In response to the above complaints. We have gone back out to the home 11/23 to look at the roof issue. The roof has not leaked and is functioning properly. The area of raised shingles is where the Flashing is. The shingles overlay the flashing as intended. There is no...
workmanship issue with this. To remove them would cause the roof to not function properly causing leaks into the home. The home was also inspected and signed off by her and the mortgage company. As for the other issues with the driveway and drainage. The home was graded and there has been no flooding into the structure of the home. We have had multiple rain events since the time of purchase. As for the driveway and the culvert. It should be noted that the driveway is crushed road base. Therefore any heavy rains can cause it to washout. The county road department inspects and approves driveway/culvert installations. They deemed it acceptable and issued an approved permit. The home is under warranty for structural issues. The drainage and driveway issues are not a builder issue unless it causes damage to the structure itself. In this case nothing has happened to the home. The deck was removed and repaired at the discretion of the owner. We do not do landscaping services for the home and this was made clear. So on the demand for settlement there is not a responsibility on our part to pay for what she has chosen to do.

I am rejecting this response because:
I retired from federal service, moved back to home town to be with family and thought it would be nice to buy a home. I was pre qualified paid 10 %down payment conventional and thought I would not have to pay for a drive way (20 degree slope over drainage) which was not the rain but cheap workmanship. The rain did wash away the drive but it should have stayed. The comal county is not responsible for the driveway only the road and pipe drain. They dont approve your poor workmanship. and when it rained, it filled up the back next to house. spending money from my retirement was not planned. When I first moved in I had to have three professionals tell me the entire tiled floor needed sealing. So he sent 5 people over to have this done (this was not caught my him or the mortgage co). In fact he played dumb as usual about this and everything that was wrong with the home and he still knows but playing dumb.The only reason he had the floor done because it didn't cost him anything, the subcontractor sent his workers over but they didn't know they weren't being paid. Additionally, a ceiling fan was turned on and almost fell off. He did replaced it but this is what I had to deal with from the time I moved in I had to find the hidden problems in the house and some are not noticed. I am overwhelmed by these hidden problems and his scam. The hidden problems continue as I have found a tub (2nd) bath that was patched. Now the plumber and Losaw said they will have it fixed. This is a new home, I would expect all of these problems in a used home but not in a new one. This is why I bought a new home so I wouldn't have these problems because of my age of 69 with a nerve issue in the back with surgery planned. I plan everything but this home is a nightmare because the builder left me with his mess.Each problem has been verbally and written to the builder (Losaw). He knows about the poor driveway(incline)and and the water fill up in back of home from the before I moved in(mar 3). I thought he would honor his code of ethics and fix the problem but each time he has put me off so I had to fix the problem. I requested 3 professionals to give me estimates and when it began to.rain I thought if I don't fix it I would not get in my home. As far as the roof, I will have a professional come over and give me a review. To be continued.Here is the breakdown behind the house and the drainage:This one area behind the home was estimated from a professional contractors to cost $7, 000 . I feel he knew about this water, drainage and cost and decided to put the cost on to me. I had several other estimates and the costs was the same with a retaining wall but I found a group that would do it without a retaining wall. This group had to remove the deck because it was 1 foot from cliff (no room to get machine back there); the idea was to push back the ledge 5 feet, move all the dirt and cliff large rocks creating a new lip or cliff 5 feet higher, then created a large berm(3 feet high)behind along the 40-50 feet length across the back to divert the water from the back of home, graded the back, then placed river rock for drainage and finally replaced deck. They realized it was taking too much time and.left the deck unfinished and unlevel. Hired another guy to complete. I have driven by several of his home and realize he left the cliff directly behind the home, I ask the group about Losaw, said he is noted to leave this problem they have corrected many of his homes with same problem. This was not my choice to have spent 6000 of my retirement money to correct this builders non professional messes which is why I want all to know. I think people who buy his homes just accept this messAgain, I had to correct this mess because I was afraid the slope of driveway would deteriorate. My family and I didn't want to drive on it, it was dangerous. Losaw knew the problem but chose to ignore my plea for help so that is why I had to correct this very dangerous situation As far as the back of home, my neighbor told the builder it was a bad idea to leave the ditch. Before I moved in my realtor and I request the builder to pull the cliff back and open it up. He said he can't get heavy equipment back there. My neighbors know about his negligence and told me he did me "no" favors. He accepts poor workmanship or hires people that do not have quality checks.. Many of the other builders grade and provide drive ways that dont wash away or have standing water.This builder took advantage of me and left a mess for me to clean up. I thought I was retired but it is a full time job working on this mess.
