Review: I joined the club fall 2012 because I have a bad back and I wanted to use the pool hot tub and sauna in the evenings. At the time the club was open until 10 PM weekdays and 8 PM weekends. The hours changed in summer to open until 9 PM weekdays and 7 PM weekends. These hour changes were never mentioned in the contract or I would never have joined. I work late so this essentially rendered the club unusable. I did try to use the club though by leaving work early since I was contractually obligated. I had other issues to deal with. The hot tub became unusable shortly after I joined. I got severely itchy skin in severely sensitive areas. When I complained to staff I was told by [redacted] that he would never use the hot tub himself for that reason. I stopped using the hot tub and never had the problem again. The contract also made no mention that the local swim team would be using the pool each night until 8 PM (actually around 8:05PM) this only left me 55 minutes to use it as well as other areas like the sauna and shower. Simply not enough time even when I left work early costing me money. I complained about the hours on more than one occasion as do many other members. One night I asked a staff member if I could look at a contract to see if the hours change was mentioned. It is not. While I was discussing the matter with the staff member a club member that appeared to be on steroids came marching over and said the hours have always been that way. I asked him if he worked there he said no. I let him know the conversation was none of his business. He then challenged me to fight. I tried ignoring him and continuing my conversation with the staff member. The staff member started taking sides with the steroid goon probably because he felt he had too since the guy was sticking up for the club hours. He followed me out of the building but was only talk since there was no altercation. I think he realized he barked up the wrong tree once we left the building. He said he agreed about the hours at the end.Desired Settlement: I would like a full refund of 13 monthly dues payments. I sent an email to [redacted] the owner and he didn't even reply. That email was sent as a way to resolve the matter with out me having to file complaints with any governing bodies like yours. There will be more letters sent to other governing bodies in 31 days if I the matter is not resolved as a result of this complaint.

We received notice from the Spokane Revdex.com on 11/1/13 that a previous

member of ours, [redacted], had filed a Revdex.com complaint requesting his annual dues be

reimbursed to him in full.

The Liberty Lake Athletic Club completely disagrees with Mr. [redacted]’s position. Mr. [redacted]

joined our facility on 9/30/12 and cancelled on 9/26/13 (see attached joining form and

cancellation request both signed by Mr. [redacted]).

Mr. [redacted]’s club usage is also attached. You will see that he used the club consistently

during his time here, checking in about 90 times throughout the year.

Mr. [redacted] also signed a 12 month membership agreement and paid each month of his

agreement like all our other members do. I have no idea what grounds he would have to

be reimbursed for the dues he paid to us when he used our services regularly. He claims

to have been misled by the fact that we close an hour earlier from Memorial weekend to

Labor Day weekend (approximately 3 months). This is a change we have made every

year for 15 years and we are very upfront with it and we let people know when they join.

We do not guarantee a certain amount of hours to be open per week in our agreement.

We appreciate the Revdex.com investigating this matter and hope that common sense will

prevail in this situation.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.

In the world we live in today everything should be in writing. Especially, when there is a contractual obligation. The contract said nothing of the change of hours or I would not have signed up. Simple as that. To say that someone would have explained it is funny to me. Nobody said a word until after my contract was in place. Why have a contract at all if they need to refer to a conversation that was supposed to have happened when I signed up. If these hours have been designated for over 15 years and they change people should be able to see that in their contract. When I signed my contract the hours were acceptable. They changed months later. I agree common sense should prevail in this case. The contract part is the main reason however I only used the club because of my contractual obligation. I was actually unhappy abut the club when I found out the hot tub was infected or contagious almost immediately. I was told by the staff they would not use it either for that reason. I had severe itching in severely sensitive areas so I had to discontinue using the hot tub almost immediately after signing my contract. When I complained I wasn't offered an option of canceling my contract so of course I had no choice but to use it. 90 days out of 395 that I paid for can hardly be considered consistent use considering I joined due to chronic back pain and would like to have used the club at least 75% percent of the time to help. I look forward to resolving the matter but this response does not even indicate that this business cares if the matter is resolved or not.
