Landlord failed to refund deposit in a timely manner. Landlord attempting to withhold over half of deposit without providing itemization of repairs.Vacated premises on 7/27/14. Scheduled walk-thru with landlord 8/1/14. Landlord failed to show up. After several attempts, landlord met with my husband 8/7/14 for walk-thru and returning of keys. No sign-off was done by landlord. We had to contact her on several occasions to inquire about deposit. My husband contacted her 9/12/14. She stated she would let him know about our refund that day around 1pm. She never called back to update him. I contacted her 9/15/14 and spoke with her. She claimed that the damages $1150 which included repairing sheetrock, painting, and repairing a garage door. The total deposit paid $1850. I disputed with her because there wasn't any holes in the walls. There was one scratch/indentation on the wall from a hanging picture that fell and scraped the wall. No damages were discussed or signed off by husband during the final walk-thru.Desired SettlementReasonable deposit for valid damages. I request itemization of charges and would like to see the repair work that was supposedly done to the property. I feel like that they are trying to charge us for painting the premises.Business Response It did take longer than normal to get deposit back to renters due to the fact that renters hit the house (garage) with car. This repair required three different repair men (garage door guy, siding guy, and painter). The siding guy and garage door guy had to make two trips each. One to remove damaged siding and trim, and garage door and to reinstall new siding and trim and the existing garage door once repair was made. This was $385.The repair to sheetrock, paint touchup inside and in the garage was $700.We did not charge to paint the whole house, however we did repaint the whole house prior to tenant moving in. The repainting of this house which is over 3,000 square feet was $4,611. We only charged to repair what tenant damaged on a house that was listed for sale at $245,000. This was a model home. Not the typical rental. The husband agreed that they should have hired professional movers because of the damage their teenage children did while moving. The carpet cleaning was $165 and the water bill was $103.94 which included their past due balance. They have had a check for $496.06 along with a copies of repair bills waiting for them at our office since September 15, 2014.Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)The garage door itself was not damaged. The plastic trimming around the the right side of the door was cracked and also the 2x4 piece of wood securing the rail was split. That would not have required a painter. The listing price of the house is irrelevant and does not speak on the actual condition of the house. When we moved in there was damage to the floors and the house did not look like then entire had been painted. I have pictures when we moved in. There wasn't an initial walk-through either. The bathroom shower was filthy and the house hadn't been cleaned. As stated previously, there was only one wall that had damaged located near the staircase where a picture fell off the wall and scraped the wall. My question is, if the house was damaged why didn't the landlord do a final walk-through and have my husband to sign off on damages when he returned the keys. We had to contact the landlord several times to turn over the keys. I feel as if they didn't have the deposit to return, so that's why it took them so long to come up with the "supposed damage." As far a carpet cleaning that is a part of the landlord's responsiblity unless the tenant damages the carpet. I have rented apartments and never was charged to have the carpet cleaned prior to the next tenant moving in. The water bill is probably the only accurate charge that I agree with. When I initially spoke with the landlord, she told me that we were due a refund for $750 and my husband could pick it up that day at 3pm. I texted her back and told her that we would not be accepting that refund because I felt she was trying to keep our deposit. I requested to see the damage that she was clamiming and itemized bills for the repairs. She texted back stating the carpet was getting cleaned on Monday and that she would be happy to give me the info. I did not hear from her again. I decided I would not contact her anymore. Final Business Response Tenant ran into the right side wall of the garage with her car which caused damage to the vinyl siding trim on the garage door opening, the wood trim, on the inside of the garage, that the garage door railing is attached to, and the weather stripping around the garage door. In order to repair/replace the damaged siding, and trim the garage door had to be removed because the garage door tracks were attached to wood that was damaged when tenant ran into the right side of the garage door with her vehicle. Tenant also ran into the sheetrock wall in the garage with vehicle several times which dented/put small holes in sheetrock in the garage in front of the bumper of car.Tenants husband agreed that they should have hired professional movers to prevent the damage caused to walls by tenants teenage children when moving furniture out. There were multiple dents/holes in sheetrock on the staircase, on the wall between the hearth room and den, on the column by the dining room and the hallway from master bedroom. The house had been completely repainted 1 month prior to tenant moving in. This house is not a typical rental home. It was a model home with granite countertops, hardwood, 2 fireplaces and many upgrades. This is why tenant loved the house. It is an extremely nice 3,000 sq ft home which had only been rented once to renters who were building a home and wanted an upscale home to live in while in transition. The home has been put back into the condition it was in when tenant took possession of the home. I will refund the $165 carpet cleaning charge, however the other charges for the repair to garage and the sheetrock repair/ touchup paint have been deducted from their deposit, and tenants husband acknowledged these damages. All invoices for repairs were included with the check that has been waiting for pickup since 9/15 (which is within the refund period). Also included with the check is a copy of the invoice for repainting the house prior to tenants moving in so that tenant can see the difference between painting the entire house, as was done prior to her moving in vs. sheetrock / touchup paint repairs that was done because of damages from tenant. We will refund the $165 for carpet cleaning bringing the total deposit refund to a total of $661.06. However, the other charges are not negotiable due to the fact that we are currently out these funds due to damages by the tenant and unpaid bills by tenant. I bought my house Oct 2014. I had an 11 month warranty and cannot get anybody to come complete the work on the new house warranty.I bought my home in October 2015 I sent my 11 month warranty paperwork to Lifestyle homes on time. They came out 1 time and did not finish the work. I texted Tony about this Oct 31st. I texted again Nov 2nd 2015, he said they will come back that Tuesday to finish. I have called and e-mailed Lifestyle. The last time I called in February the office told me they are very busy with new homes, 30 day warranties and 11 month warranties. The homeowner had signed the bottom of the form indicating that the work had been completed to her satisfaction. As is our procedure after punch lists are signed completed by the homeowner, punch lists are filed away. As soon as we received this notice that the punch list was not complete, our superintendent contacted the homeowner to set up completion of the punch list, but due to a painting project homeowner has going on, we have not yet met per the homeowner's request. We do have a meeting scheduled for May 2, 2016, and we w[redacted] be going over each item on the punch list with the homeowner and work out a schedule for the remaining repairs.Consumer Response (The consumer indicated he/she ACCEPTED the response from the business.)Rob came over and reviewed. But no work scheduled yet. He told me he is lining up contractors. I w[redacted] close when work is completed.
