The business still has not explained why they added an additional fee the day they received my payment. Back to the original information I sent documentation of, I paid my balance in full by the date of the invoice. I submitted a copy of the invoice and the cancelled check that they cashed by the due date. Based on this, I should have had a zero balance, instead they have charged me about $in fees including $for a lien they placed on my property for an account that should have had a zero balance. Their business practice is unethical - you can't charge someone late fees on a current account along with lawyer fees for an account that was paid. Also, they continued to charge late fees on this account when I was questioning the balance and asked for an explanation.

As I've already provided, I paid this by the due date on the notice I received. I have sent a copy of the bill and cancelled check showing it was received and cashed by the due date. If they sent an inaccurate invoice not including the total amount, that is an error on their end and should not be charging me additional late fees. Also, they filed a lien on my property for money I already paid. I don't understand how a company can get away with randomly charging someone and adding late fees for a balance they did not even request. I paid the total mount due of the invoice. As you can see from the communication from the lawyer, they sent me a bill of $due by the end of March 2017. I paid $on March 17, 2017. Also, in the response it says that my balance is now $but if you look at the paperwork they submitted, it now says $645. They are inaccurate and fraudulent in their billing practices. They continue to charge me late fees even though I am disputing this balanceBased on their communication, they are saying I had a leftover balance of $that they charged a late fee of $and then put a lien on my property charging me an additional $250. This is extreme and should not be legal. I have tried to contact the company requesting this amount at the very least be reduced and was told that "Chuck" would probably not do that as it was sent to the lawyers. I should not have to pay $because they sent me an inaccurate invoice. Thank you

In response to this client's complaint.... LMI Construction and Maintenance is currently in contact with this client and working toward a resolution In all fairness to this client's complaint, LMI has been out to the property two times to further assess the situation It is our
opinion that the source of the problem is unrelated to any of the services provided to the client thus far An estimate to resolve the problem was forwarded to this client at 1:p.mon Friday, August 25, This was not a reactionary or knee jerk reaction to this complaint as it had not yet been received on our end.To this client's point, LMI was delayed in getting her an estimate for a new door But, once our Estimator was allowed ample time to research a replacement a door, three options were provided, and it has been offered to redo the original work at no cost Butwe are convinced that the work initially done is not the source of the problem We believe the actual door is the problem

I think it best to start to from the beginning.  This entire process started November 16, 2015.  After a great deal of back and forth via texts, e-mails, and phone calls to the client, LMI presented a Contract to the client on February 15, 2016 for a complete bathroom remodel.  We...

were initially informed that the client's budget for this bathroom remodel was $8,000. It was explained to her that her "wish list" for the bathroom would far exceed her $8,000 budget.  The client increased her budget to $10,000.  After researching the client's "wish list" our Estimator presented the client an estimate for $12,034.00 on February 15, 2016.  Please note that the estimate presented was very thorough in terms of job scope and materials (a copy of this estimate has been sent to the Revdex.com for verification).  A product called Hardi Backer Board was included as part of the estimate and specifically stated in the Contract.  Hardi Backer Board was to be utilized on the walls where tile was quoted to be installed.Over the next few days, a serious of text messages between our Estimator and the client ensued.  LMI does not deny the client's claim that due to "budget" constraints, she wished the project be done in phases.  Her texts do reflect this, but in the text thread, she also says..... "I want the bare minimum to be able to pass my inspection for a VA Loan....".  This text thread happened between 2/15 and 2/18, and was interpreted by our Estimator as a "bare mininmum" estimate to pass inspection.  At this point, our Estimator presented a revised Estimate on February 19, 2016 in the amount $3,349.00.  Our Contract clearly states "Fix Violations In Master Bathroom" which is far different from "Putting the Master Bath Back Together".  The revised estimate clearly states that drywall is to utilized throughout the bathroom.  Furthermore, the bare minimum quote did not include any "finishing" work (tape, mud, float, sand) of the drywall.  The materials are up, but currently remain unfinished as was clearly stated in the estimate as requested by the client.

"I want the bare minimum to be able to pass my inspection for a VA Loan....".  This text thread happened between 2/15 and 2/18, and was interpreted by our Estimator as a "bare minimum" estimate to pass inspection.  At this point, our Estimator prepared and presented a revised Estimate on February 19, 2016 in the amount of $3,349.00.  Our Contract clearly states "Fix Violations In Master Bathroom" which is far different from "Putting the Master Bath Back Together".  The revised estimate clearly states that drywall is to utilized throughout the bathroom.  Furthermore, the bare minimum quote did not include any "finishing" work (tape, mud, float, sand) of the drywall.  The materials are up, but currently remain unfinished as was clearly stated in the estimate, and as requested by the client.The job commenced February 29, 2016 and was completed on March 9, 2016.  Upon completion, the entire job was reviewed by the client and final payment for services rendered was provided by the client on March 9, 2016.  On March 25, 2016 (16 days after completion) the client contacted our office and stated that LMI technicians had scratched her hardwood floor in the hallway, and that the wrong material was installed on the walls of the bathroom.  She said she had "a friend" tell her that drywall was not a proper application for the bathroom.  Her "friend" contacted our Estimator and said that he is "pretty sure" that drywall is not code for the city of South Russell.  For the record, LMI contacted the Building Department in South Russell to make certain that drywall was an acceptable application for a bathroom, and it was confirmed that it was.Her accusation that LMI did nothing to protect her home (hardwood floors in particular) is completely untrue. It is standard operating procedure to put drop cloths down on hardwood floors to protect them against scuff marks while bringing in materials.  Drop cloths were administered daily, and picked up at the end of each day as part of the clean-up process.After her initial complaint(s) were received, our Estimator and our VP Operations met the client on-site to review the areas in question.  Her calls or texts never went un-returned.  In fact, our office tried to schedule this on-site meeting several times, but we couldn't leave a message because her voice mail box was full.  The client is right on point when she states that LMI offered to repair the hardwood floor.  It was specifically stated to her that LMI is NOT admitting fault, but as a matter of "good faith" we were willing to buff out the scratches at our expense.  Futhermore, LMI was also willing to remove "some" sections of the drywall and replace it with either Cement Board or Hardi Backer Board, but not the entire bathroom.  Again, this would be done at no further expense to her.  In conclusion, LMI rests on the fact that a "bare minimum" estimate was provided and executed by the client. LMI executed every detail in the fulfillment of this Contract, and was absolutely willing to make adjustments after the fact at our expense.  The entire text thread between client and LMI is available for viewing upon request.  There are also before and after photos available for viewing upon request.Respectfully Submitted by:Richard J.
