Failed to remove trees he cut down, which was part of our agreement. On 3/11/15 I verbally contracted with Lopez Tree Service, [redacted] to cut down and remove 6 trees at my home, [redacted], for $2000.00. When the crew arrived I contracted with Mr. [redacted] to also remove a small brush pile in the backyard for an addition $150.After cutting down the trees, Mr. [redacted] asked for payment in cash and promised to return the next day to remove the trees. I paid him $2150.00 in cash. After he left, I discovered that he had dropped one of the trees from my backyard onto my left side (when facing my house) neighbor, [redacted], yard without securing her permission or mine.He did not return the next day and told me via the phone that his large truck was being repaired and he would come the following day. He did not, and this pattern was repeated daily until the next week when on 3/19/15 a truck belonging to a second company came to remove the trees. The driver informed me that it was his truck that had been broken. He further stated that he would have to drag the trees from my yard, which would cause considerable damage, and that he was unable to access the tree in my neighbor's yard at all. I was unwilling to allow this damage and he left. I immediately called Mr. [redacted] who said that he would repair any damage to my yard. He called the second company who called me back and said they could not return that day but would come the following day as long as there was no rain. There was no rain and they did not ever return.During the above, I informed Mr. [redacted] that it was clear that the tree in [redacted]' yard would need to be cut up and removed manually and that it was likely that all the trees would need to be removed this way. He attempted to charge me an additional $1000 to do this and ultimately agreed to remove the tree in Ms. [redacted]' yard in this fashion without further payment. I also told him that Ms. [redacted] was preparing to file a complaint with the NC Attorney General.After daily repetition of broken promises to return, Mr. [redacted] agreed to come on 3/25/15. Instead, a third company, [redacted], arrived on that date. They attempted to remove the tree on my front lawn but their skid loader caused considerable damage and they were both unable and unwilling to proceed. They attempted to remove trees from the right side yard but were unable to do so. They promised to return next week when they expected the ground to be dryer. They called Mr. [redacted] who agreed to come that afternoon to remove the [redacted]' tree. Mr. [redacted] did not come. When I called, he again told me his truck needed to be repaired and that he would come on 3/26/15. Ms. [redacted] agreed to withhold her complaint until that date. He removed the tree on my neighbor's yard a few days later and has refused to remove any others.Desired SettlementI had to pay another company to remove the trees. Including his failure to do what I already paid for, fees to the other company and the cost of repairing the damage to my lawn, I feel a refund of $1500 is appropriate.
