I certainly understand this client’s frustration She has been trying to establish a company with what seems to her a lot of obstacles.When she first came to see me, she had no company name nor domain to register *** *** *** *** ** *** *** *** *** *** ** *** *** *** ***
*** *** *** *** *** *** She was very passionate about her venture, and we seemed to agree and connect during our conversation She told me she had two names she was considering but would be registering one We searched the names while we were first meeting and I indicated which ones were available for sale as domain names She selected the name and we committed to working with it as her domain She indicated she was in a hurry to get the site up, that she had gathered years of experience and now capital for the launch of her business We agreed to begin with a basic number of items for sale on her site and that she would be contacting the wholesalers to arrange images and copy for the items she was selling.During this hour meeting, this client indicated that she had looked at other designers and was being quoted closer to $10,for this siteAfter a lengthy discussion about what she was looking for, we came to what I considered a very good arrangement for completing her project Since she was referred to me, I took that into consideration in her quote and I agreed to put it as my main priority My quote was for $3,to design it up to items on her store This did not include the purchase of the domain at $each and the hosting, which usually is around $for a year package Both of these purchases are made separately so that the owner of the site owns these as well One question I always ask: Are you the person who makes the decisions for your website? When asked, she said she was the sole owner of the company I was pleased, since I like to specialize in helping women who are starting up in business We agreed that I would take the required 50% deposit, she would finalize the items for sale and let me know by text to purchase the domain She said she wanted to make sure the name was the right one After the meeting, we tried to run her card through my debit machine, but as per usual in our basement location, the signal didn’t work So she gave me her credit card number and I ran the charge as part of my day’s closing when I had the cell signal later that day As agreed, I would forward a statement on the following Monday, including the deposit for the site and once I received her go ahead for the domain name would proceed with purchasing it and setting up her site When contacted next, she indicated she wanted me to purchase the domain name My understanding of that message was to proceed with our agreement and set up the site Later that same day, she indicated that she had discussed it with her husband and he did not want her to do the site So she wanted to stop the site build I would like to say that the meeting took place late on a Friday afternoon She texted to purchase the domain early Saturday morning I was not working that weekend When I did finally have contact with her later that day, it was then I realized she had meant to only purchase the domain name But earlier on Friday, she had okayed the purchase, given me her card and even waited as I tried to run it through my debit machine times When she contacted me later on Saturday, I received a lash of emotion that wasn’t warranted for what I understood to be the misunderstanding She said her husband had decided he did not want her to build the site at all It was a bit of a shock, since she had indicated that she was the one in control of the decisions Since our Merchant Services account is not set up for refunds, (indeed, our company policy is no refunds, exchange only) I indicated I would have to gather the funds again as they had been distributed to begin the site There was no indication on my part that I would call the bank or that there was an error in processing the transaction as, to my knowledge, I was processing a deposit on a verbal agreement for a contract In November of 2016, we experienced a significant reduction in one of our businesses (The Dojo) and gave notice to leave the space we were occupying This stress and the lack of income has resulted in our inability to refund as quickly as our client would like, and we very much appreciate her frustration, as we are experiencing the same. To create revenue, I began to increase my marketing and website business and this is beginning to offset this reduction. ** *** ** *** *** *** *** * *** *** *** *** *** *** *** *** *** *** *** *** ** ** *** *** *** *** ** *** *** * *** *** ** *** *** *** *** *** ** *** *** ** *** *** *** *** *** With regard to her claim that we are a danger to her and our community I am willing to offer our service record and other client testimonials as proof that we are most definitely the opposite in character This is why we were referred in the first place However, this situation is obviously filled with misunderstanding and has not followed the process I deeply regret it occurring. I have found that the language and the angry threats that have been directed to us from this particular client have made me very focused on completely eliminating it from our life It has affected the healing we are attempting to do here and I have asked the client to discontinue contacting me by text, and to only contact us by email as the last communication caused my husband undue stress when he used the phone The client is misleading you, as I have refunded $to date, and have indicated that I will refund until complete including interest, which she has indicated will be in the neighbourhood of $ The client’s claim states that I have not paid anything, even to cover the interest Given the math, I believe I have done very close to both I have made one payment to our client since my husband’s heart surgery, even though I did not pay my credit card, gas or power and will continue to do so as often as possible I have put payment to this client above these necessities as her method of communication is very volatile, and I am aware the only way to discontinue it is to finish it During the last contact, I merely indicated that I had sent a transfer of money and was forced to stop the communication as it turned fierce again While I completely understand her anger, I am attempting to make resolution There was no mention at that time that she had contacted you I have changed my business processes drastically and am adopting new policies since this situation occurred, including a detailed questionnaire about their readiness to proceed with our services and a contract that is signed immediately I no longer accept verbal agreements as contracts, although I understand they are legally binding I understand that this situation is completely untenable for both parties and will attempt resolution as soon as possible As you have requested, I will continue to attempt positive communication and make payment to this customer as quickly as possible so that it is resolved for both parties.If you require any other questions answered or information, please do not hesitate to contact me. I am rejecting this response because: Lorie Saito has taken it upon herself to pay me $1000.00, bringing her total repayment to $1450.00. Lorie is quite aware that she owes a total of $and has told me this is all i'm getting.I'm not satisfied, and the total repayment of $(plus interest charges) is what I continue to insist she pay me.I'm not prepared to settle this based on what Lorie seems to think is fair Who does she think she is?
