My mother has plenty of text messages from [redacted] regarding his attitude about finishing the job, and getting a permitNot only did he tell my mother several times we didn't need itHe told me himself that we didn't need it, even after I asked him about having a VA loanIt is not our job to go get a permit, or to know if we even need oneI don't own the company, and it's not me building the deckWhen my mother got the permit, they didn't even know who [redacted] was, or Longhorn Fence CompanyThat means [redacted] never pulls permits in Elizabethtown Ky., otherwise, they would know about himI had to track him down, via text message, myself, after not hearing from him for about a monthAs far as him getting in touch with usIt never happened! My mother has tracked him down via text message, a couple of times, because he said he was coming back, and never didThe only time he came back was one time after he was trying to be with my mother via text messageAll this after he verbally was talking to her about dating, and she said NO! I hope you can understand why my mother wants nothing to do with him, and why she is uncomfortable having him come back to try to fix anything he has caused to be messed upIf the deck was sound, and built the way it should have been, we wouldn't have all the necessary correctionsAll [redacted] is doing is back peddling, because we are seeking a refund, and hiring an attorney [redacted] acts like we never had any conversations verbally, or through text message about what he was intending to doExBuilding, cleaning, and staining the deckWe expected the deck to be built to codeHe owns a company for God sakeNever once was our having to buy the stain discussed [redacted] told my mother on several occasions that the stain cost $per bucket, but never ever once did he say we had to buy itHe said he would go to ***'s, and purchase the color of our choice, when we decided on a colorApparently, anything we discussed with [redacted] verbally doesn't even matter to him, or count nowHe is lying about several things now, and it is nothing short of annoying! Why is the inspector himself telling us not to use it? The one, and only time [redacted] came back to my house, he didn’t have any people with him to help him do the posts, like he said he was going to doHe ended up doing much of nothing to the deck, but he and my mom fixed the double drive fence gate together, because he had no helpers with himIf the only problem with the deck was the fact that around posts are out of plum, that wouldn’t be such a big issue to us, but that on top of the fact that it is not built well, or sound is my chief complaintHow does that happen, when you own a company? It makes no sense to meWe have had a couple of deck people out, and they recommend we start from scratchWe have to redo the entire back half of the deck, because or posts are out of plum, which throws off the entire back half of the deckOn the side of the deck around posts have to be redone, and that throws off that edge as wellSo, more than just a few things have to be corrected, and we don’t consider them minor, or easily fixed, nor does the inspectorIt’s off more than just a 1/of an inch like [redacted] claims! I know, as well as, my mother knows that he told the both of us on several occasions that we didn’t need a permit, unless the inspector came to the house and askedThen he would stop work and go get oneThe inspector is supposed to come by to inspect different aspects of the job and clear each step for the next in the processLike I’ve said before, no one at the Elizabethtown office has even heard of *** or his companyThey know my mother’s voice, as well as, her face and she’s only been in there like three timesIt’s a small office and they know their regularsJudging by all the code violations we have on our deck it’s very clear that *** didn’t know code and didn’t build to codeSome things are correctly built to code and some of the same exact things are not built to code in a different areaA great majority of things are not built to codeI don’t understand why you say you don’t buy materials, when you bought everything we needed for the deck except the stainMy mother has a text message that says, among other things, “I will seal the deck.” Never once did *** ask us to buy the material or did he ask us if we had the materialAgain, I have plenty of proof via text messageMy mother has at least text messages on her new phone aloneHowever, my phone company won’t allow me to get proof of all the text messages without a subpoenaThe inspector told us we had days to get the deck taken care of and that was on 11-21-The days has come and goneWe still don’t have a functioning deck that is built to code that we can useI don’t want to have my house considered uninhabitable because of the issues with my deck! I have sent over plenty of pictures and a few documents to verify my complaintWe would like a refund asapHe can either leave the deck as it stands, or he can come take it downEither way we want a refundTy

At no time did I ever say to them that you don't need a permit. I said in the city you do, I'm not sure in county, I'll find out. I got busy working and trying to get it finished, I dropped the ball on the permit. But if aa coder enforcement came and checked you, you stop work and go get the permit....

we continued to work on the deck and were getting close to finishing and noticed some deficiencies a few post the top was leaning in about a 1/16" didn't see this until top and side rails were installed. We showed this to the customer and told then we would fix it. About that time [redacted] said something about staining the deck. I told her if they get what stain they wanted that I had just bought a new sprayer and I would spray the deck. At no time prior was deck staining an issue or part of the agreement I was doing that to show appreciation for the work they gave me prior to the deck I installed approx. 400' of chain link fence. But at about this time [redacted] developed a migraine headache so we stopped work. This headache continued on and we agreed to come back and finish the job.eah had expressed concerns about my health and working so much.I   was going to slow down and finish a few small jobs. I picked up another job and started working on it .It really wasn't wasn't that big just a lot of detail and solid rock. Which naturally cause it to take longer than expected. The weather started changing also. [redacted] contacted me and I told her what was going on and asked her to bear with me for another week. In about the same time I Had a mini stroke leaving my left eye with temperory paralyze of the # 3 optic nerve the Dr said caused by to much stress.I was down about 4 weeks, they put a prisism on my glasses which me focuse and not see double. I returned to work depending on my crew to see what II couldn't clearly. I contacted [redacted] to make arrangements to finish the job. I couldn't do it because she was having company, we I tried again she dad dr app. I tried again she had Dr app. I had delivery of mat schudled without out knowing on the only day that week I could come. We just couldn't get our schudles in order. I informed them that I was booked until the 1st of the year taking in account all the holidays and the weather, I just left things along because I really need a breake. Then on Jan  3rd or 4th I had a certified letter native to pick up from the post office. That's when I found out they had filed a complaint against me a month earlier. I sent [redacted] a tex msg asking to meet with them and see if we could work this out. No that wasn't goin to happen. I called her daughter to try and talk to her, Leak answered the ph no that was not going to happen she informed me ot the attorney . I said if that's what you gotta do then go ahead.what I would like to see if someone can work it out. is to finish the deck to code. the violations are minor easily fixed. the deck is built well it sound and I see no reason to tear it down. This would not have happened if I could have finished it I had the time and people but you cannot control illiness you have to work with it. When I Said get someonelse to fininsh I was referring to if she had to have the deck stained right now, Because I couldn't get to it factors being wet wood and wind.At no time did I say I was finished with the job or I wasn't going to finish it. Aa far as expressing my feelings for her mom,yes we talked and texed back and forth. I told her that I shouldn't be sayings anything to her that it was unprofessional and I was still working for them. She said say what's on my mind. She said we could hang out depending on what we were doing because she wasn't a spring chicken anymore. The subject of maybe dating come up. She said she wasn't looking for that that she had lost her husband some time ago. I said I understand but if you change your mind in the future you  know my number. Out of respect for her the issue was dropped. That said the issue had or has any bearing on finishing the job.

We’re tired of going back and forth with you regarding the refund we have requested, when all you keep talking about is your lack of responsibility in the permit process. It’s very evident, and clear that you have a problem knowing, and following the permit process. That’s neither here, nor there at this point. Like we have said from the very beginning… We are requesting a refund. We’re tired of asking for it in every possible way we can. We have tried to achieve a refund in the least expensive manner possible, and you don’t even comment on that fact ever. It would be nice if you actually remarked on that matter. All you keep saying is you’ll come back. Only after you were put in the hot seat, did you decide it was actually time for you to come back. If you don’t pay for materials, as you’ve stated, who’s going to pay for all the materials that you thought we didn’t need from day one? We need new rails, posts, stairs, extra wood, etc.? It’s not our fault you built the deck wrong, and you didn’t charge us correctly, or according to code. Including the fencing job you’ve done, and say you stand behind, we don’t want you to come back here EVER!!! Let me say it again, we don’t want you to come back here again ever!!! We don’t trust your work ethic, your workmanship, or your word that you will do what should have been done in the first place!!! So, like we’ve said from the beginning, and keep saying, we want a refund. That’s what we’ve asked of you, since you decided you weren’t coming back to complete the job. If you’re unwilling to give us any kind of refund, we will be forced to hire the attorney that had us try to settle this matter ourselves, and in the least expensive way. We were told that you would be responsible for our legal fees, and we assume it’s going to be more than a refund would be at this point. We never would have wasted all this time with the Revdex.com, had we known it would be just a waste of time. The attorney suggested we exhaust all our avenues, and handle this matter without litigation; however, you have never once said anything about any sort of refund. PLEASE respond to our last attempt at getting a refund with a response regarding the refund itself. Without you saying a word… It’s very evident that you have no desire to give us a full refund, so what type of refund are you willing to negotiate on? Half our money back? You pay for someone else to come fix your mistakes, including materials? You pay for the materials that should have been included from day one? You pay for someone to come fix your mistakes? I never did tell them they wouldn't need a permit, I said if the inspector comes by I would stop and go get one. There are a couple posts out of line, I didn't realize they were out of line until I was putting the side rails on above the deck. I saw it and brought it to there attention, everything was out in the open that I was going to correct a couple of posts. I will need to correct those.We were working on the deck, she said something about staining it, I said I just bought a new sprayer and I'll stain it for you. I picked up the stain and I still have the stain sitting at the house.  The [redacted]'s will need to pay for the stain for the deck, as this was not part of the original contract but I'll stain it for them it's just they will need to pay for the stain.I'm still willing to finish the deck and go line by line item of the Inspection Sheet. I stand behind my work but I need to be able to finish the job. [redacted]
