bring the car to them so that they can fix the problem. When I got there they looked at the car and told me nothing was wrong with it. When I told them that the car turned off on me 3 times on the way there they looked at the car again and noticed that my transmission mount was broken and that they needed to order a new one but in the mean time would fix the broken one. I took the car home and the problem stopped for a short while. When I took the car back to get the new transmission mount, I told them that the car was still having the same problem. I left the car at the dealership so that they could fix the car. The dealership gave me a loaner car which needed to be jumped every time I drove it. After a couple days I got my car back and it drove good for awhile. When the problem started again I called the dealership and told them that the original problem continued and they told me the car was out of warranty. I took the car to a [redacted] dealership to be diagnosed and they told me that I needed a new transmission. The [redacted] dealership told me that the transmission had been in bad condition for a long time because they could see the wear and tear on it. They told me that the car was a lemon. I contacted Liberty Auto and told the office manager about the diagnosis and she told me that the owner was not in the office and they had to wait until he came back to solve the problem. I called Liberty for weeks to get the problem resolved and each time I was told the owner was not there.Desired Settlement: I would like to trade the current car for another car with another 90-day dealership warranty.

Response:

Dear [redacted],

This letter is a written response to the complaint made by our customer. The customer made the purchase of a [redacted] on 10/31/2013. She signed our standard 50/50 warranty which states that the customer is responsible for 50% of parts and 50% of labor required to install any parts. About one month after the purchase a problem occurred that caused the engine to rev up and down. We diagnosed the problem and installed an Oxygen Sensor in the vehicle and did not charge the customer for the part or the labor; this solved the revving up and down problem. Approximately two weeks later on November 28th we installed a new transmission mount. We gave the customer a loaner car for the six day period at "no charge" while corrected and installed the mount. We tested the car after the mechanics work, the mechanics drove the vehicle and stated that the engine and transmission worked properly. There was no stalling or hesitation. Approximately four months after the repairs the customer called our dealership and the customer diagnosed that the transmission was defective; however the customer provided absolutely no proof. There was no transmission analysis documentation provided to our dealership from the [redacted] dealership whom alleged the defection of the transmission. In any case, we complied with our written 90 day warranty and actually did not charge the customer for parts or work completed.

Respectfully submitted,

Review: On 4/26/13 I purchased a 2006 Ford F250 Superduty XLT, 6.0 Liter diesel 4x4 truck from Liberty Auto Sales. I had originally told the finance manager / office manager Melissa Davis that I would be putting down $4000.00 as a down payment. Melissa called to advise me that the vehicle was ready for me to come and look at, and sign paperwork. She also advised that I would need to put $5000.00 down instead of the $4000.00 I was expecting to put down. I was also told that even though I am putting the money down and signing the paperwork, that I would not be able to drive the vehicle home this day, as it would not be ready for me to take home until the following day 4/27/13. This was somewhat strange to me as every vehicle I have ever bought, new or used, I took possession of the vehicle the day papers were signed and money exchanged. I went to the bank, got the $5000.00 in cash and went to Liberty Auto Sales. Upon arriving at the dealership, I asked if I could test drive the vehicle and I was told by Melissa that I couldnt do a test drive because the vehicle was being detailed, and she also stated it didnt much matter since the vehicle was bought exclusively for me by the owner of the dealership Edwin at the auto auction. She then had me come into the office to proceed with signing the paperwork and taking my down payment money of $5000.00. At the advice of the finance manager / office manager "Melissa Davis" I also purchased the extended warranty through AUL for $1,100.00 which was included in the total financing of the truck for $14,849.99. I was then instructed to return to the dealership the next day 4/27/13 to pick up the vehicle.I picked up the vehicle the next day on Sat 4/27/13. When driving away from the dealership I noticed the steering was very loose. I thought it may be just the way the truck was. I dealt with this for 3 days and concluded that this was not normal and extremely dangerous. I then asked a mechanic friend of mine what he thought the issue with the steering may be. He stated it sounded like the steering box, stabilizer bar, and possibly the gear box. On Monday 4/29/13, I called the dealership and advised Melissa of the issue and she then advised Edwin her boss. Melissa stated that Edwin said bring the vehicle on down to the dealership and they would take a look at it and get it fixed. I took the truck to the dealership that afternoon on Monday 4/29/13. The vehicle was ready to be picked up after the repairs were done on Thursday 5/2/13. I picked the vehicle up on 5/2/13. No more than 1 mile from the dealership I called Melissa at the dealership to advise her that their mechanic had not straightened the steering wheel; the steering wheel was cocked approximately a turn off of being centered and correct. At that time I told Melissa I didnt have much faith in their mechanics since after over 2 full days of them fixing the steering issue they couldnt even get the steering wheel straightened correctly and obviously didnt even test drive the vehicle. At that time Melissa advised me to take the truck to a repair shop of my choice and they Liberty Auto Sales would reimburse me for getting the steering wheel fixed. That same evening I was driving and the instrument panel was not lighting up the speedometer and other gauges were not being illuminated. I called Mellissa again on 5/3/13 to advise her of this new issue. She said once again to bring it on down to the dealership so they can take a look at it. I took the vehicle to the dealership on 5/3/13 and they replaced some instrument panel bulbs that were blown. Melissa noticed that I was being apprehensive with their mechanics touching the vehicle again; I stated that they couldnt even get the steering wheel straightened correctly, and now they are messing with the electrical. I told her that the truck seems to be having other issues possibly needing further repair, such as the truck becoming unbearable to drive due to it bucking like a wild horse. Knowing that I didnt have any faith in their mechanics, and the fact that they Liberty Auto Sales do not have a diesel mechanic, she Melissa once again told me to take the truck to a repair shop of my choice to be repaired. As instructed by the dealership in which I purchased the vehicle from "Liberty Auto Sales", I took the truck to a repair shop on 5/15/13. The repair shop "Digges Automotive" called the AUL warranty claims dept, advising them that I needed to have 6 or 7 out of the 8 diesel fuel injectors replaced. AUL stated that this was not covered under my warranty as they classify fuel injectors as electrical group. They denied my claim, and subsequently I had to pay out of my pocket $3,376.64 to have the repairs done. Melissa continued to tell me that AUL would pay for the repair even though the extended warranty which she sold me was the Essential not the Basic. The essential does not cover injectors but the basic does. Melissa kept insisting that AUL was wrong and she was going to force them to pay even though the paperwork clearly stated which AUL extended warranty package covered what types of repairs. After the injectors were replaced more issues with the engine arose, such as major white smoke, severe loss of power and hard starting. I once again called Melissa at Liberty Auto Sales. She said to have the repair shop call it in to AUL warranty to be covered. On 5/31/13 the repair shop called the repair into AUL warranty and they covered $2,500.00 of the $4,737.95 worth of repairs that were needed. The engine had a broken lifter, a bent push rod, a bad head gasket, and warped heads. As I previously stated AUL paid out the maximum of the extended warranty policy which was $2,500.00 for this repair / claim, and once again I had to pay out of my pocket an additional $2,000.00. I called Melissa at Liberty Auto Sales and advised her of the newest repair with the lifter, and heads and let her know that AUL picked up their maximum payout on the poliDesired Settlement: The repairs which were performed on my truck were authorized by Melissa Davis the finance / office manager at Liberty Auto Sales and 50% of the total cost out of my pocket needs to be paid back to me from Liberty Auto Sales. Total cost out of my pocket for these repairs has been $5,376.64 and 50% of that for which the dealer is responsible for, per the dealer warranty is $2,688.32. The dealership Liberty Auto Sales has been provided copies of the repair receipts, and I have also sent the dealership an invoice for their 50% reimbursement to me per the dealer warranty of $2,688.32. The Finance company Ace Motor Acceptance Corporation has been notified of all of this information. A copy of the repair receipts, and dealer warranty have also been provided to Ace per their request. The amount of money that had to come out of my pocket to make the truck drivable and safe has put a personal and financial hardship on me, and I expect the dealer to honor their limited warranty as explained above

The customer purchased a [redacted], vin#[redacted]. The customer was informed to pickup said vehicle on 4/27/13 we had to detail the truck; and fix a repair in the front seat, he agreed. In like manner, the customer, did purchase the extended warranty from [redacted] for $[redacted]. On or about 5/2/2013 we replaced (at no charge) to the customer the steering box. We informed the customer that we due not do alignment, that we would have to take the vehicle and have it aligned after the replacement of the steering box, we asked him to leave it for one more day, but the customer indicated he would get the alignment done himself at his expense. We do not have alignment equipment that is why we informed the customer to leave the car at Liberty Auto Sales for one more day so that we could have it aligned, but he said that he would have it done himself. There were no issues with the stabilizer bars.

In like manner, in reference on 5/3/13 we replaced several panel bulbs at (no charge) to the customer and this corrected that problem. In reference to the allegation from the customer that he paid $[redacted] to have repairs done to replace 7 out of the 8 diesel fuel injectors, we received no mechanical report from a repair shop to indicate that work needed to be done. The customer had a written warranty with [redacted] and on 5/31/2013 we were informed that the warranty only covers $[redacted] in repairs. At no time did the customer bring the car into Liberty Auto Sales complaining about interior engine problems as fuel injectors are not included in our 90 day warranty out warranty covers the "moving" parts of the engine. We also could not know what the problem was; as the customer did not allow us to inspect the alleged engine problem. Any and all repair claims were covered by the customer's [redacted] warranty, and were done by a repair facility of his choice as noted by the customer himself, and it's our understanding that these repairs were covered by his [redacted] warranty. The engine repairs were covered to the maximum allowed "$[redacted]" under the warranty that the customer agreed too.

This should answer the complaint of the customer. should you have any further question's please feel free to contact us by phone or letter.

Response:

I have reviewed the offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

First off I do not know who this [redacted] guy is, I never spoke with him and he had nothing to do with my purchase of this vehicle, or any of the major engines problems and other issues with this vehicle being discussed and outlined in my complaint. The fact that he is responding to my complaint is unacceptable to me. In regards to Liberty Auto Sales responses to my complaint, please see below: Yes, they did have the front seat repaired which was considerably ripped. They did and should have replaced the steering box on the truck, as the steering issue was present since day one of the vehicle purchase; it was a severe and dangerous issue where the truck would not steer properly. Liberty Auto sales used a used junk yard part to fix the issue. Not sure how the truck passed inspection with such a steering problem but it somehow did. The only reason a 4 wheel alignment was discussed was because the mechanic (doubt he is a certified mechanic) at Liberty Auto sales was unable to even properly straighten the steering wheel itself, he did something incorrect when installing the new steering box which made the steering wheel off to the point where the position of the steering wheel [redacted] logo was vertical instead of horizontal as the normal position would be. This steering wheel issue was fixed by [redacted] repair shop when they fixed all the other issues needing repaired. The owner of Liberty Auto Sales, [redacted] said he would pay for a 4 wheel alignment, I never stated I would pay for it. Why would I pay for something that their so called mechanic could not do correctly? As far as the instrument panel bulbs being replaced, yes they did replace the bulbs that were dead. My response to that would again be, how did my vehicle pass inspection with burnt out instrument panel bulbs? Lights and internal lighting are major issues checked by a service center performing the inspection. If the service center which did the inspection put an inspection sticker on the truck, they are responsible for the condition of that vehicle, in addition to the dealership that sold the vehicle. Due to that response from Liberty Auto Sales, I would now legally request to see the actual inspection paperwork from the service center which performed the inspection, as I feel that the service center just pushed the vehicle through the inspection process as a favor to the owner of Liberty Auto Sales, "[redacted]". Regarding the repair work done on replacing 7 out of 8 diesel fuel injectors, yes Liberty Auto Sales did receive a mechanical report from [redacted] repair shop, as [redacted] and [redacted] at Liberty Auto sales were actively pushing the issue with "[redacted]" the extended warranty company to cover the repair cost and replacement of the defective and faulty diesel fuel injectors. "[redacted]" would not cover the cost of the injectors, and [redacted] actively fought with [redacted] on this issue, and [redacted] has all of that communication on file by phone recording or phone call transcripts. With that said, [redacted] and [redacted] kept telling me that the injectors should be covered under the [redacted] extended warranty, as these were internal lubricated moving parts, so they felt that [redacted] should cover them, but they the dealer should not cover the repair cost. I disagree and expect Liberty Auto sales to make good on their warranty, and refund me my money for the repair cost, as you can't dispute something to the extended warranty company and then change your mind when the issues is now to be covered under the dealership warranty. As far as the statement from Liberty regarding me bringing the vehicle to Liberty Auto Sales to have the engine looked at, I spoke with [redacted] about my apprehension in doing so, since their mechanic is not a diesel certified mechanic, or even a certified mechanic at all as far as I am concerned. Their mechanic could not even put the steering wheel straight after replacing the steering box with a junk yard steering box; I sure didn't have much faith that they would be able to fix a diesel engine problem. All of the engine problems and my apprehension in the mechanical ability and knowledge of their mechanic were discussed with [redacted] at Liberty Auto sales prior to any of the work being performed and she assured me that what [redacted] the extended warranty company didn't cover, the dealership warranty would cover. Further explanation of this issue is listed below in the original in itial complaint from me to the Revdex.com.

After the injectors were replaced more issues with the engine arose, such as major white smoke, severe loss of power and hard starting. I once again called [redacted] at Liberty Auto Sales. She said to have the repair shop call it in to [redacted] warranty to be covered. On 5/31113 the repair shop called the repair into [redacted] warranty and they covered $2,500.00 of the $4,737.95 worth of repairs that were needed. The engine had a broken lifter, a bent push rod, a bad head gasket, and warped heads. As I previously stated [redacted] paid out the maximum of the extended warranty policy which was $2,500.00 for this repair I claim, and once again I had to pay out of my pocket an additional $2,000.00. I called [redacted] at Liberty Auto Sales and advised her of the newest repair with the lifter, and heads and let her know that [redacted] picked up their maximum payout on the policy of $2,500.00. I then mentioned to

her that per the Dealer limited warranty, Liberty Auto Sales would be responsible for 50% of the repairs which were not covered by the [redacted] warranty. She said she would talk to [redacted] the owner. I called a couple days later to check the status of Liberty Auto Sales reimbursing me for my out of pocket

expenses and [redacted] stated that [redacted] was going to make her pay out of her pocket ~ of the injector repair which total cost was $3,376.64. I then also mentioned to [redacted] that I expected the dealership to also pay for~ of the lifter, heads repair which total cost from my pocket was $2,000.00. The dealership limited warranty is good for 3 months or 3,000 miles whichever comes first. The dealer warranty states the dealer will pay 50% of labor and 50% of parts for the covered systems that fail during the warranty period (copy of dealer warranty available upon request) the truck is still well within the warranty period.

The repairs which were performed on my truck were authorized by "[redacted]" the finance I office manager at "Liberty Auto Sales" and 50% of the total cost out of my pocket needs to be paid back to me from "Liberty Auto Sales" . Total cost out of my pocket for these repairs has been $5,376.64 and 50% of that for which the dealer is responsible for, per the dealer warranty is $2,688.32. The dealership "Liberty Auto Sales" has been provided copies of the repair receipts, and I have also sent the dealership an invoice for their 50% reimbursement to me per the dealer warranty of $2,688.32. The Finance company "[redacted]" has been notified of all of this information. A copy of the repair receipts, and dealer warranty have also been provided to "[redacted]" per their request. The amount of money that had to come out of my pocket to make the truck drivable and safe has put a personal and financial hardship on me, and I expect the dealer to honor their limited warranty as explained above. I am prepared to take my complaint with Liberty Auto Sales and the service center which performed the inspection, up to the property authorities including all legal channels until I am financially reimbursed as explained above.

Response:

After speaking with [redacted] he stated the fuel injectors are not covered under the warranty because only the motor and drive chain parts are under warranty. Fuel injectors do not fall under either of these two categories.

Response:

They have not mentioned anything about the “Head Job” that I had to pay for out of my pocket. Just because the extended warranty (which I paid for) covered $2500 of it, that doesn’t release the dealership from their warranty responsibility on the $2000 I had to come out of my pocket with. They owe me half of that amount, which is $1000.00. The “Head Job” that was done is covered under their warranty. I have attached supporting documentation to this email. Also, I will mention that this is a diesel truck. The Injectors are not electric, they are internally lubricated by the engine oil.

Response:

The customer was informed to bring the truck to us to check any engine proplems; the customer informed us he would not because he did not like our mechanics. The warranty we issuue is a 50/50 basis parts and labor; but informs the consumer we have the right to inspect and approve any repairs before work is performed; the customer refused to allow us to inspect the engine prior to his repairs elsewhere thus voiding the warranty on the repairs that may or may not have been needed; we informed the customer that he needed to allow us to inspect the engine prior to any outside repair work being done. But as noted he refused to allow us to inspect the engine. Best Regards, [redacted], General Manager, Liberty Auto Sales.
