Review: On May 22,2013 I purchased a 2010 CTS Cadillac from Lindsay Cadillac. I made diown payment which included $695.00 for GAP insurance. On June 5, 2013 I traded the 2010 cadillac ( with a different car dealer) for a 2012 CTS Cadillac and on June 10, 2013 went to Lindsay, spoke with a **. [redacted] and he prepared a cancellation form to have the $695.00 that I paid for GAP insurance refunded to me. I spoke with [redacted] on several occasions regarding my refund even though I was told that it would take about 4 or 5 weeks to get the refund. Finally in July when I spoke to [redacted] was told that the check was sent to me, I never received a check. It has been four months and I have not received any calls from anyone at Lindsays. I wrote to the finance director, [redacted], after almost 2 weeks he called and said that he would get my money to me, its been a month, havent heard from him anymore.Desired Settlement: A refund of $695.00 asap

In an attempt to settle the issue at hand as it pertains to **. [redacted], requested that we cancel and reimburse her GAP Protection Policy which we did; a check was issued and sent on June 14, 2013 in the amount of $695.00. Attached is a copy of the check and proof that it was cashed.

I am rejecting this response because: I never received the check that Lindsay claims to have sent me and if you will check the back of the check you will see that I did not sign the check, now I am beginning to thinK that this is an inside job and the check was never mailed to me in the first place. [redacted] had the nerve to insinuate that someone must have stolen the check from my mailbox. This never happened because I dont believe they actually mailed the check to me. Lindsay claimed they were investigating the bank where the check was cashed, they arent doing any such thing. I want the $695.00 that I paid to them when I purchased the car, I believe they know who cashed the check, it certainly was not me. I have written and called the Finance Director, [redacted], he called me once and said that he would get the money to me, have not heard from him any more, HOW PROFESSIONAL is that? I thought LINDSAY was a reputable company, I am finding out differently. They were quick to take my money, after that they ignore you. My husband and I have purchased many cars from Lindsay, BUT NO MORE. When I went to Lindsays to cancel the insurance, [redacted] informed me that it would take a few weeks for me to receive my money, but they claimed they mailed the check 4 days later. NO THIS ISSUE IS NOT CLOSED, NOT BY A LONG SHOT, IT WILL BE CLOSED WHEN LINDSAY RETURNS MY MONEY.

I am rejecting this response because: I still have not received the $695.00 that I paid to Lindsay Cadillac. I am surprised that what is supposed to be a respectable company as Lindsay would take me through these changes for six months without refunding my money. And regarding [redacted]' letter stating that their bank [redacted] investigated this claim, well if they did, they did not do a very good job of investigating. And his saying that the check was mailed to my address, doesn't mean a thing, I never received the check. How many times do I have to say, I DID NOT RECEIVE THE CHECK!!! They claimed to have investigated this claim in August 2013, but neither Lindsay or [redacted] Bank reached out to me with any information. If they know that the check was cashed at an [redacted] Bank ( I never heard of this bank), it seems [redacted] Bank would have a record of who cashed the check. I Never heard from them. I have been the one doing the calling and letter writing, they were not professional enough to answer my letters or my phone calls. So unprofessional, that's why I am not sure if that check ever left the Lindsay Office. Something is wrong. And I can say that perhaps the check was never mailed, because I never received it and all of the staff that I have dealt with at Lindsay Cadillac is so unconcerned, so not interested in my getting my money that I paid to them in good faith. It seems that [redacted] is only interested in this claim being closed, not in trying to satisfy his customers.

Review: I bought a used [redacted] 2008 from the dealership on Feb 24, 2014 for $18000.00 and I put down $6000.00. The dealer called me during office hours while I was at work that all papers are ready for me sign, I went to the dealership, didn't have time to test drive the car because my sales guy ([redacted]) told me everything is fine with the car and I believed him. I drove the car back to the office and on my way to the office I noticed a warning light came on about ESP 4 Matic and Cruise control wont work, I thought may be its a small electronic issue that will correct itself. Thats Issue #1.

Issue #2 - They gave me a full tank of gas when I picked up the car and I was going to use all to let me have an idea of how much I need to be putting in the car going forward. On Friday Feb. 28, I left work around 5pm with almost half full tank of gas according to the gas gauge and as I approached Exit 31 on Highway 495 right in the middle of 5 lanes, the car engine just shut off, the car behind me swerve to avoid hitting me and she got into an accident, I was shaking as I didnt know what to do, at this point, all vehicle passing by slow down as they noticed I was in trouble, I managed to pull to the side of the road and I called my insurance company, at this point, I didn't know the issue was the gas because the car is still showing that I have gas, but it look like the car is trying to start every time I tried. My insurance sent a roadside help after waiting on the side of the road in my car for almost 3hrs and in the cold. The roadside guy came and the car was towed to [redacted], the roadside guy at the repair shop check the car and said there is no gas in the car even though the gauge said otherwise. we went to the nearest gas station and put gas in the car and the car started. I went home after that, this was around 9PM at night. I took the car back to the repair shop to really give me the diagnosis of the issue and then they said that the GAS SENDING UNIT is bad, also something regarding the first issues and another issue making 3 issues total. I paid $162.00 to the dealer for the diagnosis and told them that I need to contact the place where I bought the car for next steps. the total repair cost was about $2500.00.

I kept [redacted] informed all that happened and he said to bring the car to their dealership that they will fix the issues. I took the car there on March 6 and thats where the problem started, they said I have to be responsible for the half of the repair cost because the 30 days warranty they offered says that clearly. I told them no and [redacted] the used GM said to look for another car to make a SWAP, at that point, I didn't see other car that I like, then we are back to fixing the [redacted], then they said they will fix only one issue and the other issues are mine. I refused. They gave me a rental car and when I got to the office, I found a car on the website and emailed [redacted] that I would like to SWAP the car, and then he said swapping the car is no longer an option. and now they will fix two issue and leave one. Their stands and story keep changing every time.

As of now, they will not fix all the issues. I thank God that Im alive today and also not in a hospital bed because what happened was really terrible. All the issues on this car was there before and there is now way I would have know even I test drove the car because they gave me a full tank of gas.Desired Settlement: I want all issue fixed, or swap me into another car or we to go court.
