We have stated our positionWe are not refunding anything Nothing in our gym has changed since [redacted] signed up Our gym hours have not changed so he knew what was available at sign upHe can still use the club any time he wantsI cannot refund every time someone changes their mind--cable/cell phones do not let you break your contract just because you changed your mind He should have looked at other options before signing up for a year We have many different options he could have chosen if he wasn't sure about schedule or whatever

I reject this offer because I did not sign anything stating I was aware of the no refund being issued and the fact a sign was there and I was not aware of it until they brought my attention to it after I requested my refund does not seem legal or ethicalI see this as a contract issue and unless I signed a physical contract acknowledging my understanding of this policy I see this as me paying for a service in a term that I did not contractually agree toTherefore I continue my position of requesting money owed to me

He can still use the club any time he wants. I Never signed a contract that stated no refund would be issued. It is the policy of the Locomotion Fitness Center to not give refunds on prepaid memberships. There is a sign posted at the front that reads "REFUNDS ARE NOT GIVEN ON PREPAID MEMBERSHIPS, MONTHLY PAYMENTS, TANNING PRODUCTS, TANNING PACKAGES OR SWIM LESSONS.  Thank you, the Management". ...

All members are told that their membership is NOT based on the amount they use the facility--they can use as much or as little as they want.  We are open from 5:30 am in the morning until 9:00 pm which is ample time for a person to use the facility.  I cannot control someone's schedule and I do not think that this is a legitimate reason to break a contract (we offer a lot of different options that he could have chosen instead of doing a prepaid).
