I purchased a new build town home in 2016 (*** Commons). Upon move in, I connected with *** to advise the builders left plastic on the 3rd storey window.
No one came by to remove it.
I added it to the 30 day Tarion warranty list. I was promised it would be removed. It wasn't.
I added it to the 1 year Tarion warranty list of outstanding items (2017). I was assured by *** that the order was placed to have someone remove the plastic. This item is still outstanding.
I am in the process of listing my home and need it removed. I have made several attempts to get this resolved and have been told *** has to wait until the spring to remove it.

Desired Outcome

That a contractor attend the site and remove the plastic in the next week. Or that I bill *** with the cost I will incur as a result.

Hi,
My family purchased brand new town house from Losani Homes.The builder agreed in writing to give us interim occupancy starting from June 04,2018 which we accepted through ***,Director,Human Resources & Customer Experience for Losani Homes.Our final closing of house took place on October 05,2018.We received the complete file of our closing of the house from our lawyer the first week of December 2018.Our layers statement showed that the interim occupancy was started from the month of May 2018. Losani Hoomes charged the occupancy fee of month of May and not starting from June 04,2018.This is clear violation on ***,business and professional grounds.Mr. *** agreed in writing through his emials that the occupancy date shall be starting from June 04,2018.I have trail record of his emails which shows that the interim occupancy stating date is June 04,2018.I wrote an email to Mr. *** on December 10,2018 and explained him my lawyer's statement regarding the final closing of our town house,following is his answer,
"I am following up with our legal office not sure why this happened."
I waited for considerable time to let them take care of my issue.For almost one month I did not receive any answer from Mr.,I sent him an email on January 11,2019 to get any update regarding my issue.It is almost two weeks and there is no answer from Losani Homes or any of their representative.Now I took this step and let Revdex.com take care of my family's issue with Losani Homes.The builder has very good reputation but it is very sad to see that they are overcharging us for the month of May.
We have complete record of all emails in which the builder is agreed to start our interim occupancy from June 04,2018 but still they charged us more in the final statement.

Desired Outcome

Losani Homes should make all calculations regarding the closing of our house starting from June 04,2018.Whatever they charged us extra should return us with an apology for causing inconvenience.

We reviewed this matter in detail. The Consumer was provided with the option of delaying interim occupancy of this condominium unit until June 2018, but instead commenced interim occupancy on May 3, 2018. The statutory occupancy fees charged to the consumer commenced on that actual occupancy date. We agree that fees should not be charged for a time frame prior to an occupancy date, however in this case the fees were charged correctly from the actual date that the consumer took occupancy of the unit. We would be pleased to send written confirmation of the actual occupancy date upon request. The interim occupancy took place between solicitors so it was recorded in correspondence.

I read the written response of Losani Homes very carefully and comprehensively.It is absolutely unacceptable and completely contrary to the actual facts.I would present here all the documentary evidence of Losani Homes in which they agreed in writing to start the interim occupancy on June 04,2018.Following is the email response written by a responsible Losani Homes employee,Mr. ***,Director Human Resources & Customer Experience,
On Thursday, May 3, 2018, 11:37:03 a.m. EDT, *** wrote:
Good Morning Mr. and Mrs.,
Upon review of the below email, we are willing to extend your occupancy to June 1st, without the application of any occupancy fee to you. We always hope to work alongside our valued homeowners to help alleviate their concerns, and hopefully I can explain some of the expectation for a new build, in this current phase of construction, to you.
Should you have more questions, please feel free to contact myself and we will be pleased to help you.

There is second email response of Mr. in December 2018 which shows there is no consideration of occupancy in the month of May. I am copying the exact wording of email text here,
On Monday, December 10, 2018, 11:15:43 a.m. EST, *** wrote:

Both above mentioned emails clearly show that Losani Homes agreed in writing to start the occupancy from June 04,2018.
An other important aspect to highlight is that PDI(Pre Delivery Inspection) performed on Friday, June 01,2018.(Email proof can be provided)
Thre is no proof,we ever received the house keys in the month of May.
Now I explain the second part of the issue.Losani Homes claimed in their response that the lawyer has copy of the occupancy signed on May 03,2018.Yes,we were threatened to accept the agreement on the said date otherwise we will be out of the deal, losing our deposit money as well as the house.This acceptance was under *** and we are consulting legal experts to file formal complaint against Losani Lawyer to Law Society of Ontario.
