Attached is a copy of the paid in full statement that was mailed to Mr [redacted] August 31, with his labor warranty

Mr*** called in and paid the original portion of the contract and stated he would decide if/how much of the supplement he would pay We have submitted a revised statement to Liberty Mutual noting the original contract amount and payment.A paid in full statement will be mailed with the labor warranty to Mr***

We are in receipt of the complaint filed by *** ***The cost of the roof was not misrepresentedIn fact, it is clearly stated on the contract signed by our representative and Mr***We did not lie to get anyone's businessIn addition, Mr*** was not told he would "be getting
money back." Mr*** does however owe us $1,Regarding the statement that we "began to immediately adding fee and charges," the only fees added were finance charges on the past due amounts as provided for in our contractThe account is over days oldAs for the allegation of rudeness on the part of our staff, I highly doubt it as they are trained that interaction of that type never results in a positive conclusion.We intend to pursue collection of this accountWe have offered to work with Mr*** on a payout or will accept a credit card payment for the balance and waive the the finance charges

I have consulted with several roofers and all have made the determination that all decking should have been replacedThis home is years old wood will rootI am not an expert but I have to believe the roofing company are the experts or just storm chasers trying to make a buck

Mr*** has admitted the company undisputedly pulled my creditHowever, he fails to address the reason whyI have received many reasons from company representatives Reasons stated, "we thought it was a cash transaction," "it was the color tile you wanted, " "you would be amazed how many people do not hand over the insurance money to us."In my opinion, none are satisfactory answers especially in light of the company not giving a disclosure and/or permission from the homeownerIn addition, a roofing company pulling a homeowner's credit in a situation where the payment of the roof is covered within an insurance claimI have talked with my insurance company, along with my lender, neighbors that are former customers of Lon Smith, other roofing companies, and insurance salesman, all have agreed this was a red flag to end whatever said agreement with Lon SmithInterestingly enough, those same neighbors denied having their credit checked as a part of an insurance claim roof replacementThis is most upsetting and even endorses further that Lon Smith has discriminatory practices in dealing with certain clients.To provide some background information pertinent to my case, my insurance company writes a check to the homeowner and the mortgage lenderThe check is then placed in a frozen account and released in thirds and only after suitable inspections made by the bankI, as the homeowner, never have access to the money let alone have the ability to use for personal useThis makes the excuses by Lon Smith not plausible.I understand that screening some potential client's credit is an acceptable practice to Lon SmithI also understand it is the culture from top down in the company My goal is to expose it to the general public and any potential licensing body of roofers in Texas because at this time there is none as well as expose their unethical business approach and altogether backhanded marginalization and discriminatory practices of some but not all clientsI would also like to emphasize that within their faulty business practices they invade the privacy of clients, expose their financial information to potential fraud, and do not have a disclosure listing written reasons for credit being accessed or permission of homeowner.I would suggest Mr*** to reread the Fair Credit Reporting Act and specifically the appropriate uses and access of credit information of consumersThe company has made a serious violation of the Act

The decking, at the time of installation was in serviceable condition. In reviewing thefile, neither Lon Smith Roofing or the insurance adjuster noted comments pertaining toreplacing the decking at the time of the installation. We cannot attest to the condition ofthe decking seven (7) years later.
