Lindsley Lawn Care will not honor a refund of any kind for the services rendered to this individual The product and service that was provided to her did not contain any defects The client chose to maintain her own property/lawn after the product was installed and by doing so caused damage to her lawn starting in November She reached out to us following her attempt at maintaining her lawn and explained that her actions had caused problems and wanted our opinion and expertise on how to rectify In addition, the weather conditions of the following months had an impact on all properties in the area Lawns go dormant in the winter months We returned to over-seed the property two additional times at the clients request Each time it grew back in perfectly (as she stated in one request "could you work some more of your magic"), but was then damaged by a maintenance crew or the client As you can see from the following email correspondences we responded to the client timely and in a professional manner trying to help her correct problems that were clearly not caused by us In our opinion the individual or company providing the ongoing maintenance to her lawn, that ultimately caused the damage to her turf, should be responsible for repairing, replacing, or funding the replacement of the said product Lawn Was Installed In August of Client expressed how happy she was of the end product and how excited she was to have a back lawn space Nov8th From Client: I had to go out of town unexpectedly for a family emergency for a few weeksMy neighbor was going to put my lawn mower together and mow while I was goneOmg, I came home to an overgrown yard and a small patch destroyedI want to cry! I attached a pictureAnyway you could swing by this week with one of your lawn mowers and help me salvage my yard and maybe see why my lawn mower destroyed one patchI am afraid to try and fix it because I dont want to ruin the yard! Nov 8th, Our Response: Absolutely It looks like it jut got too long With that type of mower and the grass at that length it probably just wrapped around the blades as opposed to "cutting" It'll recover Thanks again, LAWN THEN WENT INTO DORMANT SEASON WITH HEAVY SNOW AND SOME ICE FOLLOWED BY NEARLY MONTHS OF CONSTANT RAIN April 2nd From Client: Do you have anytime this week that you could swing by and take a look at my back yard? It's growing like crazyMy HOA is supposed to come Wed to mow it but it looks like a yard of overgrown weeds and lots of patches with nothing really growingWondering what you might be able to do to revive it to get it back to how nice it was when you installed itI am free most of the week: all day Monday, Tuesday afternoon, Wednesday afternoon, Thursday morning, or all day Friday April 4th Our Response: Let me think about it for a bit There has to be a way to make it easier for the HOA guys Maybe putting in a border? You'll need to do a weed-and-feed fertilizer, and over-seed with a "shade" seed, & put down a lot of iron as there is no real sun back there to keep the moss away A lime treatment in the fall would have helped the lawn come back quicker this spring, but it was a strange winter, so we are doing repairs everywhere What do the HOA guys do? This will help me help you Do they fertilize, aerate, spray for moss & fungus, Cut regularly? Without knowing what they do, I'm unsure how to help? Thanks again April 5th From Client: All they do in the backyard is mow the lawnRight now it desparately needs mowed because they missed my yard the last few weeks but it should be getting mowed todaySo whatever you can come do to help repair/revive it, I would appreciate the helpIs there a time you can swing by and look at it? If I happen to not be home, my neighbors are fine if you go thru their yards as long as the gates get closed so no dogs get out April 7th From Client: I dont do any mowingMy HOA is doing it allThey mow every WednesdayI am fine with tomorrow but I have conference calls I have to be on for work throughout the morning so if you can come after Noon that would be the best May 25th Would you be able to swing by sometime and look at the back yard? It looks a lot better than it did but there are a still some spots not looking the greatestI attached a picture of one areaIf I am not home, it is ok to go through the neighbors yardI am not sure what the yard needs but can you come work s ome of your magic on it please Our Response was that it appears to be tire marks from the HOA cutting and turning their self-propelled mower in a confined space when turf may have been too soggy Following picture submitted to us from client showing and stating that she has not cut the lawn since installation in August and this is taken in November She then used a "reel" mower which ripped the lawn out damaging the root system.Following this event, we went into extreme cold weather for a couple solid months The following photo was submitted to us from the client in the spring when we came out of extreme cold, but then went into extreme rainfall She stated that this area was the area that she damaged in the winter It is confirmed by the appearance of the patio at the lower left of the photo We over-seeded the lawn heavily to repair from damage It grew in strong as she mentioned in one of her above emails "the lawn is growing like crazy" The above photo shows that the grass grew back strong, but was damaged by the HOA maintenance crew I mentioned above in a previous email that a border would help deflect the heat from the extreme edges We again over-seeded the lawn heavily

I am rejecting this response because: The company isnt providing 100% of what happenedI did NOT damage my lawn nor did anyone elseWhat he is failing to tell you is:1) He never told me up front that work isnt guaranteed unlesshe maintains itThis was told to me almost a year later.2) The one small area that was damaged was NOT done by me but by a neighbor when I was outThat isnt a point of this, as it is one of the ONLY areas that is surviving.3) Numerous times I reached out to him by email, he never responded for at least a week and in some cases up to a month later.4) I followed ALL his instructions on how to maintain the yard.5) When he did the job he originally said putting in the wood was neededThen later said it shouldnt be dying off because of the woodThen later said well the heat from the wood will cause it to die offThen later says a simple to inches of bark dust would have prevented itSo did the story change multiple times and whg didnt he recommend the bark dust when giving me the estimate.5) He tells me end of that the lawn will revive after winter and if it doesnt by end of March to contact himSo I didBut he then tells me a simple lime treatmemt would have helped over the winterSo why wasnt that told to me when I talkes to him end of 2016.6) When I asked where his contract and policies are he says he shouldnt have to provide common senseWhat kind of professional says that. The comlplaint isnt solely about the grassIt is also because of poor business practices, conflicting information provided, failure to respond timely and mutliple times of not showing up when he said he wouldIt is also because I tried to communicate to come to a resolution and he flat out refused to and showed nothing but disrespect
