Lindy's Leased Parking

I live at the Heritage Apartment complex. The complex just implemented a new parking permit policy. On the evening of 12/13/2014 my family came to visit including a cousin who uses a mechanical ventilator to breath through the tracheotomy in her neck. I had them drop her off and park in the proper visitor parking space. When it came time to bring my cousin back to the car we pull the car directly in the front of the building and brought her outside. Within the 5-10min of us picking up her supplies and walking to the car the company put a boot on the car. I called the company to tell them what was going on and they sent the worker back out. Once they arrived they refused to remove the boot without payment. I tried to explain the situation and the fact that her oxygen tank was running low and she needed to get home for another one. I also explained that she needed to be plugged into the power supply of the car. They refused to remove the boot even after my explanation. I tried to call the office but they refused to agree to remove the boot without payment. During this conversation the guys drove away. I called back to the office and the guy tried to act as he did not know what I was talking about, but dispatched the guys back out to this care. After all of this we were waiting over 20mins to get things settled. Due to the medical acuity of the situation and the fact that the police would not become involved with a parking situation I was forced to pay the bill so that my cousin could get the medical care she needed. I find it completely unacceptable that they would put a person at risk like this. And the guys told me the only way she would get care was for me to call the ambulance, which was completely an unnecessary thing in this situation. All she needed was another oxygen take, not exposure to multiple sick ppl in the hospital during flu season.Please keep in mind that I use a power wheelchair as well and had to stand outside in the freezing weather to deal with this matter.Desired SettlementI would like to be refunded the $75.00 fee associated with this boot placement.Business Response Contact Name and Title: [redacted]Contact Phone: [redacted]Contact Email: [redacted]Our business impounds cars that are illegally parked or do not have the correct permit that is required in order to park in an area. It does not matter if the vehicle has been parked in the area for 5 minutes or 5 hours, all vehicles that are illegally parked, are impounded. In response to the complaint, we have met and both parties have come up with a solution. We were hired to enforce the parking policy of the apartment complex.Consumer Response After meeting with the owner of Lindy's Parking we were able to come up with a solution that was amenable to me. Although the owner never would admit fault in this situation he did express understanding that some cases have to be dealt with in an individualized manner. I impressed upon him to further train his workers (even if they are working for commission) to use common sense and good judgement in situations such as the one that occurred with my family. I still stand by my initial assessment of the situation however I will say that the owner did impress me with is level of sincerity after receiving this complaint. Though I hope to never have interactions with this company again I cannot say that the owner is a terrible person. Final Consumer Response
