Initial Business Response /* (1000, 10, 2015/10/19) */
This is a response to a complaint made by [redacted].
In regard to the previous ownership of the vehicle, we purchased the vehicle from Advanced Remarketing Services and to the best of our knowledge it was only owned once.
When Randy...

spoke to the customer he relayed the fact that the previous owner had inadvertently checked a box on the title when they signed it about the mileage not be accurate. That does happen. Randy had a conversation with the new owner about the box that was checked on the title at the time of sale.
The mileage on the Bill of Sale from Advanced Remarketing Services states the mileage as 84,999 and at the time of sale it was 85,023.
Furthermore, Mr. [redacted] has had no other contact with me regarding any concerns since the time of the sale.
We cannot scan the document so I will be sending it directly to your office today with a copy of this statement.
Initial Consumer Rebuttal /* (3000, 13, 2015/10/20) */
(The consumer indicated he/she DID NOT accept the response from the business.)
In the business' response there is ultimately no logical defense of anything with which I had a problem. Saying "to the best of our knowledge" doesn't excuse the fact that they were wrong about previous ownership and falsely advertised the car. People could just sell anybody anything under false pretense and just say, "to the best of our knowledge..."
As for the mileage, just because sometimes people check the wrong box doesn't mean that the previous owner of this particular vehicle did so. The fact that Randy said that they did without any factual knowledge of their doing so is irresponsible and inexcusable. The Bill of Sale from Advanced Remarketing Services said the mileage was 84,999 because that's the odometer says. Repeating what the Bill of Sale stated as the mileage is pointless; I can read an odometer myself.
Again, the bottom line is the previous owner checked the box indicating that the mileage on the odometer was not accurate and then within 2 days of buying the car the odometer stops working. Randy told me they checked the wrong box, but he didn't actually know that. Based on his immediate reaction and puzzled look he hadn't even noticed that they had checked that box before advertising the car as having 85,000 miles. Before advertising a car as having one owner, one should make sure such a statement is actually true, it's not difficult nor time consuming.
I haven't contacted Randy because I feel like it would be pointless. He has already lied to my face, so I just don't feel that a phone conversation would get me anywhere. The business' response is wholly unsatisfactory and I still want compensation for what I feel was being taken advantage of and misled. At the very least, to start out, I would like LMB Recovery to present me with a Carfax report. Then I can get a better idea of mileage and previous ownership. I will ultimately go to conciliation court if necessary.
