Thank you for your correspondence outlining the complaint you received regarding the purchase of [redacted] Laurel, Maryland 20724 by [redacted] ***. Please find attached a file regarding this specific complaint which was filed previously by Mr. [redacted] with the Maryland Real Estate... Commission.Mr. ***, who was represented by an agent from another company on this transaction, was the buyer on the [redacted] property. The agent at Long and Foster Real Estate, Nicolas M***, represented the sellers of the property. Mr. ***’s buyer's agent was not present for the property inspection, not present for the final walk through to determine the condition of the property before settlement, and not present for the settlement on the property. Additionally, Mr. [redacted] was not given a verbal guarantee about the condition of the flooring installation because Mr. M [redacted] was not involved in any way in the installation of the kitchen floor. In fact, the floor was replaced while Mr. M [redacted] was out of the country and well before Mr. M [redacted] was engaged to list the property. This is all fully reflected and included in the response to the real estate commission complaint response given by Mr. M [redacted] to the MD Real Estate Commission.Mr. [redacted] is expecting that the seller's real estate agent, also an observer of the condition of the floor at the time of the pre-settlement inspection, would know the condition of the sub-flooring installed beneath a ceramic tile floor. That is just not possible or plausible. At the pre-settlement inspection, Mr. [redacted] was in the presence of the seller who had hired the flooring installer, and who he could also ask about the condition of the flooring. Mr. ***’s concern was one floor tile at the time which the seller addressed by giving him a $500 credit.I am very sorry that Mr. [redacted] is not satisfied with the amount of money he agreed to accept from the seller as compensation for his concerns regarding the flooring. It is most unfortunate that he did not accept the advice and advocacy of his buyer's agent. Mr. [redacted] himself noted that he hired a limited service agent who would refund him most of the commission. Limited Service agency is actually not legal in Maryland, but that is not our concern here. Nicolas M [redacted] of Long and Foster did nothing to hide the condition of the flooring and certainly did not explain the backing of a flooring system he did not witness being installed.Please do review the supporting documents in our response to the MD Real Estate Commission complaint filed by Mr. ***. Long and Foster of South Boston, Va. cost me $5000 because of what they claim is a miscommunication of a counter offer I proposed. Buyers offered $135,000 and me pay them $5000 towards their closing costs. I countered, in the brokers office, with $150,000 and $5000 towards the buyers closing. The Long and Foster broker suggested I make the counter offer a flat $145,000 and I agreed. My mistake was trusting that the broker and agent would present the offer as agreed. The $5000 was still in play. Tax value on the house and property was $147,000. The buyers got one great deal at $140,000 due to Long and Foster, South Boston, Va. screw up and my misplaced trust. Do not do business with this branch...very unprofessional.

I am rejecting this response because: Hi ***,Thank you for following up on our complaint against MrM***, Long and FosterI'm not sure why I was unable to see their response via the Revdex.com websiteI received the email that you sent me with their response and four attachmentsBelow is my response.Thank you,***Response:Long and Foster is continuing to alter the truth and change the topic to place blame elsewhereThe inspector and buyers agent that we hired did their jobs honestlyThey may not have been as thorough as we would have liked, but they did not lie to usThe Long and Foster listing agent who represented the sale of the property blatantly lied to us about the ceramic kitchen tile floorOne should be able to trust the sales person showing and representing the sale of a propertyWe are filing this complaint to inform other consumers about Long and Foster's dishonesty during our interacting with them.Long and Foster and the listing agent are now furthering the deceit in their response to our complaint:1) "MrM*** was not involved in any way in the installation of the kitchen floor"- While showing the house, MrM*** mentioned that a person named "***" installed the kitchen tile floorHence, MrM*** at least had some involvement in the renovation work.- Regardless of whether or not MrM*** knew about or was involved in the floor installation, it does not change the fact that he claimed to know about the installation and lied about it.2) "This is all fully reflected and included in the response to the real estate commission complaint response given by MrM*** to the MD Real Estate Commission."- We just spoke to the MD Real Estate Commission and they told us that MrM*** did not provide any information regarding the person or company who installed the ceramic kitchen tile floorWe asked for this information months ago and MrM*** refused to provide itWe would very much still like to know who installed the floor.- The MD Real Estate Commission administratively dismissed our case due to lack of written evidenceAfter speaking with the case officer, I was lead to believe that the MD Real Estate Commission does not have the resources to investigate and peruse small claims where there is no written evidence.- Since the case was administratively dismissed, the MD Real Estate Commission did not speak with the witnesses (myself, MsTodd, MrVoilquin) that heard MrM*** tell us that the floor was installed correctly.- *** *** (###-###-####) was the case officer for our complaint (#***).Attached is a statement from one of the flooring experts that inspected the floor and an estimate to replace it

I received the email that you sent me with their response and four attachments. Below is my response.Thank you,[redacted]Response:Long and Foster is continuing to alter the truth and change the topic to place blame elsewhere. The Long and Foster listing agent who represented the sale of the property blatantly lied to us about the ceramic kitchen tile floor. - We just spoke to the MD Real Estate Commission and they told us that Mr. M[redacted] did not provide any information regarding the person or company who installed the ceramic kitchen tile floor. We asked for this information months ago and Mr. M[redacted] refused to provide it. We would very much still like to know who installed the floor.
- The MD Real Estate Commission administratively dismissed our case due to lack of written evidence. After speaking with the case officer, I was lead to believe that the MD Real Estate Commission does not have the resources to investigate and peruse small claims where there is no written evidence.
- Since the case was administratively dismissed, the MD Real Estate Commission did not speak with the witnesses (myself, Ms. Todd, Mr. Voilquin) that heard Mr. M[redacted] tell us that the floor was installed correctly.
- [redacted] (###-###-####) was the case officer for our complaint (#[redacted]).Attached is a statement from one of the flooring experts that inspected the floor and an estimate to replace it.

Review: I reached out to Long and Foster to list my home and look into the purchase of another. I was assigned Darlene N[redacted], and after the initial phone call, she has not responded to my email or returned the message I left her.Desired Settlement: I would like another agent assigned to me. One who will look into the home that I requested originally; and list mine if this home can be obtained.
