I have reviewed the offer made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
The current situation in a number of areas of my lawn is that of muddy, barren, and eroded soil. These areas did not exist prior to the 'work' performed by Liberty I do not believe I should have to wait until August to have grass seed placed on these areas. The offer would leave large areas tof dirt hroughout the lawn all spring and summerI've sent a series of photographs to the Revdex.com on Feb 11, documenting the existence of these conditions as well as the appearance of the lawn along side the diveway prior to the application of the compost blend material. For me, an appropriate response by Liberty would be to offer to sod those areas of concern early this spring or refund the requested amount so I can hire another company to place sod
With respect to several comments in the response form Liberty, I would offer the following:
My email regarding my appreciation of *** note had to do with *** statement that felt bad that the guys did a poor job and that he should have supervised them closer. Nothing in that note had to do with any sort of discussion or agreement with *** about the placement of straw or fabric
I sent a certified letter after it appeared by December email was ignored - where I asked two questions of ** ***: did he visit the property ~ Dec 6th as he said he was going to do? ; what did he think of the work that was done then? Moreover, I had to followup with Liberty in ealry December after there was no action resulting as promised from my November telephone conversation with ** ***
I appreciate the cost of materials and labor expended by Liberty at my homeHowever I did not plan the course of action nor the follactions taken by Liberty. I should not have to suffer the results of poor workmanship or incurr the cost to actually have the lawn repaired

We hired this company to renovate our landscape*** showed up promptly, and was helpful in planning the work, gave new ideas, and was very friendlyThat was probably the best we got out of the whole experienceWork was to start withing 7-days...it was like the last day when someone finally showed up...after I called and left a message that I wanted a refund it not started by that dayThey will not talk to you on the phone..they leave a message that you have to dial into to get the message...or e-mailI was offered a 10% discount to pay up front in full...bad mistake..should have been a warning signThe day of install, the crew was not informed on exactly what was to be doneThey cut edges so crooked between my grass and flower beds, they had to re-cut the edge straightBoth flower beds on the side of my steps come out one foot beyond the foundationStill today a lot of the fiber weed block was never installedWhen they came the final day, the arrived and left so fast my wife never knew they were there, and they dragged a piece of my newly layed driveway asphalt into the ditch below because they drove off the driveway and across the ditch to get onto the road in front of my houseI'm having the paving company fix it when they seal in a few daysI had rock put in my flower beds, and some of the rocks were thrown onto the newly installed scrub and bent a branch that will not straighten upI left an email wanting it replaced, they never responded as of yetIf the scrub dies, court we will go because I know this is the only way to make them do the work now that hey have been paid in fullThe workers blammed all the delays on me as why the work was taking so long...well I am paying the bill, and I wanted the job done right One part of the actual contract they never did at all

apologize. We want each person we do business with to walk away feeling
satisfied, and that apparently didn’t happen in your case. We thank for the opportunity for allowing us to address the concern you have shared with us.  We want to make things right.  When you had sent a certified letter to a person and not the company, it did throw up a red flag. We hope we had never gave you the feeling that you could not talk with us directly Dec 16th is the last email we got, to us the certified letter made us feel that the relationship that all of us enjoyed building changed over the winter months and we did not know what to do, how could we produce results in the middle of winter?
After praying and review of the account we felt a complementary lawn care program  (6 lawn care treatments fertilization, weed  & crab grass control, lime treatment and at the end of August aeration and seeding) for the year 2014 was not only an opportunity to address the concern but to regain your trust in our efforts.
We have seen to many companies and relationship end over unsatisfied results due to time frame and the norm is to pay the client to go away. We have made it a point to stand to make the wrong, right. We have been successful for many years and we continue to look for ways to improve.    
 Although
we try to cover all the bases, we aren’t perfect. We depend on clients
feedback to let us know where we can improve. I do hope you accept our apology
and see fit to do business with us on any level.
We can not refund the money we spent to get the results we all wanted for your lawn to have.
We have attached a copy of e-mails over the past 2 months. [redacted] it was clear to us that anytime you asked us to come we did and tried everything we could. [redacted], have express effectively and completely that the results you do not have is a result of the straw with netting, but [redacted] we offer sodding for the areas of concern ( you had wrote it was not necessary) we offered this because the window for growth was gone for now and the Spring will be a time for celebration!
When I wrote you that [redacted] felt the netting and straw would not help in any way, the reply I got was

Along with the emails I attached has always been our attitude, if we felt it would help we would have do it, with a great and kind heart. [redacted] and the entire team want your lawn to be the best and we ask you for forgiveness for the grass to not look its best during the late Fall/ Winter. We still want to see this to success, please allow us a little more time at no cost to you but patients for the season to reveal the fruit of our labor and your investment!

Review: I hired Liberty Lawn and Landscaping Oct 2, 2013 to perform overseeding and grading services to my yard. More specially, Liberty was to apply a light dressing of compost material, perform core aeration, and the overseed with grass seed. They were to also fix several areas to change the grade of the yard. I asked Liberty to ensure they provide for sufficient topsoil blend material in their price. I was provided a quote of $6473.00 for this service (which I paid). When I was able to inspect the work I found in particular that the areas to be graded were only minimally worked on. I was subsequently told by Liberty that they ran out of material to do the job completely, and that it would be another $1500 to finish the work. I also observed little evidence of core aeration (no plugs, few if any holes in most all the lawn - however Liberty insisted they did the aeration. I agreed to the additional cost and Liberty came out Oct 19th. to do the grading work and to "re-rake rest of lawn to correct imperfections and make sure homeowner is satisfied". Liberty did a poor job in this second grading effort and actually left several large areas of exposed soil. Erosion quickly impacted these exposed areas. I made a number of requests for correction of the problem, to include asking them to place straw or fabric over the exposed areas. I've sent Liberty a number of photographs of my concerns. Liberty said they would not put down straw but would do fabric - but they never did. I actually had to buy some straw to place on a hillside to prevent further erosion. One of the Liberty employees (foreman?) actually left me a note on Dec 5th apologizing for the poor work of the staff. As of now, I have a number of exposed soil areas in the lawn that require repair to restore the integrity of the lawn. I sent a letter to Liberty on Jan 15 outlining my complaint and requested a partial refund. In an email exchange with [redacted] (co-owner) on Feb 4 I advised [redacted] I would be open a plan to establish lawn in the eroded areas provided that the installation of the grass was occur very soon.Desired Settlement: I have asked Liberty to return 1/2 the initial cost of the work (a sum of $3236.50) AND the entire second charge of $1,500. This refund of monies paid are needed to hire another company to repair and restore the lawn.
