noted as well as recommended in every auctions details that it is solely the bidders responsibility to inspect each item before placing a bid on it. We are a consignment-based auction company & we do our best to describe each & every item being sold to the best of our knowledge. This tractor was on consignment thru an estate consignment, it was delivered to our facility, started & driven off the trailer & into out lot. The tractor started-drove-loader operated well therefore that was included in the description of the item when sold. The description indicated the details of the tractor; name-model#'s-engine size-options/accessories-awd options-etc. The high bidder of this tractor picked up and paid for it on the scheduled date, it was started & driven onto the trailer and hauled away. More than a couple of weeks later the buyer called Loretto Equipment to "inform" that the tractors AWD system was broken & not functioning, never during that phone conversation did he request any action or correspondence of any sort. Many weeks after this phone informative phone conversations the buyer sent complaints to the website K-Bid, who forwarded them onto Loretto Equipment. I contacted the buyer to speak to him about the situation & told him that this was an auction item purchased under the terms & conditions of "as is" "where is" etc & I apologized to him saying I cannot refund him for his item but I could & will re-sell the item at no cost to him. That offer was rejected. In my defense, the buyer was not treated with disrespect as indicated in the complaint & I did not yell & scream into the phone at the buyer nor were accusations made about this "all being his fault". I simply re-stated the terms & conditions, of this & all auctions on K-Bid.com, as being as-is where-is no warranties or refunds & its is the buyers responsibility to inspect each item before placing a bid. I offered a resolution to this issue, not the resolution the buyer was requesting, but a generous one none the less. (selling his item for no-charge)

When I called Loretto Eq to talk to them about the tractor and the fact the AWD was broken, I asked, for a refund. I was told "NO", as far as "Reselling" the tractor? Loretto Eq. said they "Would" resell it for my wife and I, ONLY, that this time, they would list the fact the AWD was broken and not working, which means, the tractor would sell for a LOWER price than what my wife and I paid for it. When Loretto Eq. called me, there was shouting and yelling. I was told that (A) Loretto, just takes items, (B) They do not check the item or items out "COMPLETELY" (C) If you read the auction bid for this auction, all the tractors HAD the same wording, which means, NONE of the tractors SOLD that day, where CHECKED or tested to """RUNS & OPERATES WELL"""

Loretto Equipment has provided more than enough explanation to this issue. The bottom line is the item was purchased on auction under specified "terms & conditions" in which the buyer was required to & DID agree to before placing a bid. The buyer did NOT inspect the item prior to purchase as well as failed to do so even after purchase before leaving with the item. Had this issue been known prior to the sale Loretto Equipment would have indicated any known issues (per usual) in the description of the item. Although the information provided in descriptions is to the best of our knowledge, any indications noted in the description do NOT supersede the terms & conditions of purchasing any item on auction. All items are sold "As-Is, Where-Is, No Guarantees, No Warranties, No Refunds. It is the responsibility of the buyer to inspect items before purchase.
It is unfortunate that the buyer was not satisfied with the purchase of his item; although Loretto Equipment is not obligated to offer any resolution to the buyers situation, a courteous offer to resell the item at no cost was presented.
