Mr***'s account was incorrectly charged for September dues on September 1st He informed us and we reversed the charge on 9/2/it should have been in his account no later then 9/4/as we have no control over how the banks
process thisThis is standard procedure when this occurs, I have found no one that informed Mr.*** that it would be weeks for a refundHis money was returned promptly and I have no idea what his issue is

Mrs *** became a member at Lifecenterplus in April, Her signed contract is attachedIn the contract it clearly states that cancellations must be submitted in writing on or before the 24th day of the month prior to cancellationIn
September of Mrs *** requested to freeze her membership from September through April Her signed freeze form asking to have her dues reinstated beginning in April is also attachedThe fact that an account is frozen does not negate the terms of the original agreementAt some point Mrs *** must have decided to no longer be a member of the clubWe were not notified in writing as her contract indicates she must and therefore we rightfully charged her for the month of April If Mrs *** was able to produce a written resignation letter, which we have no record of and we keep meticulous records, we would have gladly refunded her duesNo such letter exists as she did not fulfill the requirements of her signed agreement
Having said this, Mrs *** has gone to her bank and somehow convinced them to credit her and withdraw the money back from usShe therefore most likely does not have a complaint about us anymoreHowever, we have been wrongedShe has been sent to collections and I will take her to small claims court if need beIn addition, if we become aware of one more fraudulent post on social media that impacts our business I will have her charged with slander
People cannot just decide to not fulfill their obligations and then get their own way by threatening to go to the Revdex.com and destroying your reputation on social mediaIts just not right

We presented LifeCenter Plus with a cancellation letter back in August of At the time, the membership representative talked us into "freezing" our account instead of cancelling our membership as way to avoid the enrollment fee should we decide to rejoin laterI'm attaching that cancellation letter hereSince this occurred months ago, I honestly do not remember if the LifeCenter representative obtained a copy for their recordsOur main concern here is we were completely mislead with how "freeze" process worked and the fact that LifeCenter admitted other members felt this way as well there was clearly a lack of communication among the membership staff
We did submit an unauthorized ACH request through our financial institution and they did decide what LifeCenter did was fraudulent as I can only assume LifeCenter was unable to provide a copy of an ACH authorization form that either account holder signed authorizing them to debit the checking account for this transactionAs I'm sure the Revdex.com is aware of Regulation E, businesses need to have signed authorization to debit a consumer checking accountNow had the club mailed us a bill for these April charges that would have been a completely different issueHad the club been timely in their response to us when we questioned the debit, again completely different situationBut they not only fraudulently debited our account, but they also took over days to return our phone callsClearly they are in desperate need for money as they are willing to take every customer who has written a bad review of their club to small claims courtI have every right to review the experience I have had with LifeCenter Plus just as I would if I had a positive experience at their clubIts called the first amendmentIts not right to mislead customers with incorrect information for financial gain

First, Mrs *** was asked repeatedly to produce a letter of resignationUntil now she has been unable to do soI find this mildly curious and hope you do as well
I am truly confused as to how Mrs *** can feel as though she was mislead on how a freeze worksPerhaps since the original paperwork was completed and SIGNED by her husband she missed the highlighted statement that says PLEASE REINSTATE MY DUES OBLIGATION BEGINNING APRIL
As far as an individual at Mrs ***'s bank deciding that we were fraudulent, I am appalled that we were not contacted and have proceeded taking action against the individual and the bank
In addition, for Mrs ***'s information, once a bank has returned money from an ACH withdraw, by law the money cannot be returned to the business regardless of what documentation is producedHowever, our bank did agree with us that whoever returned the money made a mistakeThis is why we have sent Mrs *** to collections vsre-withdraw the moneyAs an FYI, the collection agency also agrees with us
I rest my case as far as Mrs *** ability to make incorrect, negative comments about LCPI am curious as to how she came to the conclusion that LCP is "clearly in desperate need of money" because we would take someone to small claims court for making a negative comment and/or reviewTo clarify, I never said that I would take Mrs *** to court for posting a negative review, I said I would take her to court to collect the money she owes usNot because we are desperate for it, only because she owes it to us
As for the negative review, I take all reviews, good and bad, seriouslyI try to learn from them and also try to be as honest with myself as I possibly can on whether a review of us is accurateTruthfully, most times they are and I use the information to better our business or train our employeesThe problem I have, and the only reason I mention the review, and truthfully I was really more referring to the stuff she put on FB then I was the review, is that LCP is a small family business and we work hard to remain competitive and provide a safe, family friendly health clubIt is so disheartening to me that because someone feels that things didn't go there way they can take to the internet and proceed with their attempt to destroy what a lot of people have worked hard to buildI agree, of course, with Mrs *** the 1st amendment certainly provides everyone the right to speak their mindHowever making fraudulent statements that directly impact the financial future of a person and/or business is not protected under the 1st amendment
