Hi ***I'll look for an email from you thenThanks! Matt

Since receiving this we've met with the Buyer and the Buyers Agent and believe that we have come to mutually agreeable remedies for all of these items of concern Should any remain, hopefully there is open communication so that the items can be resolved We'll work to outline the solutions below.Regarding the fireplace trim, see attachment "2106-Gmail - RE_Fireplace" where we were told that verified that the buyer wanted a clean face That being said and shown in writing, we have installed the fireplace trim that she wanted at no charge to her Regarding the closet lights Those aren't something that we ever include standard in kids bedroom closets The cost to install them was quite a bit more and in an effort to appease the buyer, we had agreed to share the cost with her.Regarding the outside fireplace did not have the log set installed at the time of this email, but does now The fireplace itself does not look different pictured (attached as 2016-Carolina); However, to the Buyers credit the cladding around the fireplace is different There is a metal piece above the fireplace that my stone mason has advised me against attaching stone to in fear that the stone will not stay adhered over time to the metal This has been reviewed with the Buyer and the Buyer has been given the option of adding the masonry cladding over the metal, but under the advisement that it may not hold up well outdoors in Utah We will do whatever the homeowner would like us to with the cladding but stand behind the advice given by our mason.Regarding the rock retaining wall (pic attached as "deck patio-min.jpg" and the pic isn't a perfect pic of the wall, but the only one that I have currently from the professional pics taken Additional photos can be provided.), the rock wall has been engineered and passed inspections by both the engineer and city inspector With regards to being aesthetically pleasing, we have agree'd to discuss options with the engineer that might be good solutions for the Buyer.Regarding the island size and refrigerator The island was turned to accomodate a larger island than the plans showed Long after that, the request to order the refrigerator through us was made, and the refrigerator was installed and did meet code In an effort to appease the Buyer, we would be willing to buy the first refrigerator back at the price she paid.Regarding the exterior lights, they are on back-order We have offered to credit the amount for the fixtures that are back-ordered, allow the buyer to select new lights that are in stock, or escrow funds at closing to ensure completion and installation of the lights She's opted to wait and have them installed when they arrive They are currently back-ordered Furthermore, we'd apologize that you've felt that the customer service has been poor, and that you've been disrespected We should certainly like to achieve better than that and as our Buyer you did deserve betterWe are constantly looking at how to better manage our projects and will take that feedback into consideration We appreciate you as a Buyer and think that your home turned out AWESOME! Please advise us if there are any outstanding concerns Thanks!

Hi *** I’d love to address your concerns From your complaint, I gathered the following things with regards to construction quality: Damaged Concrete in Driveway and Porch Paint non touched up with exposed drywall work never completed Settling of foundation to point that front and back porch are destroyed and half the doors in home don’t close RE: Damaged Concrete in Driveway and PorchI will get someone scheduled to get this done Is it okay to get someone over to the property in the next few days to see what needs to be done? Please let me know as I won’t schedule them until I hear from you that it’s okay to have them on your property RE: Paint non touched up with exposed drywall work never completedI have an email dated in December showing Terry trying to schedule the painter and also requesting that if you didn’t hear from him then to please reach out to him Did this never happen? I’ll forward you the email And, assuming that it didn’t happen, I’ll also resend it to the painter RE: Settling of foundation to point that front and back porch are destroyed and half the doors in home don’t closeIn that the home closed in and it is now 2018, this will now fall under the year structural portion of the warranty Please reference your 2-Home Buyers Warranty for information on how to submit a claim As far as naming the house plan that I designed after your wife, I apologize that this was offensive to you and I also apologize to your wife You never voiced to me that this bothered you It certainly was not meant to be offensive or to “rub salt in your wounds” I apologize that this aggravated you and have already changed the name of the home plan and will definitely not use her name in the future in reference to any home plan that we offer Again, my apologies on this matter The house plan, however, is and always has been my property and my design and I will continue to offer this plan for sale I never, in any expressed or implied manner, gave you rights or a license to the house designBest RegardsMatt M***

Hi [redacted].   I’d love to address your concerns.    From your complaint, I gathered the 3 following things with regards to construction quality: 1.       Damaged Concrete in Driveway and Porch. 2.       Paint non touched up...

with exposed drywall work never completed. 3.       Settling of foundation to point that front and back porch are destroyed and half the doors in home don’t close.  RE: Damaged Concrete in Driveway and Porch. I will get someone scheduled to get this done.  Is it okay to get someone over to the property in the next few days to see what needs to be done?  Please let me know as I won’t schedule them until I hear from you that it’s okay to have them on your property.   RE: Paint non touched up with exposed drywall work never completed. In that the home closed in 2014 and it is now 2018, this will now fall under the 10 year structural portion of the warranty.  Please reference your 2-10 Home Buyers Warranty for information on how to submit a claim.   As far as naming the house plan that I designed after your wife, I apologize that this was offensive to you and I also apologize to your wife.  You never voiced to me that this bothered you.  It certainly was not meant to be offensive or to “rub salt in your wounds”.  I apologize that this aggravated you and have already changed the name of the home plan and will definitely not use her name in the future in reference to any home plan that we offer.  Again, my apologies on this matter.   The house plan, however, is and always has been my property and my design and I will continue to offer this plan for sale.  I never, in any expressed or implied manner, gave you rights or a license to the house design. Best Regards. Matt M[redacted]
