This is in regards to a complaint against Lincoln Credit Group on 9/4/
Our client’s name is *** ** and the ID# is ***

He recent** filed a complaint with your office that he wasn’t satisfied with our service, while in reality,
Mr*** ** stated to us that he could not afford to continue with our program and was delinquent
on his paymentsAs proof of his inability to continue with our program, I have attached his letter to us, stating
“the main reason is I real** cannot afford the program and I will try to handle the accounts myself.”
On his complaint, *** ** *** ** also stated that we collected payments from his checking account in the total amount o $ *** However, based on the records from our Accounting Department , as matter of fact, we on** collected $ *** from himThe other two payments did not actual** go through due to unauthorized customer advise . Please refer to attachments Payment Record & Return List for details. Please notes : 1) NSF means “ Non Sufficient Funds”; 2) R 10: Customer advise not authorized
Though Lincoln is not the party at fault for *** ** *** *** cancellation , as customer’s satisfaction is at the core of our business model, we generous** agree to refund *** *** ** $ *** , the total amount we actual** collected from him If *** ** *** ** agrees with this amount , we would like to request a signed written statement from him ,stating that he agrees to accept the final refund in the amount of $ *** and will not seek any other compensation Upon receipt of such statement, we will glad** honor our offer
If *** ** *** ** does not agree and can provide actual document from his banking institution to prove that Lincoln did withdraw $ *** his checking account , we will take further investigation into this matter

Review: This Company is taking advantage of people with credit problem. They took out 3 payments of my checking account worth $1800 and didnt do a thing for me. I lost my job and I can not keep up with the payments so they kept all the money and I still stuck with bad credit. There should be some kind of law to protect consumers from being ripped off by these type of companies. Later I found out some of the stuff I can do myself, and this company charges an outrage fees. I tried to email the president of the company but they didnt response, I just want some of my money back. Went on their website they are no longer there. Please help me get some of my money back from this company. They are out to take advantage of the unfortunate.Desired Settlement: May be half of the money they took out of my checking acct. 2 years ago. I would be satisfy with that, and never make the same mistake twice.

Lincoln Credit Group and our law firm are in receipt of your letter dated May 23,2013 presenting a

complaint with lD # [redacted]. Our law firm represents Lincoln Credit Group fn' all its legal matters.

Our law firm has duly reviewed your letter and the complaint submitted by our former client Mr. [redacted] and deeply regrets the misunderstanding occurred as a result of Mr.[redacted]' s failure to

comply with his contractual obligations and terms as per the agreement entered into with Lincoln

Credit Group.

Lincoln Credit Group represents clients during the process of debt settlements. As a prerequisite to

the delivery of our promises, client must comply with the conditions established in the contract in

order to enable negotiations with the creditors.

It is our contention that our client, Lincoln Credit Group, complied with the terms of the agreement

and services that were offered to Mr. [redacted]. Lincoln Credit Group was in the process of rendering

those promised services until Mr. [redacted] defaulted and breached the contract.

Mr. [redacted] also failed to maintain constant communication with our client which was a contractual

duty on his part. Our client's representatives established numerous communications with Mr. [redacted]

to clarify Mr. [redacted]'s misundererstanding and to demand compliance of the contract. Further, Lincoln

Creditt Group's representatives attempted to contact. Mr. [redacted] on several ocasions to no avail as

evidenced by the print out of the case summary which was properly recorded. (see report enclosed

showing attempts to clarify Mr. [redacted]'s confusion and misunderstandings and several attempts to

contact him)

One of the contractual terms and requisites Is to enable Lincoln Credit Group to negotiate with the

intent to settle on behalf of its clients. It is within this realm that Lincoln Credit Group must have

direct communication with creditors. Further, Lincoln Credit Group's clients have the duty to inform

Lincoln Credit Group of any contact client may have established with creditors as those actions are

detrimental to the settlement process due to confusion and miscommunication.

In this Instance, Mr. [redacted] continued to make payments to his creditor Without notifying Lincoln

Credit Group, which ultimately prevented further negotiations with Mr. [redacted]!s creditors.

Furthermore, Mr. [redacted] never responded to any calls made by Lilncoln Credit Group's

representatives. Mr. [redacted] also failed to have sufficient funds to continue: with the administrative

and monthly fees to which he agreed. After many months trying to locate Mr: [redacted], on February 7,

2011, Lincoln Credit Group sent a letter requesting Mr. [redacted] contact Lincoln Credit. Group's offices,

request that was neglected by Mr. [redacted] as evidenced by the enclosed report.

On March 8, 2011, Lincoln Credit Group sent a Pre Cancellation letter to :Mr. [redacted]. Finally on

March 18, 2011, Lincoln Credit Group was forced to cancellation contract due to lack of contact

Our client, Lincoln Credit Group, is willing to reinstate the contract in order to represent client in the

settlement. of his debt as long as Mr. [redacted] provides assurances that he will duly comply with all

contractual terms to enable Lincoln Credit Group to properly attempt to settle the debt.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

To Whom it may concern:

Lincoln Credit Service tricked us to sign the EFT form , so they can have the fees up front before you guys even start to help the consumer. My point here is that you keep taking out money from my account to make it overdrawn. I lost my job at that time so I was unable to go on, so no need for me to call you guys back. If you cancelled the customer at least give some of the money back after they took out 3 EFT payments total over $1800 already, and cause me to have bad credit with Wells Fargo Bank. Why would you tell consumers just stop payments to all your credit cards and save your money in the checking account so they can withdrawl , and after that just save by myself until I reach the goal of half? Who need Lincoln Credit when I can do this myself? This is one of the big conception the consumer have when they enter the contract.
