Dear [redacted],
Before registering both parents were informed both verbally and in writing that their security deposit was non-refundable and if for any reason they did not complete the school year it would not be returned. We have a signed contract to that effect on file. The policy is in place to give us a month to find a replacement when someone decides not to fulfill their commitment. If you have children, then you are aware that registration happens at a specific time of year and once that time has passed it is very hard if not impossible to find open preschool classes - this goes for finding students as well. Once registration season has passed we can go months or even the whole year without being able to fill an opening. We held a spot open in their requested class for multiple months (I believe 6 months), turning away other applicants. Then a little over a week before the program was to begin they removed their son from the class. In the incident in question their son took a toy from another little girl. In an effort to get the toy back that child grabbed the back of their son's shirt at the collar as he walked away. This was not a "attack", it was simply two young children that are still learning how to share, take turns and appropriately interact with others who both wanted the same toy. These are just the skills that all 2 and 3 yr olds are working on perfecting and one of the reasons why we offer the class. The teacher witnessed the incident and took action to stop it from continuing. The whole thing only lasted the few seconds it took her to cross the room. While it is unfortunate that their son was scratched on the back of his neck by the other child's untrimmed finger nails it does not turn the incident into anything more than a mild disagreement over whose turn it was with a toy. Not taking turns and wanting the same toy are normal behaviors for 2 and 3 yr olds. [redacted] emailed and said she was concerned about her son and the other little girl continuing to be in the same class. I offered to move her son to another class that was held on the same days and at the same time for the same monthly tuition. At this time I reminded her that she would lose her security deposit should she decide to drop the class. A few days later on 8/22/14 she dropped the class with full understanding that her security deposit was non-refundable. We have been in serving the children of Loudoun County for almost 9 years with the same policy and this is the 1st and only complaint we have ever received.
Thank you,Karlene B

I am rejecting this response because: her assertion that my son received a mild scratch is totally and fully inaccurate.  He has a scar to this day.  When I brought this to the school's attention, I was dismissed summarily.  If the school cannot provide a safe environment, I believe their refund policy is null and void as they are not honoring their end of the agreement.

Review: My three-year-old son attended Little Sprouts Preschool in [redacted], VA. He was attacked by another child in his class repeatedly. It got to the point where he would ask, "Is (she) going to be there today?," referring to the other child. When my son received scratches on his neck that resulted in scarring, we decided to remove him from the class. The school takes no responsibility for the lack of oversight on their part and now refuses to return our deposit, going so far as to say scratching that results in immediate bleeding and long-term scarring is "normal toddler behavior." While I appreciate that children will be children (I have two of my own), I cannot allow my children to be in situations where their health is jeopardized and do not understand how we can be held financially liable for the school's poor performance.Desired Settlement: I request the return of my $450 deposit. We removed our son for his safety, both physical and mental. I can neither have my son hating/fearing school while he's still in preschool nor allow him to be physically attacked repeatedly while the school does nothing to intervene.
