Review: Mr [redacted] of Lions and Associates, LLC, was hired by a local vendor I use to recover a current bill (10% less than 45 days old, 90% less than 30 days old). Mr [redacted] hired a local private investigator to 'investigate our vendor, client, and banking relationships', who for some reason contacted me first to tell me he was going to do this, and left Mr [redacted]'s name. I called Mr [redacted] back to find out what the bill was / who it was for, and during the first conversation Mr [redacted] was only mildly insulting as he told me what the bill was for, an account that was not even past due. I told Mr [redacted] I'd call him back from my office the next morning when I had the documentation in front of me. When I called back the next day, Mr [redacted] persistently yelled and insulted me, told me how he'd freeze our bank accounts if we didn't pay in full, plus an additional $3000 That very day, and would direct his investigator to be as 'disruptive as possible' in his investigation, to ensure that 'You and [redacted] have to find another line of work because of this'. I offered repeatedly to make a payment arrangement to pay the bill in full within two weeks, but he said that he was directed to 'punish as much as collect', and that I should 'just take the punishment you have coming like a man'. When I told him that he needed to lower his voice and speak respectfully to me, he said 'Well sir, you're in Oregon, and I'm in Louisiana. When I raise my voice, you wont need your damn phone.'After the conversation above I contacted and left a message with the vendor to work out a reasonable arrangement, told the vendor of the unethical and illegal practices his agent was using, and was promptly contacted by Mr [redacted] again to tell me that I was not to talk to the vendor under any circumstances. I called my lawyer then and she confirmed that I am in the right on this matter and we will be bringing a civil case.Desired Settlement: Our council believes Mr [redacted] violated several laws in his handling of this issue, and was at very least extremely unethical in his handling of it. We will be pursuing legal recourse, but I believe at very least a strong apology and a dismissal of Mr [redacted] would be required.

The complaint of being unethical, insulting, foul language and breaking laws is a complete fabrication, Mr. [redacted] is an officer of a company that we are proceeding against on behalf of a client as a commercial collection issue. Lions and Associates does have an investigator conducting an asset and liability investigation on Cannibal Mountain Logging LLC and Mr. [redacted] as the signer of an NSF check at the request of our client to determine whether or not there are sufficient assets to warrant legal proceedings and to determine if commingling of corporate assets is present to also pursue of the shareholders individually. [redacted] offered a resolution for the worthless check in question to be paid off with a payment plan for the other balances and Mr. [redacted] refused to discuss the situation, became irate, terminated the call then Mr. [redacted] began sending our client numerous text messages that could be construed as harassment. Mr. [redacted] also mentions his unknown attorney that will be filing a civil action against Lions and Associates which any such action will be met with an aggressive counter-suit for frivolous filings in addition to the dilemma his company is already facing, further we take slandering our companies name very seriously and it will be dealt with accordingly if it continues. Additionally Mr. [redacted] is not our cus[redacted]er and should not be filing a "Cus[redacted]er Service" complaint. Lions and Associates has in no way acted unethically nor have any laws been broken.

As such we ask Mr. [redacted] to retract his complaint and deal with me personally to reach a resolution if he does not wish to deal with Mr. [redacted], and I hope that he understands that we are reasonable but cannot help him unless he allows us to.

For transparency purposes I have attached our notes as well as the notice of intent that was issued to Cannibal Mountain Logging.

I have reviewed the response made by the business in reference to complaint ID 10151102, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

The company's response is completely fabricated, and does not make any sense whatsoever given the context of the situation. I did in fact maintain my 'cool' throughout my interactions with Mr [redacted], even when he was cussing and yelling at me, and going far out of his way to find ways to personally insult me. He also made very clear that his direction was to punish me as much as recover the current bill for his client. At no time did Mr [redacted] offer a settlement or payment option, but rather cussed at me when I suggested one. Mr [redacted]'s only offer was that I pay the bill in full, plus an additional $3,000, within a matter of a couple hours, or they will 'make sure that you and (my wife) need to find a new line of work'. I repeatedly offered to set up a payment arrangement in which I would pay the NSF check basically immediately (within a matter of a few business days), and the rest of the bill well within it's due date, and Mr [redacted] rejected every offer of this, and continued to cuss and yell and insult, and tell me to take 'the punishment you have coming' if I didn't pay his exorbitant sum within hours. After the third conversation in which I had to simply hang up since he would not stop yelling and repeating himself over the top of me, I conferred with my attorney, and she assured me that Mr [redacted]'s actions were in direct violation of both state and federal laws, and that basically nothing that he said even made any sense, and that if any conference with our vendors, clients, or banks occur beyond getting our contact information, which this firm obviously already has, it would constitute interference with a business relationship, which would open the firm up to legal liabilities which she would be comfortable and confident in pursuing. As Mr [redacted] indicated that he would not only direct his investigator to contact the above mentioned parties, but also said that he would direct him to be 'extremely disruptive' in his 'investigation' of our business relationships, my mention of these liabilities he is taking on for the firm is in no way slanderous, but simply very accurate. I am indeed the insulted and harassed party here, and will pursue whatever recourse I need to protect myself and our business from these unethical and illegal practices being conducted by Mr [redacted] of Lions and Associates.

Furthermore, my text messages to Mr [redacted]'s client were in no way harassing, they simply politely made him aware that his debt collector was conducting unethical and illegal practices on his behalf, and directly indicating illegal intent on his behalf, and I offered that if he'd like to promptly settle this matter and get paid, I would like to speak with him. In response I got yet another threatening and aggressive phone call from Mr [redacted].

Being that apparently this firm has issues with truthfulness, maintaining professional decorum, and legality, I am not inclined to speak with any of its officers without legal counsel being present and recording of the conversation so as to avoid this 'he said, he said' blasphemy that we are apparently currently confronted with. In fact, if the firm is so set up, I would challenge them to provide me with a recording of my conversations with Mr [redacted], and show me where he acted professionally or even legally, and where any of their claims of settlement offers, etc, in their response email were made.

Additionally, at no time were we as a company or individuals issued a notice of intent.

My response has not changed however, It may please Mr. [redacted] to know that we will conduct a full internal investigation of the alleged misconduct and if it is found that Mr. [redacted] did in-fact behave outside of our Code of Professionalism he will be terminated. I would like to point out that collectors and their respective agencies that utilize illegal practices typically have several negative comments and reviews all over the internet. The fact that this is the only such complaint we as an agency have had and [redacted] as a collector has had should speak for itself. I have personally worked with [redacted] for over 15 years and have never once witnessed him acting this way and although he states he was firm (which it is his job to be firm) with Mr. [redacted] he admits no misconduct. My belief is that this is an attempt to derail the proceedings against Mr. [redacted]'s company and it will be dealt with accordingly. Our attorney in his jurisdiction, Mr. [redacted] will be sending out a Jurisdictional Notice of Intent and I will leave the door open to negotiate am amicable agreement (pre-litigation only) either with Mr. [redacted]'s attorney or Mr. [redacted] himself and I will give permission to record any such conversation. This matter can be easily resolved if Mr. [redacted] allows us to have a reasonable conversation, if he continues to close the door he is essentially forcing our hand which will require us to become "legally" aggressive in protecting our client's rights. Please advise Mr. [redacted] that we are pleading with him to reach a voluntary resolution and that his complaints will not delay the inevitable.
