Client in claim "*** ***" have a photo session Payment is due at time of service, in which client never paid for her session I do have images on file As far as no-response and "unclaimed" or "refused" certified mail I've been hospitalized off an on from June-July
and consistently since September Being at the hospital daily since then did not allow for us to sign for any packages Delivering my baby at weeks via emergent Cesarian Section, resulting in multiple health issues and delays We are dealing with life long injuries because of this and was just first released from the hospital last Friday This is something that has been out of my control I do understand that these images are heirlooms, I've just been able to give them the attention during these timesThis has all been publicly posted and share with my clients

Client has not paid for said session, with husband calling/emailing and apologizing for "wife ***'s" behaviors In regards to delay: I've been hospitalized for the majority of my pregnancy resulting in a very pre-term emergency C-Section with a delayed child

The said clients, did indeed receive newborn services from my businessThe client also discussed the $nonrefundable depositBeing that deposit is non refundable and that was stated in the initial communication with the client The client has yet to pay for the servicesWhich prior to any
post processing work already consisted of 1/hoursThe delay that the client is discussing, was due to hospitalization, in which the client was made aware of this I am also unaware of any other businesses that preform the work/ product without payment

I had my daughter’s pictures taken in November I paid for the session in full that dayThe initial experience was very positive as Wendy was very good with our baby I was told when I left that our sneak peek would be available in 1-daysI received the sneak peek over a month later I was also told our pictures would be ready in 2-weeksI waited over months with no response to any email, phone call etcWe FINALLY got our photos months later but I am STILL waiting for her to send me the prints that were included in my session Wendy has not responded to any of my emails sinceThere is currently a group of over individuals that are STILL waiting for photos from WendyIf you want to actually receive your photos, I suggest you do not do business with Lil Sprout PhotographyVery inconsiderate customer relations

I am writing to update the complaint I had filed previously with LilSprout Photography.  Although we were unable to resolve the concern through your office, I would like to have it changed to a status of "resolved."  Please let me know if that is possible or if you have additional questions.  Thank you.
Resolved:
This complaint has been resolved to the customers full satisfaction.  Photos have been delivered and they were well worth the wait. Thank you.

If the reason I have not received my disk of pictures was because I have not payed, then why did I receive written notice that my disk was being mailed to me on more than one occasion before she finally spoke of it on July 25th?  Supposedly, the original disk was mailed out June 23rd. When the disk did not come by June 26, I sent a message (see Attachment "LSJuly10").  She then stated on her Facebook page on July 3rd that she resent the disk from the Post Office and I would receive a tracking number (see Attachment "LSJuly4"). I never received a tracking number or the disk in the mail. I sent her another message July 9th which she responded to on July 10th (see Attachments "LSJuly10" and "LS1").  On July 25th, still with no disk, I sent another message which she replied to almost instantly and that this was the first mention of not receiving my payment (see Attachments "LS1", "LS2", LS3" and "LS4").  Please note that at the end of the conversation from [redacted] on July 25th (Attachment LS4) she stated the "disc will be sent this afternoon" and "Payment is not necessary".  That conversation on July 25th, was that last that [redacted] has responded to. Even though she said "payment was not necessary", weeks later we offered to pay her just so we could get our pictures. But she never returned my or my husbands phone calls to set up a time to stop by her studio to pick up the disk and still pay her.  By then, we were not going to make a payment on her website just to not get the disk in the mail. Why should I pay online and trust her to mail it when she told me on several occasions that it was already in the mail, and that I did not have to pay?

I'm unaware of any business who provides services or products without payment.

Client did indeed receive a 6 month & 1 year session through Lil Sprout Photography.  However client has had the images form the 6 month session since May 11th, 2014. (See attached screen shot)  Client has only paid $100.00 for the 1 year session as she was qualified for the 1st year...

captured series.  Client has been notified of my hospitalization as well.  I do still indeed need to get the 1 year session images to this client.

Re: Complaint Background
Problem Occurred date: of 6/30/2014 - I'm a little unsure of this one. As to my knowledge nothing happened on this date. Client has sent emails stating she had felt "ripped off" due to no sneak peek. "Sneak peeks" are something not mentioned in any informational sent to any of my clients. This is something I verbally ask all clients at the end of their sessions, due to parental permission is needed to post these images publicly Not all sessions are posted as it's at my discretion and only about 33% of my sessions are put up for "sneak peeks". During the said times of communications, I've also been in contact with client "[redacted]'s" sister "[redacted]" & her spouse "[redacted]" on several separate occasions.
Client was told at the time of her session on 6/28/2014 that my average turn around time is 2-3 weeks. I am running behind due to [redacted] This has also been relayed to the client & her spouse. Their services of their sessions images will be completed and posted on 8/30/14. Prints from their session will be ordered and sent once they decide on their images of choice and relay to me.
If any further information is needed - please contact me at [redacted]
Thank you,

"I contacted the business MULTIPLE times via email and phone call/voice mail to discuss if my outstanding payment was the reason that we had not received the picture gallery and the prints. The business owner NEVER returned any of those emails or phone calls. We were also told at our newborn session that the remaining balance could be paid when we picked up the picture. I don't know of another business that finds it acceptable to change their policies and NOT let their customers know. I have not been contacted about the remaining balance or been given an invoice even though I have contacted her via email and phone calls OVER 30 times in the last three months. She did email me on March 25 to state that I would be getting the gallery session in the next week, and did not mention anything about the remaining balance. But again, I am STILL WAITING for the gallery session. I have again emailed and called in the last three days, stating that as soon as I receive the session and order the prints, I can gladly pay the remaining balance at the time of the picture pickup; which is what she told me we would do.
I understand that your family is going through hardships and you had a long hospital stay. But that does not make it acceptable as a business to NOT contact your customers or to deliver on the services you were hired for. Regardless of the fact that the deposit is non-refundable, I still hired you for services that have NOT been full filled. I do not know of ANY business that finds it acceptable to ignore phone calls and emails from customers for over 3 months, not full fill the services that you were hired for and still be expected to be paid the full price for services? You take beautiful pictures and all we want is for the picture gallery password so we can order the pictures from you. As soon as we do this and we pick up the pictures from you, I will gladly finish paying you for your services. Considering I've only heard back from you in regards to 2 emails that I've sent in the last 3 months, I'm very nervous to pay ahead of time, considering the lack of timeliness the last couple months.
To resolve this issue, we would like the password for the gallery so we can order the pictures. Once we have ordered those and set up a pick up time, I will gladly finish paying the balance at the time of the pick up.
