First of all *** *** is no longer associated with our companyWe the members of the LC have reviewed the file and you find copies of correspondence from our company
Also we have made several
return trips to the job site
On one occasion there was water standing on the flat roof and there was no leaking inside the room or flat area
As mentioned and described before the roofing above the flat roof has some areas of shingles that appear to be in poor conditionAgain, as explained before any leaks from above the flat roof could run under the flat roof and appear to be leaking on the flat roofbut the leaks are coming from another area of the roof above the flat roof
The only solution to solve the problem when we have these severe storms is to replace the entire roof area above the flat roof
The above entire roof option was offeredsee enclosed copy of proposalWe are in no position to install a new roof free of chargeThe flat roof and chimney flashing was the main work done on the original agreement
We offered repairs in stages and then complete replace entire back roof area, and then after several return trips and service calls after the fact we repeated a revised proposal to do the entire back of the roof
In almost all cases we refuse to just do a lower flat roof without doing the entire roof for this very reasonPeople do not understand or they do not want to understand the issues

This complaint has not been settledBarney's did return but the porch leaked on Aug 7, 8, and 10thThe leak on Aug was worse than before we contracted Barney'The quote to reroof the entire back seems to be out of line with what others have told us and we cannot help but wonder is Barney's is waiting for us to use another company so they can just walk awayIf they just want to do the lower roof why did they quote and take the jobWe are considering all our options

We have dozens of pages of correspondence concerning this customerA roof installed in Over several years and months we addressed different problemsThe main problem was a defective chimney and furnace ventAlso
during this time a major ice storm and ice daming was a problem on most all roofingWe made numerous trips out to this residence including taking flashing materials loose and inspectionsWhat we did find was a defective chimney and furnace ventWe even went to the extreme procedure to tarp the chimney to prove that the problem was not the roof but rather the chimney
The issue on this complaint deals with so-called defective Tamko roofingWe do not warranty the building materialsThe manufacture company would do thisEach roof has a written warranty between the consumer and the manufacture companyIn this case it would be Tamko
We have no specific knowledge about the class action suit on TamkoWe do know that on the internet all roofing company manufacturing companies have had suits filed for various reasonsWe do not believe that Tamko produces defective materialsThey may have had some but we have not had personal knowledge nor have we been a company to do replacement work for TamkoWe have seen a couple of cases in the last years concerning color match or stainsbut that is the extent of what we have seenWe have installed hundreds of roofs with Tamko, Certaineed, GAF,IKO,BP, Fry, Owen corning, and othersIf and when a defective material issue arises we are out of the loop concerning any correctionsWe understand that the warranty manufacturing company issues a check or coupon for the consumer to purchase new materialsAgain that is our understanding we have not control or personal experience on these issues
Just like the auto industrywith this issue are the agencies in position to tell all of their consumers about all of the recalls and defective products? We do not believe any reliable company would knowingly sell defective materialswhich of course reflects directly upon thembut the legal responsibility is up to the consumerand in this casethe so called inspector or whomever should be the person or company that would file the complain for the consumer
If we ever come upon what we believe to be defective Tamko shingleswe would notify Tamko with the details and proofUsually that would require samples, photos, and details concerning the problemThis is so rare we have not done with or times in our history
We are not in any position to do any further inspections or communications concerning this complaintWe would recommend contacting Tamko Roofing company as per their Factory WarrantyWe are sure they would respond according to their warranty

Letter was issue to Barney'sThis contract and complaint is with Barney and Company LLC

Enclosed see copy of front and back of contract
Contract was signed and copy left with Claimant
A few days later she called and wanted to cancel the contractThe contract calls for cancellation to be made within hours as per Missouri law.This was not doneWe requested this several times to her, her daughter, and son-in-lawIt was finally done about days laterThe Items on the contract were 90% special order products-non cancellable and non-refundableWe agreed to ship the special orders to herbill our cost for those items and refund the differenceThis was done and a signed agreement was receivedAgain see copies
Fact of the matter we did not nor does the law require us to do anything as far as making any special dealsWe did this for their satisfaction
The son in law came in and said that we were about *** too highwhich is an insane statementAlso they said they other reason for cancellation was they had to spend over *** on a pet at the vet's
We find this hard to believe but we try to be fairwe are now out the cost and overhead with no payment to cover these costs
We have gone beyond anything required or even reasonable
Our files are closed on the subject
We are faxing copies so you can fax back to us that you received our replyIn the past we have had a problem with communicationssaying we did not respondso we want to be sure the files are correct and the history of our company and any complaints is clear to anyone

Reply to a complaint filed by Mr***According to our sign contract/proposal all return calls involving questions on defective workmanship are subject to a service call trip chargeThis charge in no
way covers the costs of the time and return tripIf we find defective workmanship or items missed or not finished as per our proposal there would be no charge for return trips
We sent the field supervisor that installed the products in questionWe took the siding panels loose and showed Mr*** that in fact the custom work was done properly and according to factory specificationsOur supervisor ask Mr*** why he questioned our workmanshsaid that he had someone look at it and they told him we had not done the work correctly-that somehow they apparently could see what was done without taking materials loose to see the actual flashing behind the sidingIt would appear that would be impossible unless you have x-ray vision
We are sending an invoice for the trip charge for the amount $less a discountWe understand that it is not popular to charge for trip charges but we have an expense for the mileage and the hourly wage including insurance, time, and overheadThe original contract was for This job involved hours plus materials for installation and the initial inspection time agreement paper work

The supervisor did not take anything loose but just looked under the j trim and said he did not know how water was getting into the flashingHe said that it could be going under where the two panels of wrap that come together in the middle but it couldn't get to the wood because there was caulk under the wrap but not up the edge because he didn't want it to squeeze out of the edge and make a messHe suggested that I caulk the top of the trim when it dries out, it was two wet to do then because it rained the night beforeI did not know how he did the repair the first time, but kept getting repeated water under the wrap everytime it rainedThis was frustrating because I paid for a repair that was still giving me problemsI made several calls to explain that I was still getting water under the flashingI was ready to have the job redone by another company that came out and looked at itThis supvisor did nothing but tell me how he did the job the first time and took nothing loose from the house, his suggestion that I caulk the top of the wrap after it dries and I said I would*** told me he was going take it apart to find out why I was still getting water under the flashingHe did nothing but explain how the job was done and I accepted his reasoning and suggestion to caulk the top of wrap when it dries outWhy am I getting another bill for him explaining how the job was done the first time

The rebuttal statement is telling me that the supvisor pulled the siding out of the j trim and pointed out to me the new custom trim that was installedHe did nothing but stick his head up close to siding and looked behind it and said "I can see the trim going up the side of the wall"I put my head against the siding and tried to see what he did and I described to him what I saw and he said that was the trim behind j channelIt was difficult to see the trim that was installed because you could only pull the siding out so far to look behind itHe did not take the siding apart or out of the j trimIt had rained the night before and he suggested I caulk the area where the two panels overlappedI had a discussion with the supvisor about water getting under the panels that overlapped and asked him why he didn't caulk closer to the outer seam, and he said he didn't want it to make a mess squeezing it outI told him that I would do as he suggested and caulk it after it driedHe could of wiped it off dry ahd caulked it for me and saving me $The contract says no charge if they find the problem to be caused because of something they didn't doI have since caulked this myself and no more water getting under the trimThis is what I paid the first time to have done right, but it cost $to have him suggest that I do thisWhy don't they hear what I am saying, he failed to caulk it properly and it cost me another $This is a big deal and is not good customer service but makes them extra bucksThis makes customers go else where for repairs they don't have to pay twice forI would like a refund of $that I paid to correct his mistakeIt is only right! I don't intend on using them for any more repairs because of having to correct their mistake and having to write them another check for their mistake

RE: Complaint and Service Call Charge 2nd Response
On 03/24/our supervisor went out pulled the siding out of the "J" trim over the garage door opening to expose the new trim work (this is "taking the siding apart") and showed the customer that the new custom made trim was made and installed per our contractMr*** stated that another company had done the same and told him that it was not done as stated in our contract, but Mr*** also stated that he did not look at the trim work to see if it was done per our contract and took the other company's word for it
When our proposal was made it was explained to Mr*** that the existing trim work may not be the only point of entry for the water infiltration, since there is a wall of siding above the garage areaThere was no expressed warranty given for this repair, and our contract specifically states, "a reasonable service call and trip charge apply to provide purchaser for any requested warranty service or inspections." This is why a discounted service call charge was charged
Mr*** states that he made several calls for us to make a return trip, in which we have no record except for his call on 03/09/When he was asked why he had not called sooner, since the repair was completed on 1/24/and there had been substantial rain (including the 9" to 10" rain late December 2015) and he stated that he had, but we have no recordOur records show that he did call several times after his call on 03/09/and we returned his call as soon as we couldMr*** stated that he was upset because he could not talk to someone at the time he calledMost field reps are out during the day and we try to make return calls as soon as we canWe keep a "call log" of incoming calls and this is the first record we have of him calling us after the repair
Our supervisor did explain and show Mr*** what he did regarding the repair and that it was done per our contractIt was explained to Mr*** regarding the discounted service call charge and he stated that he didn't like it, but would pay for it, and he should have read the contract better
