We have fulfilled our obligation to [redacted]. The refund check was mailed out certified mail. When [redacted] entered into contract with Lindquist Buildings, he purchased a $38,000.00, Non-insulated post-frame building to be constructed in the first week of December 2017. To say the family is living in a camper for the winter due to Lindquist Buildings not providing information to obtain a permit is untrue, the original construction date was not set until well into the cold Minnesota weather. At the time of signing the contract, he left with a copy of his contract which had adequate information to get a permit. The city of Hibbing would then contact us to get the specs they needed to finalize the permit. Once again, there was never a request for this information. The information given to the Revdex.com contradicts what is being communicated via email and phone to our business. According to [redacted] the [redacted]'s have sold the original property now and have found/purchased new property that has what they need.

I am rejecting this response because: Lindquist Buildings has not fulfilled their obligation. Please see attached contract dated August 18, 2017. Nowhere in the contract does it mention a $1,500.00 cancellation fee. Lindquist Buildings cannot now impose this fee. All terms of the contract must be in writing and signed. Also, the contract does not give adequate information to obtain a permit from the City of Hibbing as the business stated. Again, why would we as consumers obtain a permit if the business that was scheduled to construct our building would not respond to us? We never stated our family living in the camper for the winter was due to not obtaining the permit – it was due to not receiving our refund of the money we put down in a timely fashion. The original construction date was set when we signed the contract, so that statement from the business is false as well. We are still trying to resolve this issue. Lindquist Buildings currently owes us $1,500.00 – they cannot charge us this fee since it is not stated in writing on the attached signed contract.

The customer statement is untruthful. When [redacted] entered into a contract with Lindquist Buildings he made no indication of financing issues and by signing the contract agreed to a purchase price of $38,000.00.  At no time did he ask about canceling or indicate that was a possibility. His...

main concern was getting it built as soon as possible.  We do not have customers cancel, we run a very tight schedule and have lost multiple sales holding the [redacted] spot for construction. Our salesman would not have sold this building contingent on cancellation in the busiest time of construction.  [redacted] and [redacted] have verbally canceled and then told us to move forward with this project multiple times. On 10-13-2017 [redacted] called the office and talked to the secretary and asked if we had received a letter from his attorney. We still have not received correspondence from an attorney. The $1500 cancellation penalty is a minimal charge that does not begin to cover the many hours we have into this building. This is a complex process, this building has been broke down for ordering, truss drawings were ordered, along with lumber and multiple other items, these services are not free of charge and are part of the building price. This process starts months before the building is erected. The [redacted]’s are blaming Lindquist buildings for them not being able to obtain a building permit. We work with the City of Hibbing on many projects per year and we do not supply the specs to the customer, we supply them directly to the city when they request them. We’ve not received a request from them for the [redacted] build to date and I followed up with the City of Hibbing and they do NOT have an application or building permit under that name or address.  To report that we caused halt of this project is MALICIOUS AND SLANDEROUS. When [redacted] was in here on 10/24/17 she stated they have sold the property. After continued harassment, irrational calls, texts, and disrupting our working environment, we are no longer taking their calls and will accept written requests only. [redacted] has sent a text to one of the owners/managers with the words “man up”, [redacted] came to our place of business demanding a reimbursement even though she is not named on the contract, caused a scene by calling 911 and refused to leave the property until requested by the Sheriff. [redacted] brought an unknown individual with her who was asked to leave after threatening and disruptive behavior.  We cannot tolerate this behavior towards any employees and/or owners. If this continues we will be filing harassment orders with St. Louis County against the [redacted]’s.
